A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, APPROVING
THE CITY OF TAMARAC LEGISLATIVE AGENDA
FOR THE 2023 STATE OF FLORIDA
LEGISLATIVE SESSION; DIRECTING THE CITY
CLERK TO TRANSMIT A COPY OF THE CITY OF
TAMARAC LEGISLATIVE AGENDA FOR THE
2023 STATE LEGISLATIVE SESSION TO THE
FLORIDA LEAGUE OF CITIES, THE BROWARD
LEAGUE OF CITIES, THE BROWARD COUNTY
LEGISLATIVE DELEGATION AND THE
BROWARD COUNTY BOARD OF COUNTY
COMMISSIONERS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac actively monitors and comments on
Federal, State and local legislation that may impact the City and its residential and
business communities; and
WHEREAS, the City of Tamarac has developed a Legislative Agenda for
the 2023 State of Florida Legislative Session outlining the City's position on
particular legislative issues, attached hereto as Exhibit A; and
WHEREAS, the City Manager and the Assistant to the City Manager
recommend approval and distribution of the City of Tamarac Legislative Agenda
for the 2023 State of Florida Legislative Session; and

WHEREAS, the City Commission of the City of Tamarac, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve
the City of Tamarac Legislative Agenda for the 2023 State of Florida Legislative
Session and direct the City Clerk to transmit a copy of said Agenda to the Florida
League of Cities, the Broward League of Cities, the Broward County Legislative
Delegation and the Broward County Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution. All exhibits attached hereto are incorporated herein and made a
specific part of this Resolution.
SECTION 2: The City of Tamarac Legislative Agenda for the 2023 State of
Florida Legislative Session is hereby approved.
SECTION 3: The City Clerk is hereby directed to transmit a copy of the City
of Tamarac Legislative Agenda for the 2023 State of Florida Legislative Session
to the Florida League of Cities, the Broward League of Cities, the Broward County
Legislative Delegation and the Broward County Board of County Commissioners.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon
adoption.

Municipal Revenue Protection
The City of Tamarac supports legislation that protects a diversified local government
revenue base ensuring the City's ability to provide adequate services for its residential
and business communities.
The City supports legislation that preserves municipal authority: authority to Levy ad -
valorem and non -ad -valorem assessments; establish service fees, levy local business
tax; issue tax -supported debt; and collect other revenues to carry out City business
effectively, efficiently, and prudently balance its budget.
The City also supports legislation that protects general revenues collected from Local
Business Tax, Tax on Rental or License Fee for Use of Real Property, Communications
Services Tax, and other shared revenue sources.
Resiliency and Water Funding
The City of Tamarac supports legislation that provides long-term, recurring, and
adequate state funding distributed equitably throughout the State for local government.
The City supports funding for water quality improvement, water conservation and
stormwater projects and technology/infrastructure, including projects that reduce
nutrient and pollutant loading from wastewater sources, mitigate stormwater and
flooding impacts and increase available water resources and supplies. Such investment
is necessary for the City's and regional long-term sustainability and resilience to
extreme weather events.
The City further supports the State in creating a mechanism to provide funding relief for
private property owners to address private seawall infrastructure. Due to its
interconnectivity with local and, ultimately, regional systems, maintaining such
infrastructure is essential to maintain the integrity of the public water and stormwater
systems.
Transportation Funding
The City supports legislation that preserves local control of transportation planning,
provides a more equitable transportation funding formula between municipalities and
counties, and provides additional dedicated revenue options for municipal transportation
infrastructure and transit projects. Additionally, the City supports legislation that
provides opportunities for City input and collaboration on State projects.
The City of Tamarac supports legislation that provides funding for publicly available
electric vehicle charging infrastructure and real-time traffic information systems.
Recreation and Green Space Funding
The City of Tamarac supports legislation that funds and protects the Land and Water
Conservation Fund (LWCF) and the Florida Forever Fund, including Florida
Communities Trust and Florida Recreation Development Assistance Program (FRDAP).
Government funding for acquiring and developing green space, recreational land, and
land conservation is a high priority for bringing communities together, providing
opportunities to improve mental and physical health, and reducing inequalities.
Protection of Home Rule
The City of Tamarac supports legislation that protects local control, thus ensuring
municipal capacity to respond to the local community's needs effectively and efficiently.
Elected local municipal representatives ensure that the local community's standards of
living and safety are maintained, preserve the unique characteristics of the community,
and are better able to address local issues promptly by implementing solutions that are
specific to the community.
Sovereign Immunity
The City of Tamarac supports the existing statutory limits for damages regarding the
liability for tort claims against the state and its agencies and subdivisions (including
cities).
Economic Development
The City of Tamarac supports legislation promoting business attraction, safe and secure
businesses, retention, and expansion, to support the creation and retention of jobs that
pay a living wage and assist small local businesses. State funding of economic
incentive programs, such as the restoration of the Qualified Target Industry (QTI) Tax
Refund Program, is vital for the local and statewide economy and residents' quality of
life.
High Quality Public Education
The City of Tamarac urges the State legislature and the local school districts to find a
joint solution that would improve the lower -performing local schools and expand quality
education options available to all students. Proper resource deployment is vital to
address the decline in student performance. Quality education is essential to the quality
of life of Tamarac residents and the residents of the State of Florida. Furthermore, the
quality of education at all stages of the educational continuum is a major success factor
for economic development in the region and locally. Thus, the public education system
must build a solid foundation for the future success of all children in Florida.
The City of Tamarac supports State funding for teacher salaries and bonuses to retain
and attract the best talent to improve the lower -performing schools.
School Safety Funding
The City of Tamarac supports the State of Florida budgeting practices that ensure
consistent and adequate allocation of State funds to school safety initiatives for all
public schools in Florida. One of Tamarac's top priorities is the safety of students,
teachers, school staff, all City residents, visitors, and businesses. The City urges the
State of Florida to develop a fair and equitable funding formula to implement the school
safety initiatives, such as funding for School Resource Officers (SROs).
Transit Oriented Development (TOD)
The City of Tamarac supports legislation promoting development that includes a mixed -
use of housing, office, retail space, and amenities integrated into a walkable
neighborhood close to public transportation. TODs provide better access to employment
and housing for people of all ages and incomes. TODs help to enhance connectivity for
area residents and businesses, leading to safer accessibility to jobs, companies,
residential and commercial districts, and schools.
Affordable Housing and Rental Assistance
The City of Tamarac supports legislation that requires all money from the Sadowski
State and Local Housing Trust Fund be used for Florida's affordable housing programs
that are targeted to meet the needs of workforce housing, including home ownership
and rental availability.
Compensation for Eligible Victims of Wrongful Incarceration
The City of Tamarac support the expansion of eligibility to receive compensation for
wrongful incarceration by eliminating ineligibility for wrongfully incarcerated persons who
had a prior felony or more than one felony before their wrongful conviction and
extending the filing deadline for a petition claiming wrongful incarceration.
Homelessness and Human Services
The City of Tamarac supports legislation that promotes and provides programs that
serve our most vulnerable populations, including but not limited to funding to address
homelessness, mental and behavioral health services, addiction, domestic violence,
and reentry programs for previously incarcerated people.
Behavioral Health Access Program (BHAP) and Workplace Mental Health
The City of Tamarac supports legislation that funds, promotes, and provides programs
that aim to assess, educate, minimize the impact of stress, improve quality of life, and
return employees experiencing significant challenges to a healthy, productive state.
BHAP incorporates the services of Critical Incident Stress Management (CISM), peer
support, trained peer support specialists, and trained professionals, such as department
chaplains, physicians, psychologists, counselors, and Employee Assistance Programs
(EAP) professionals. These tools provide a diversified resource pool that may be utilized
by employees and family members experiencing an acute crisis or everyday stress.
The City of Tamarac has partnered with its medical services provider, neighboring
cities, the International City and County Management Association (ICMA), as well as the
American Psychological Association, American Public Health Association, National
League of Cities, and the YMCA of the USA to advance its commitment to improving
workplace mental health.
Security
The City of Tamarac supports legislation that provides funding for improving both
physical security and cybersecurity at and within municipalities, as well as for business
districts and residential areas.
Cell Phone Tower Regulation
There has been massive growth in cellphone towers, masts, and antennas, 5G
networks, and other technologies. The City of Tamarac supports legislation that protects
a local government's ability to regulate cellular (and other types of) communications
tower infrastructure for aesthetic considerations, community safety, and protecting
home rule for land development regulation.
