R-2023 - 01 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING CHANGE ORDER 5 TO THE CONTRACT WITH UNITEC, INC., FOR THE FIBER NETWORK EXPANSION (PHASE 2), TO ADD ADDITIONAL FIBER NETWORK EXPANSION SCOPE MODIFICATIONS AND AN EXTENSION OF TIME TO THE CONTRACT, AT A COST NOT TO EXCEED $76,000.00, INCREASING THE CONTRACT FROM A TOTAL OF $1,236,045.00 TO A TOTAL OF $1,312,045.00; AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO MAKE CHANGES AND ISSUE CHANGE ORDERS IN ACCORDANCE WITH THE THRESHOLDS AND PROVISIONS DELINEATED IN SECTION 6- 147(J)(2) OF THE TAMARAC PROCUREMENT CODE; AUTHORIZING AN ADDITIONAL APPROPRIATION IN THE AMOUNT NOT TO EXCEED $36,368.00 TO BE INCLUDED IN A FUTURE BUDGET AMENDMENT PURSUANT TO F.S. 166.241(2); AUTHORIZING EXPENDITURES FROM THE APPROPRIATE ACCOUNTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER ERRORS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and Temp. Reso. #13866 February 8, 2023 Page 2 of 7 WHEREAS, technology is one of the key components in the efficient delivery of City services, and the City's network infrastructure is critical to ensuring continued operations; and WHEREAS, on May 26, 2021, the City Commission approved Resolution R-2021- 059 awarding IFB NO. 21-11B to Unitec, Inc. for Fiber Network Expansion (Phase 2), at a total contract cost of $1,146,070.00, with an initial 10% contingency amount of $114,607.00, for a total project budget of $1,260,677.00; and WHEREAS, on November 15, 2021, the City of Tamarac approved Change Order 1, in the amount of $8,250.00, for work to provide a direct fiber network connection to the Network Operations Center (NOC) from City Hall and the Water Treatment Plant as well as from and for a secondary Dedicated Internet Access (DIA) Circuit at the Recreation Center, paid out of contingency, and also authorizing an extension of forty-five (45) days; and WHEREAS, on February 7, 2022, the City approved Change Order 2, in the amount of $6,150.00, for work to complete the fiber network connection to the new Tamarac Sports Complex Concession Stand 2, paid out of contingency, and also authorizing an extension of ninety (90) days; and WHEREAS, on June 23, 2022, the City of Tamarac approved Change Order 3, in the amount of $53,095.00, for work to install fiber cabling within the Dog Park / Veterans Park and to Tamarac Commons Park, paid out of contingency, and also authorizing an extension of one hundred (100) days; and Temp. Reso. #13866 February 8, 2023 Page 3 of 7 WHEREAS, on January 11, 2023, the City of Tamarac approved Change Order 4, in the amount of $22,480.00, for work to relocate existing hand holes near Caporella Park and to install fiber cabling at the BSO Tamarac District HQ, paid out of contingency, and also authorizing an extension of sixty (60) days; and WHEREAS, on or about September 15, 2022, the City, while performing due diligence and testing, discovered that newly installed fiber optic cabling was non- operational and ultimately had suffered a fiber cut resulting from work performed by Horsepower Electric, Inc. and its subcontractor Florida Sol Systems, Inc. as part of a Broward County project; and where to present, Broward County, Horsepower Electric, Inc. and its subcontractor Florida Sol Systems, Inc. have refused to remedy the damage; and WHEREAS, while continuing to pursue legal remedies and working to recover repair costs from Broward County and its contractors / sub -contractors, the City desires to complete fiber network repairs as soon as possible; and WHEREAS, the City received a proposal from Unitec, Inc. for material and labor required to repair / replace damaged conduit and fiber cabling, at a total cost of $76,000; and WHEREAS, funding is available in FY2021 Capital Improvement Project (CIP) budget, Project GP22A Contingency in the amount of $24,632.00; as well as in the Information Technology FY2023 Budget in the amount of $15,000.00; and WHEREAS, an additional appropriation of $36,368.00 will be required and will be included in a future budget amendment pursuant to Section F.S. 166.241(2); and Temp. Reso. #13866 February 8, 2023 Page 4 of 7 WHEREAS, it is the recommendation of the Interim Director of Information Technology that the City Commission approve Change Order 5, attached hereto as Exhibit 5, to the contract with Unitec, Inc. for the Fiber Network Expansion (Phase 2) Project scope modifications required to repair / replace conduit and fiber cabling damaged as a result of a fiber cut, including an extension of time not to exceed one hundred forty (140) calendar days, in the amount not to exceed $76,000.00, increasing the contract from a total of $1,236,045.00 (which includes Change Orders 1, 2, 3 and 4) to a total of $1,312,045.00-1 and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve Change Order 5, attached hereto as Exhibit 5, to the contract with Unitec, Inc. for the Fiber Network Expansion (Phase 2) Project scope modifications required to repair / replace conduit and fiber cabling damaged as a result of a fiber cut, including an extension of time not to exceed one hundred forty (140) calendar days, in the amount not to exceed $76,000.00, increasing the contract from a total of $1,236,045.00 (which includes Change Orders 1, 2, 3 and 4) to a total of $1,312,045.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1. The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. The City Commission hereby approves and authorizes Change Order 5, to the contract with Unitec, Inc. for the Fiber Network Expansion (Phase 2), to add the additional fiber network expansion scope modifications required to repair / replace damaged conduit and fiber cabling, including an extension of time not to exceed one hundred forty (140) calendar days, in the amount not to exceed $76,000.00, increasing the contract from a total of $1,236,045.00 (which includes Change Orders 1, 2, 3 and 4) to a total of $1,312,045.00, and further authorizes the appropriate City Officials to execute all necessary documents to effectuate Change Order 5. Section 3. The appropriate City Officials are hereby authorized to expend an amount not to exceed $1,312,045.00 for said purpose. Section 4. Funding is available in FY2021 Capital Improvement Project (CIP) budget, Project GP22A Contingency in the amount of $24,632.00; as well as in the Information Technology FY2023 Budget in the amount of $15,000.00. An additional appropriation of $36,368.00 will be required and will be included in a future budget amendment pursuant to Section F.S. 166.241(2). Section 5. The City Manager or her designee is hereby authorized to approve and initiate change orders in amounts not to exceed $65,000 per section 6-147 of the City Code and close the contract award which includes but is not limited to making final payment and releasing bonds per section 6-149 of the City Code when the work has been successfully completed within the terms, conditions and pricing of the agreement. Any scrivener or typographical errors that do not affect intent of this Resolution may be corrected with notice to and authorization of the City Attorney and City Manager without further process. Section 8. If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. (Note: For D/A Circuit). Total Change Order: $8,250.00 B. Increase Unitec's contract time in consideration of loss time due to material shortages caused by the current pandemic (Covid-19). The delay negatively affected the productivity and fabrication of construction materials in meeting scheduled installation timelines in accordance with the project's completion dates. The progress of the work (as a whole), has impacted the critical path of the project schedule. Accordingly, an extension of time not to exceed forty-five (45) calendar days shall be granted to the contractor for the project's completion schedule. The project's Substantial Completion shall be adjusted from 195 calendar days to 240 calendar days from Notice to Proceed (NTP). Final Completion shall be adjusted from 240 calendar days to 285 calendar days from Notice to Proceed (NTP). PURPOSE OF CHANGE ORDER: The purpose of this change order is to document the contract scope modification listed here -in, regarding proposed changes by the City for the Fiber Network Expansion Phase 2 Project. The work as described above, shall include all labor & materials as required to complete the work. Additionally, an extension of time shall be granted to the contractor due to delays caused by the current pandemic (Covid-19). Issue: The approval of Change Order No. 2 for the City of Tamarac's Fiber Network Expansion (Phase 2) Project to document an increase in Unitec, Inc.'s contract value resulting from the added scope changes to the project (pulling of 48 strand single -mode fiber cable and added 2" conduit raceway for AT&T services at the Tamarac Sports Complex, Concession Stand 2) and an increase in the contract time resulting from project delays due to Broward County permitting process and AT&T's untraceable dielectric fiber lines as outlined below, in accordance with the Fiber Network Expansion (Phase 2) Project requirements. Background: As part of the Fiber Network Expansion Project (Phase 2), the following field modifications and added scope changes to the project were made: Fiber Network scope changes at the new Tamarac Sports Complex, Concession Stand 2 facility — As part of the Fiber Network Expansion (Phase 1) project, a 48-strand single -mode, plenum rated fiber cable was pulled to a nearby hand hole but was unable to be terminated in its intended location (new Concession Building). At that time, the existing Concession Building was scheduled to be demolished to make way for the construction of the new Concession Building. As such, the contractor (Hypower) was released from the final termination work and a credit was issued for the project. As the new Concession Building is now built, the need for the fiber cable to be terminated is warranted. As such, during the progression of the project, it was determined that the existing 48- strand single -mode, plenum -rated (CommScope) fiber cable (inside fiber vault located east of the new Concession Building), shall be pulled, and terminated to a new cassette in the existing fiber patch panel inside the new Concession Building IT Data Closet (2nd floor). This work would best serve to provide for a direct fiber network connection to the new Sports Complex Concession Building and allow for fiber connectivity to the Network Operations Center (NOC) and Recreation Center from the Backbone Fiber Cable (Phase 1). 2. As part of the scope changes, an additional raceway (2" conduit) is required to be provided and installed from City's fiber vault (hand hole) located east of the new Tamarac Sports Complex, Concession Stand 2 facility up to AT&T's Terminal located on the south side of the adjacent building (1-story building, east of new Concession Building) via a stub up. The proposed conduit will serve as a point-to-point raceway, allowing for AT&T to run the City's required phone services into the new Tamarac Sports Complex, Concession Stand 2 facility. Based on Unitec's ongoing work with the City, their availability, and their expertise to perform the work in an expeditious manner, it was determined to be the most efficient and economical direction to have Unitec perform the necessary work (short conduit installation). 3. In consideration of lost time due to permitting delays caused by Broward County and delays caused by AT&T's inability to trace their buried dielectric fiber lines along Commercial Blvd and McNab Road in a timely manner, an extension of time is required. The delay has negatively affected the progression of the project (as a whole), impacting the critical path of the project completion schedule. Accordingly, an adjustment for an extension of time not to exceed ninety (90) calendar days shall be granted to the contractor for the project's Substantial and Final completion schedule. The project's Substantial Completion shall be adjusted from two hundred forty (240) calendar days to three hundred thirty (330) calendar days from Notice to Proceed (NTP). Final Completion shall be adjusted from two hundred eighty-five (285) calendar days to three hundred seventy-five (375) calendar days from Notice to Proceed (NTP). Amount of Change Order Total: $6,150.00 Fiscal Impact This Change Order will increase the original contract amount, in the amount not -to -exceed $6,150.00. Per Resolution No. R-2021-059, the City Commission approved a contingency in the amount of $114,607.00 to the project amount, with $106,357.00 available in contingency. Accordingly, the procurement of the added scope will come from that approved contingency. The City's network infrastructure is built around a private, fiber optic, Wide Area Network (WAN), which provides high-speed network connectivity to City facilities, enabling the City to take advantage of and utilize cost saving technologies. The Information Technology Department has engineered its network to use state-of-the-art Cisco switches, routers and firewalls, all connected by the City's fiber optic network. Expansion of the City's existing fiber network is a key component of implementing the City's Security Master Plan in major City facilities, improving public safety and security and to provide public WiFi access in parks. Fiber Network Expansion (Phase 2) Change Order 3 1 1 P a g e Much of the City's existing fiber optic network is "above -ground" on utility poles, and is also therefore prone to disruption if there is a disaster or storm -related event. For all new fiber network connections, all cabling has been installed "underground" for resiliency and disaster preparedness. Fiber network expansion has been a phased approach. The Fiber Network Expansion (Phase 1) project was approved by City of Tamarac Resolution R-2019-16, on file with the City Clerk's Office, on January 23, 2019, with a total final cost of $1,569,314.50, and provided a continuous, underground fiber network backbone from the IT / Public Services Building (Network Operations Center) to the Recreation Center, and expanded the fiber network to, and within, the following locations: • Tamarac Sports Complex • Veterans Park / Dog Park • Tephford Park • Sunset Point Park • Fire Station 36 • Water's Edge Park • Grants Plaza Water Storage Facility • West Stormwater Pump Station • Central Stormwater Pump Station Phase 1 was completed in October 2020. The Fiber Network Expansion (Phase 2) project was approved by City of Tamarac Resolution R-2021-059, on file with the City Clerk's Office, on May 26, 2021, with a contract amount of $1,146,070.00 for the Primary Scope of Work, Option A, Option B and Option C (detailed below) — including a one (1) year written guarantee for all labor and materials provided by Unitec, Inc., and a twenty-five (25) year manufacturer's solution system warranty on the installed products / solution —, and also provided for a 10% contingency of $114,607.00, for permits and other unforeseen needs, for a total project budget of $1,260,677.00. Fiber Network Expansion (Phase 2) will provide fiber network connectivity to, and within, Mainlands Park and Caporella Park; provide underground, fiber network connectivity from the Recreation Center to City Hall (Municipal Services Complex) (included as Option A), the Water Treatment Plant (included as Option B), and the East Stormwater Pump Station (included as Option C). On November 15, 2021, the City approved Change Order 1, attached hereto as Exhibit 1, in the amount of $8,250.00, for additional fiber cabling and fusion splicing necessary to provide a direct fiber network connection from City Hall and the Water Treatment Plant to the Network Operations Center (NOC) as well as to provide for a direct fiber network connection for a secondary Dedicated Internet Access (DIA) Circuit at the Recreation Center to the Network Operations Center (NOC), paid out of contingency, thereby increasing the contract amount from $1,146,070.00 to $1,154,320.00, leaving a remaining contingency of $106,357.00. Change Order 1 also increased Unitec's contract time by forty-five (45) days in consideration of lost time due to material shortages caused by the pandemic (COVID-19). Fiber Network Expansion (Phase 2) Change Order 3 2 1 P a g e On February 7, 2022, the City approved Change Order 2, attached hereto as Exhibit 2, in the amount of $6,150.00, providing and installing an additional conduit from the City's existing fiber vault (hand hole) installed as part of the new Tamarac Sports Complex Concession Stand 2, connecting to the AT&T terminal located nearby at an adjacent building, necessary to provide telephone service to the new Tamarac Sports Complex Concession Stand 2; and additionally for the installation of the fiber network cable installed as part of the Fiber Network Expansion (Phase 1) project within the new Tamarac Sports Complex Concession Stand 2, which included pulling the fiber into the new building and completion of fiber terminations, paid out of contingency, thereby increasing the contract amount from $1,154,320.00 to $1,160,470.00, leaving a remaining contingency of $100,207.00. Change Order 2 also increased Unitec's contract time by ninety (90) days in consideration of lost time due to permitting delays caused by Broward County and delays caused by AT&T's inability to trace buried dielectric fiber lines along Commercial Boulevard and McNab Road. At present, the Fiber Network Expansion (Phase 2) project is nearing end with expected completion in June/July 2022. As part of the City's Security Master Plan (SMP), security enhancements including video surveillance cameras are planned for the City's Dog Park as well as for Tamarac Commons Park in future phases of the SMP. In consideration of these future plans for security enhancements as well as to provide WiFi in parks, and recognizing the continued rising costs for said work, it is considered prudent and more cost effective to engage Unitec, Inc. for completion of the required fiber network connections to the aforementioned locations now rather than delaying to later phases of the SMP. In addition, a Renovation Project at the City's Dog Park is currently underway, making for the ideal time to install additional fiber cabling while the park is already under construction. High voltage lines run overtop the Dog Park, and past experience has seen challenges gaining approval from FPL to make additions/changes to the park; therefore, it is ideal to install the additional fiber connections now while construction work is already approved and underway. The following proposed fiber network expansion scope modifications, including an extension of time not to exceed one hundred (100) calendar days for added work and material procurement, are included in the proposed Change Order 3, attached hereto as Exhibit 3: As part of the Gary B. Jones Dog Park Renovation Project, four (4) new Security / WiFi Pole locations and one (1) future location for an Emergency Phone have been identified and will be furnished and installed as part of that separate Renovation Project. In consideration, however, of the necessary power and fiber connection requirements for each of these three (3) locations, Change Order 3 will include installation of a Powered Fiber Cable (PFC), one (1) two inch (2") conduit and innerduct connecting each location to the existing Restroom facility near the Dog Park (inside Veterans Park), by the City's fiber contractor (Unitec, Inc.), as part of the Fiber Network Expansion (Phase 2) Project. The work will also include the installation of three (3) hand holes to service each corresponding location. As part of the Fiber Network Expansion (Phase 2) project, a fiber backbone cable has been installed connecting the Recreation Center to City Hall. The fiber backbone cable runs from the Recreation Center, south on University Drive, west along McNab Road and then north on Pine Island Road to City Hall. As a result of the conflict created through the FDOT's project, it was determined to have the previously installed handholes (2ea) relocated outside of the impacted areas. 2. During the progression of the project, it was determined that the installation of a new 12-strand single -mode fiber cable originating from the City's Fire Station 41 (2nd floor IT Data Closet), connecting to the Broward Sheriff's Office (BSO) Tamarac District HQ Exit Gate and by extension to the Fuel Island would best serve to provide for a direct, future fiber network connection to the existing Exit Gate and to the Fuel Island. During the progression of the project, Change order No. 2 was issued to the Unitec, Inc., to pull into, and terminate, an existing 48-strand single -mode fiber cable inside the new Tamarac Sports Complex, Concession Stand 2, IT Data Closet that was originally left inside a nearby handhole as part of the Fiber Network Expansion Phase I Project. In consideration of the completed work, it was determined that newly terminated fiber connection is required to be certified to attain a Commscope Twenty -Five (25) Year Warranty for the work. The proposed work shall include all field verification and testing (OTDR, OLTS, etc.) of terminated fibers for the project. The total cost for the proposed fiber network expansion scope modifications included in Change Order No. 4 is $22,480.00, which will increase the contract from a total of $1,213,565.00 (which includes Change Orders 1, 2 and 3) to a total of $1,236,045.00, leaving a remaining contingency of $24,632.00. Subsequently, during a progress meeting for County's project held on June 22, 2022, Horsepower Electric, Inc. was reminded by the County of City project as construction activities were being performed by the City along the north side of McNab Road from Pine Island Road to University Drive. During this progress meeting, Horsepower Electric, Inc. stated that they would coordinate work with the City of Tamarac. A copy of the meeting minutes are attached for reference. According to Contract Documents for County's project "once the Contractor commences construction, it shall be presumed by the County that any damages or deficiencies identified in the work area during later County inspections, or identified by other utilities or agencies in the course of their normal maintenance activities, are attributable to the Contractor, and the Contractor shall be held responsible for the repair(s)". Good afternoon Dibb, We are in receipt of your latest communications regarding the damage to the City of Tamarac Fiber Optic line on McNab Road. As you note, the City discovered certain damage to its fiber optic line and has alleged that Horsepower should be responsible and thus make the necessary repairs to the alleged damage. In order to respond to the City's claims, Horsepower needed to investigate and make a determination as to the true cause of any alleged damaged. Based on Horsepower's investigation, it is clear that any damage sustained the City's Fiber Optic line is not Horsepower's responsibility. Horsepower's assertions are based on the fact that on 7/14/22 Horsepower's subcontractor notified the City, through the appropriate legal channel and in accordance with Florida Statue Charter 556, that directional boring will take place on the North side of McNab b/w NW 80 Ave and University Dr. For your reference, please see attached Sunshine 811 Locate ticket #192206946. In accordance with the applicable law, the City was required to provide field marking for any all utilities that may be affected by the subject work. The City of Tamarac received, responded and cleared the aforementioned excavation locate ticket. Accordingly, upon receipt of clearance by the City of Tamarac the subject work (directional boring) took place. Unfortunately, the City failed to provide the required field markings associated with the subject Fiber Optic line and the alleged damage was sustained within the excavation limits described in the locate ticket. As you are well aware, the subject work took place after clearance of and within the dates set forth on the locate ticket. Therefore, any damage caused to the fiber optic line is the result of the City's failure to properly mark the subject utility line (Fiber Optic) as Horsepower and its subcontractor's followed the required laws and procedure before excavating. Based on the foregoing, Horsepower is not responsible for the subject damages. Finally, we strongly encourage you to retract the City's final statement that any open permits (by Horsepower Electric) with the City will be placed on hold and that future permits will be denied. As noted above, Horsepower followed all required procedures, submitted the proper locate ticket and awaited clearance of same from the City before commencing any work. Accordingly, the damage sustained is not Horsepower's responsibility and the City's decision to place open permits on hold and deny any future permits is inappropriate and unfounded. Moreover, such a decision by the city will have an extreme negative affect the City's residents (including its elected officials) as Horsepower dedicates its work to constructing, repairing and maintaining vital infrastructure that serves municipalities and residents, including, but not limited to, the City of Tamarac.
