CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2023 - 030
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA,
AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO SUBMIT A GRANT APPLICATION
FOR THE RECREATIONAL TRAILS PROGRAM
(RTP) TO THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION FOR THE
SPORTS COMPLEX MULTI -PURPOSE
PATHWAY REPLACEMENT PROJECT IN THE
AMOUNT OF $320,000.00; PROVIDING FOR A
MATCH IN LOCAL FUNDS OF $80,000.00 IN THE
EVENT OF APPROVAL OF THE GRANT
APPLICATION; PROVIDING FOR ACCEPTANCE
OF THE AWARD AND EXECUTION OF
NECESSARY DOCUMENTS PENDING LEGAL
REVIEW, PROVIDING FOR CONFLICTS,
PROVIDING FOR SEVERABILITY; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes provide that municipalities shall have the
governmental, corporate, and proprietary powers to enable them to conduct
municipal government, perform municipal functions and render municipal service,
and exercise any power for municipal purposes, except when expressly prohibited
by law ; and
WHEREAS, Article IV, Section 4.07 of the City Charter of the City of
Tamarac ("City) empowers the City to adopt, amend or repeal such ordinances
and resolutions as may be required for the proper governing of the City ; and

WHEREAS, the City desires to enrich the quality of life by improving parks
and amenities throughout the City ; and
WHEREAS, The Recreational Trails Program (RTP) is a Federal Grant
program funded by the Federal Highway Administration and administered at the
State level by the Florida Department of Environmental Protection to fund the
renovation, development or maintenance of non -motorized trails ; and
WHERAS, the grant application to (RTP) will be in the amount of $320,000
for the renovation of the Tamarac Sports Complex Pathway; and
WHEREAS the City of Tamarac is required a twenty percent match of local
funding in the amount of $80,000; and
WHEREAS, the Director of Parks and Recreation, Public Services and
Financial Services recommend submission of the Recreational Trails Program
Grant application and acceptance of the award in the event of approval ;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution. All exhibits attached hereto are incorporated herein and made a
specific part of this Resolution.
SECTION 2: The City Commission of the City of Tamarac HEREBY
provides approval of an application to be submitted to the Florida Department

Environmental Protection for the Recreational Trails Program grant in the amount
of $320,000 with a local match of $80,000 and in the event of approval authorizes
the acceptance of the award and further authorizes the appropriate City officials to
execute the grant agreement.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon
adoption.
