R- 2023 ©3'?-- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA ADOPTING A RESOLUTION OF SUPPORT FOR THREE MUNICIPAL CAPITAL PROJECTS FOR THE BROWARD COUNTY MOBILITY ADVANCEMENT PROGRAM (30-YEAR ONE PERCENT SURTAX FOR TRANSPORTATION) FUNDING; ACKNOWLEDGING THAT THE PROJECTS ARE LOCATED WITHIN THE CITY OF TAMARAC; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO TAKE ANY AND ALL ACTIONS NECESSARY TO APPLY AND RECEIVE THE FUNDING FOR NEW MUNICIPAL CAPITAL PROJECTS IN AN AMOUNT NOT TO EXCEED $3,353,459; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac wishes to enhance public transportation and multi -modal connectivity throughout the City; and WHEREAS, Broward County voters approved a 30-year, one percent surtax for transportation in November 2018; and WHEREAS, the sales surtax took effect on January 1, 2019 and the first distribution of surtax revenues was received by Broward County from the Florida Department of Revenue in March 2019; and WHEREAS, over 400 County roadway and transit improvements and over 700 municipal -requested projects were candidates to be funded in the Transportation Surtax Plan for these surtax dollars; and WHEREAS, MPO ranked, prioritized and provided recommendation to fund 110 municipal capital projects for Cycle 1 funding; and Temp. Reso. 13912 March 22, 2023 Page 2 of 5 WHEREAS, following the Independent Transportation Surtax Oversight Board review, 97 municipal capital projects (MCPs) and 61 municipal rehabilitation and maintenance (R&M) projects were deemed statutorily eligible for funding with the surtax dollars (13 MCPs were withdrawn by municipalities, deferred at the request of municipalities, or deemed ineligible); and WHEREAS, the City of Tamarac was awarded Cycle 1 transportation surtax funding for four (4) Cycle 1 MCPs and one (1) R&M project for a total award amount of $4,047,058; WHEREAS, on February 24, 2021, to pursue funding for the awarded Cycle 1 projects and to be eligible to submit new transportation projects, the City Commission of the City of Tamarac approved the Second Amendment to and Restatement of the Transportation System Surtax Interlocal Agreement (ILA) that is available on file at the City Clerk's Office; and WHEREAS, the ILA outlines the municipal project eligibility criteria and provides for an annual New MCP application, evaluation, and ranking processes, among other terms and conditions; and WHEREAS, per ILA, municipalities seeking transportation funding for New MCPs shall submit applications to the MPO consistent with MPO's prescribed application process. This year, only three projects are allowed to be submitted per municipality; and WHEREAS, on March 10, 2023, the City of Tamarac submitted three (3) MCPs to be considered for the Broward County Mobility Advancement Program funding: • NW 94th AVE Traffic Calming (raised school crosswalks) and Roadway Improvement Project Temp. Reso. 13912. March 22, 2023 Page 3 of 5 • Sands Point Shuttle Stop No. 04 • Woodlands Boulevard Complete Streets and Traffic Calming Project WHEREAS, a resolution from the City Commission of the City of Tamarac stating support for New MCPs is required to establish funding eligibility with Surtax funding; and WHEREAS, the Assistant to the City Manager and Directors of Community Development and Public Services recommend supporting the above -referenced MCPs and acknowledging that these projects are located within the City of Tamarac; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens of Tamarac to endorse the following MCPs and acknowledge that they are located within the City of Tamarac: • NW 94th AVE Traffic Calming (raised school crosswalks) and Roadway Improvement Project • Sands Point Shuttle Stop No. 04 • Woodlands Boulevard Complete Streets and Traffic Calming Project NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are HEREBY made a specific part of this Resolution. All exhibits attached HERETO and referenced HEREIN are expressly incorporated and made a specific part of this Resolution. Section 2: The City Commission of the City of Tamarac HEREBY provides this Resolution of Support for the three (3) above -referenced MCPs for the Broward County Temp. Reso. 13912 March 22, 2023 Page 4 of 5 Mobility Advancement program (30-year one percent surtax for transportation) funding and acknowledges that these projects are located within the City of Tamarac. Section 3: The appropriate City Officials are HEREBY authorized to take any and all actions necessary to apply and receive the funding for the above -referenced New MCPs in an amount not to exceed $3,353,459. Section 4: All Resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. Section 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Resolution. Section 6: This Resolution shall become effective immediately upon its adoption.
