R-2023 — inLt A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING TASK AUTHORIZATION NUMBER 23-09D WITH STANTEC CONSULTING SERVICES, INC., ATTACHED HERETO AS EXHIBIT 1"; IN THE AMOUNT OF $8,615, AND AUTHORIZING A CUMULATIVE EXPENDITURE FOR SAID PURPOSE IN AN AMOUNT NOT TO EXCEED $87,740.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac's Continuing Engineering Services Agreement, allows the City to choose from a prequalified list of consultants, as authorized by Resolution No. R-2022-138, a copy of which is incorporated herein by reference and is on file in the office of the City Clerk; and WHEREAS, upon consideration, Public Services Staff, together with the Information Technology Department, have selected Stantec Consulting Services, Inc. "Stantec" for various unrelated Purchase Orders "PO" and Task Authorizations ("TA") as it is the firm which possesses the required expertise, experience, knowledge, and resources for the projects outlined below; and WHEREAS, per City Ordinance and Procurement Policy, Purchase Order No. 260292, Purchase Order No. 260353 and Purchase Order No. 260526 exceeded $65,000.00, and therefore required City Commission approval through Resolution No. R- 2023-008, which is incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, there is a proposal to extend the Buffer Wall along Rock Island Temp. Reso. #13918 April 26, 2023 Page 2 of 4 Boulevard for approximately 200 feet to the north to provide buffer screening for the newly constructed residential development, Tamarac Circle, and the City has requested Stantec to provide a price proposal for the additional scope of services, as detailed in Task Authorization No. 23-09D; and WHEREAS, Task Authorization No. 23-09D includes the preparation of a topographic survey and engineering design of the extension of the Phase 2C Buffer Walls, at an additional cost of $7,115.00 with an additional $1,500.00 for possible additional services required, a copy of Task Authorization No. 23-09D is hereto attached as "Exhibit 1 "; and WHEREAS, the proposed Stantec Task Authorization No. 23-09D for a cost of $7,115.00, and additional $1,500.00 for additional services, together with the Resolution R-2023-008 will result in a cumulative total of $87,740.00 being spent in Fiscal Year 2023, thereby requiring City Commission approval for expenditures in excess of the previously approved $79,125.00 authorized by R-2023-008; and WHEREAS, it is the recommendation of the Director of Public Services, the Director of Financial Services and the Purchasing and Contracts Manager to authorize the increase to Stantec above the previously approved $79,125.00 by an additional $8,615, for a total expenditure not to exceed of $87,740.00; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interest of the citizens and residents of the City of Tamarac to accept the recommendation, authorize execution of Task Authorization TA 23-09D and authorize a cumulative expenditure not to exceed $87,740.00 for said purposes. Reso. #13918 April 26, 2023 Page 3 of 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AS FOLLOWS: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission HEREBY approves an additional expenditure for Professional Engineering Design and Consulting Services with Stantec Consulting Services, Inc., in the amount of $8,615, for a cumulative amount not to exceed $87,740.00, inclusive of the previous expenditures approved via Resolution No. R-2023- SECTION 3: The City Manager or his designee is hereby authorized to approve and initiate Change Orders in amounts which will not cause the cumulative amount of $87,740.00 to be exceeded; and is further authorized to close the contract award, which includes, but is not limited to, making final payment and releasing bonds per Section 6-149 of the City Code, when the work has been successfully completed within the terms, conditions and pricing of the agreement. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Temp. Reso. #13918 April 26, 2023 Page 4 of 4 Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Page 2 of 6 Reference: Woodland Estates Buffer Wall Exhibit "A" Woodland Estates Buffer Walls - Phase 2C Task Authorization No. 23-09D GENERAL DESCRIPTION OF PROJECT Buffer Walls had previously been planned along the Woodland Estates Subdivision as part of the initial development of Phase 2 in 2015. Plans were developed at that time to the 60% level in conjunction with the other buffer walls along the south side of Commercial Blvd. Challenges with the scope, location, and configuration of the Phase 2C segments required that it be temporarily postponed. The project design resumed in 2021, and 75% level construction drawings were developed by Stantec. It is Stantec's understanding that the City plans to extend the proposed Phase 2C Buffer Walls alignment, defined in Task Authorization No. 21-04D, along Rock Island Road for approximately two hundred feet to the north to provide buffer screening for the newly constructed residential development titled Tamarac Circle. The City requested from Stantec to provide a price proposal for the additional scope of services presented in topographic survey and engineering design of the extension of the Phase 2C Buffer Walls. SCOPE OF SERVICES The following tasks comprise the services that the Stantec shall employ to accomplish the purpose for this task order authorization. Task 1 - Data Collection Survey data will be updated through the use of a subconsultant to provide topographic data for the added section along Tamarac Circle on Rock Island Road. Please note that we will need assistance from the City to help work with the residents to gain access to those properties for surveying. The survey should include the following features: Establish horizontal control tied to state plane coordinates NAD83. Establish vertical control referenced to NAVD 88. The survey should include location and elevation of all above ground features including edge of pavements, sidewalks, driveways, utility poles, trees, mailboxes etc., location and elevation of underground facilities as evidenced by surface Design with community in mind TR 13918 EXHIBIT 1 n Ail March 24, 2023 Mr. John E. Page 3 of 6 Reference: Woodland Estates Buffer Wall features (valve boxes, drainage structures, manholes, handholes etc.); location and identification of trees within the survey limits with a caliper size above 3". Task 2 — Project Design and Construction Documents Stantec will modify the design documents for Buffer Walls Phase 2C to include the additional wall section in the following stage of design for the project, as detailed in Task Authorization No. 21-04D. Stantec is expected to submit documents for review to the City at the following stages: • 90% plans, specifications and OPC • Final plans, specifications and OPC Stantec will meet once with City staff after each submittal to review and discuss City comments. The purpose of the meeting will be to review the comments, discuss revisions and design decisions associated with the project, concluding the meeting with an approved set of percent complete deliverables for the project. Stantec will address comments and revise the work as applicable to the following phase of development for the work. Any significant redesign will be provided as an additional service. The drawings will be developed in a 24" x 36" format and also printed in 11 " x 17" format. Final drawings and documents shall also be submitted in electronic format (PDF files). Government Agency Approval Assistance, Bidding Assistance, and Construction Phase Services for the added wall section will be covered under the corresponding tasks described in Task Authorization No. 21-04D. ADDITIONAL SERVICES Any services not specifically provided for in the above scope will be considered additional services and can be performed at our then current hourly rates. Additional services we can provide include, but are not limited to, the following: 1. Underground utility location services to verify locations and depths of underground utilities. 2. Attendance at public hearings beyond that outlined above. 3. Services required by additional governmental regulations, which might be put into effect after the date of this agreement. 4. Page 4 of 6 Reference: Woodland Estates Buffer Wall 5. Structural design beyond those identified. 6. Environmental services beyond those identified. 7. Landscape and Irrigation Design 8. Responses to agency comments beyond those outlined in this scope. 9. Threatened or Endangered species coordination or specific protected species surveys. 10. Any services not specifically identified and described in the above Scope of Services. 11. Irrigation services for wells, meters or timer clocks if irrigation systems are not existing or adequate. TO BE PROVIDED BY CLIENT The following items are to be provided to Stantec by the Client or the Client's Consultants: 1) Available As -built (record) drawings and GIS Schematics of all existing utilities within the project limits. 2) All required geotechnical reports and recommendations. 3) Permit work other than that mentioned in the Scope of Services is not included. 4) Additional work to relocate utilities or miscellaneous structures is not included in this proposal. 5) This proposal assumes that a field survey will be provided to us in AutoCad format to utilize as a base sheet for the construction documents for the Prospect Road Segment of the project 6) Coordination with residents and approvals for property rights (ie easements) will be handled by the City. 7) Authorization to represent the Client on permit applications. 8) Access to the site. 9) Proof of Ownership documentation needed for permitting. 10) Permit application fees and plan review fees. 1 1) Any other existing information related to the project that may influence the scope of services noted above including but not limited to, budget, aesthetics and associated modifications or revisions. Page 5 of 6 Reference: Woodland Estates Buffer Wall SCHEDULE Stantec will provide its services in an expeditious and orderly manner to meet the formal written schedule mutually agreed to by the Client and Stantec for the various elements of the project. An anticipated schedule of deliverables is included herein. FEE AND BILLING Stantec will accomplish the services outlined in Tasks 1 and 2 for the Total Additional Service Lump Sum Budget of $7,115 Invoicing and payment will be in accordance with the terms and conditions of the consulting agreement between the City of Tamarac and Stantec dated October 26, 2016 and shall govern this agreement as applicable. The following task items represent a breakdown of the lump sum amounts for Stantec for reference: Data Collections $2,119.00 Proiect Design $4,996.00 Additional Labor Fee $7,115.00 When possible, all permitting, application, and similar project fees will be paid directly by the Client. Fees and expenses will be invoiced monthly based, as applicable, upon the percentage of services completed and expenses incurred as of the invoice date. Payment will be due within 30 days of the date on the Stantec invoice. Fees and times stated in the agreement are valid for sixty (60) days after the date of this letter.
