Gomez called the Monday, March 20, 2023, City Commission Workshop, being held in Conference Room 105, to order at 10:00 a.m. ROLL CALL Present were Mayor Michelle J. Gomez, Vice Mayor Marlon D. Bolton, Commissioner Kicia Daniel, Commissioner Morey Wright Jr., and Commissioner Elvin Villalobos. Also present were City Manager Levent Sucuoglu, Assistant City Manager Maxine Calloway, City Attorney Hans Ottinot, and City Clerk Kimberly Dillon. PLEDGE OF ALLEGIANCE Commissioner Villalobos led the Pledge of Allegiance. DISCUSSION ITEMS 1. Woodlands Development Agreement Maxine Calloway, Assistant City Manager/Community Development Director, explained the development agreement would appear for first reading on the March 22 Commission agenda. Attorney Scott Backman, of Dunay, Miskel, and Backman, provided a presentation regarding the development agreement. The presentation is on file in the City Clerk's Office. Mayor Gomez thanked the developer for the proffers. She provided the following feedback on the development agreement presentation, and Attorney Backman responded as appropriate: • References to the sections of Woodlands should be updated to include the legal names of each of the sections, as well as to homeowners' associations. • Paddleball courts are preferred over pickleball courts as they are quieter for a community. • Language related to the amenity campus needs to be reviewed for consistency. • Remove the word "possible" before cafe in reference to the amenity campus. • Asked that it be spelled out that sidewalks would not be installed on Woodlands Boulevard. • Clarify guest parking is additional to minimum parking standards. • Clarify who will maintain signage, as well as who is authorized to collect insurance and make decisions regarding replacement. • Add language regarding maintenance of individual properties by the homeowners. Mayor Gomez noted a conversation she had with the applicant's counsel regarding milling and resurfacing of roads. Attorney Backman explained that part of the project was building roads and stated at all of the intersections with existing roadways, milling and resurfacing will be done within 100 feet of that intersection throughout the entire development. • Clarify credit of impact fees. • References to boding and insurance should be clear that if there were ever a problem, the City would be made whole. • No financial ramifications on the rest of the Woodlands community in obtaining fobs as needed for the gates. Attorney Backman stated the property manager would be responsible for any fobs or other mechanisms as needed. He explained the concept of the gates was a "soft -gate" concept, with the main gate opening automatically upon approach and other gates being intended for resident access. He noted license plate reading would be utilized. • Existing City streets will remain City streets. • Aerators are all interconnected and flow together. • Overlays should be updated to specify height of hedges and maintenance of the same so that Code Enforcement has tools as appropriate for managing buffers, and references to the golf course are removed. • Concerns related to buffer wall items, including what happens if the homeowners don't agree. • Request additional dollars in fund to help homeowners to deal with any dirt and debris related to construction. • Adjust language related to NW 64th Avenue in section 16.d. to remove "in the event" there was access. • Remove "to the extent possible" in section 17. • Reword section 18 in relation to construction management to clarify that construction be limited to 8 a.m. to 6 p.m. Monday through Friday, 8 a.m. to 4 p.m. on Saturday, and no construction on Sunday, with no loud equipment before 9 a.m. • Provide two (2) weeks' notice or rerouting and detouring whenever possible and minimize delays. • Clarify City access to and compatibility of utilities. • Correct typographical error in section 24. Minutes March 20, 2023 —Workshop Page 2 City Attorney Ottinot asked Mayor Gomez to share her notes with Assistant City Manager Ottinot to ensure accuracy of amendments. Commissioner Daniel referenced the three (3) models shown and noted the presentation had said there would be others. She asked how many there would be and the square footage planned. Attorney Backman referenced Exhibit C to the development agreement, which showed 10 different elevations and renderings. He explained it would be in that range, depending on lot sizes. He stated the minimum under -air size would be 2,000 square feet with sizes up to 3,500 square feet or more. Commissioner Daniel expressed concern that the neighborhood not be "cookie cutter" and inquired about guarantees. City Attorney Ottinot clarified that the development agreement is a binding contract between the City and the developer, and any future modifications would need to be approved by the Commission. Commissioner Daniel asked what portion of the open space would be water. Assistant City Manager Calloway clarified the acreage included in the development agreement. Attorney Backman stated the applicant would do the calculation on the portion which is water and provide that information at the Wednesday meeting. Continuing, Commissioner Daniel confirmed that if new waterways were impacting a homeowner, concessions would be made. Attorney Backman stated the developer was not taking land from homeowners and could not without addressing that. Commissioner Daniel asked for clarification on the recreational trail. Attorney Backman explained the amenity would start at the clubhouse and work its way around the entire community to avoid people needing to use the streets. Discussion continued regarding trails and sidewalks. Commissioner Daniel asked whether the turn lane on Rock Island was guaranteed, and whether the County could deny the request. Attorney Backman reiterated the obligations placed on the developer through the agreement and provided a brief history. He stated Broward County had confirmed all of the improvements could be made. Continuing, Commissioner Daniel referenced the Code Enforcement Officer to be paid for by the developer and asked whether the cost would be placed on the residents at any point. Attorney Backman stated it would be a cost shared by residents of the new community. Discussion continued regarding the parties of the agreement. Commissioner Wright inquired regarding the density of the project. Attorney Backman clarified the density calculations. Commissioner Wright asked how high the ceilings would be in the homes. Attorney Backman stated there would be a minimum of nine (9) feet. In response to a follow-up Minutes March 20, 2023 —Workshop Page 3 question, he stated the development agreement restricts construction to two (2) stories, and those would only be in part D. Commissioner Wright asked about traffic flow within the development. Attorney Backman responded that the traffic engineer and other experts would be available at the March 22 meeting. He reviewed traffic patterns briefly and stated additional land had been acquired to ensure access in the area of the new density away from the main entry. Commissioner Wright asked the average cost of the homes. Attorney Backman stated the costs would start at approximately $700,000. Commissioner Wright asked whether the developer was open to giving more of a contribution toward affordable housing than the $2,000 per unit required. Attorney Backman provided a brief history on the increase in that number through the process and stated there were a large number of community impact dollars being paid. Discussion ensued regarding the proffers being made by the developer. Commissioner Wright asserted Women in Distress should be receiving a larger contribution than the Tamarac Chamber of Commerce. City Attorney Ottinot stated any suggestions or concerns regarding the proffers should be shared with staff to discuss directly with the developer. Mayor Gomez added that the proffers were not requirements or obligations but are voluntary. Commissioner Daniel asked about resident concerns related to arsenic in the development, and the proper measures to ensure health and safety. Attorney Backman stated an environmental expert would be providing a full response to the concern during the March 22 meeting. He noted there is a clear process in place through Broward County and the State of Florida. He stated it was not included in the development agreement as it was a legal requirement, but he would have no issue adding it. Commissioner Wright asked for clarification on the amount of open space in the presentation. Attorney Backman stated there was a difference between what was being deed restricted and what was included in the plan.
