R-2023 - Ot�q A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ENCOURAGING HOMEOWNER ASSOCIATIONS IN THE CITY OF TAMARAC TO REVISE THEIR RULES AND REGULATIONS TO PERMIT HOMEOWNERS TO A INSTALL PHYSICAL SAFTETY BARRIERS IN THE REAR YARD FOR PUBLIC SAFTEY REASONS, WHICH INCLUDE CRIME PREVENTION AND ACCIDENTAL DROWNING OF YOUNG CHILDREN; DIRECTING THE CITY MANAGER OR DESIGNEE TO INITIATE A PUBLIC AWARENESS CAMPAIGN TO PROMOTE SAFETY NEAR WATERBODIES; PROVIDING THE MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a recent drowning of a young child in a water body without safety barrier in the City of Tamarac has triggered the need to encourage Homeowner Associations to revise their rules and regulations to permit homeowners with the ability to install safety barriers in their rear yard near water bodies; and WHEREAS, it is well known that safety barriers are a useful drowning prevention tool, especially for infants and young children who may not fully understand the dangers of water; and WHEREAS, safety barriers like fences can prevent young children from accessing nearby ponds, pools or rivers; and Temp. Reso. # TR13935 April 26, 2023 Page 2 of 4 WHEREAS, safety barriers are useful for infants and children who, while curious about water, may not fully understand its dangers; and WHEREAS, safety barriers can be disincentives for committing crimes at homes with safety barriers in the rear yard; and WHEREAS, burglars, based on empirical evidence, have generally used rear doors of homes to commit heinous crimes due to the lack of fencing in the rear yard; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the citizens and residents of the City of Tamarac to encourage Homeowner Associations to revise their rules and regulations to permit homeowners with the ability to install safety barriers in the rear yards near bodies of water and to direct the City Manager to initiate a public awareness campaign to promote safety near waterbodies. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac hereby encourages Homeowner Associations to revise their rules and regulations to permit homeowners with the ability to install safety barriers in their rear yard near Temp. Reso. # TR13935 April 26, 2023 Page 3 of 4 bodies of water for public safety reasons, including crime prevention and accidental drowning of young children. SECTION I The City Commission of the City of Tamarac hereby directs the City Manager or designee to initiate a public awareness campaign to promote safety near waterbodies. SECTION 4: The City Commission of the City of Tamarac hereby authorizes the City Manager with the authority to effectuate the intent of this Resolution. SECTION 5: This Resolution shall become effective immediately upon adoption. "The remainder of this page is left blank intentionally" Temp.
