CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2023 - 0(02
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, RATIFYING PAST
PURCHASES FROM AXELLIANT LLC IN THE AMOUNT
OF $57,201.01; AWARDING BID IQ20230171 TO
AXELLIANT LLC; AND APPROVING THE PURCHASE OF
A CISCO SYSTEMS SMARTNET MAINTENANCE AND
SUPPORT AGREEMENT FROM AXELLIANT LLC AT A
TOTAL COST OF $59,835.00; AUTHORIZING
EXPENDITURES FROM THE APPROPRIATE
ACCOUNTS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SCRIVENER ERRORS PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes provide that municipalities shall have the
governmental, corporate, and proprietary powers to enable them to conduct municipal
government, perform municipal functions, and render municipal service, and exercise any
power for municipal purposes, except when expressly prohibited by law; and
WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac
("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions
as may be required for the proper governing of the City; and
WHEREAS, technology is one of the key components in the efficient delivery of
City services, and the City's network infrastructure is critical to ensuring continued
operations; and
WHEREAS, the City has multiple Cisco Systems SMARTnet contracts, providing
maintenance and support, and replacement coverage, for critical Cisco Systems network

switches and equipment, which expire on June 13, 2023, and on August 5, 2023, thereby
requiring renewal in order to maintain said coverage; and
WHEREAS, on April 28, 2023, the City issued Bid IQ20230171 - Cisco SMARTnet
Renewal — , on file with the City Clerk's Office, requesting quotes from authorized Cisco
Systems partners and/or resellers, for a Cisco Systems SMARTnet renewal, to renew
referenced items for the greater of either five (5) years, or until the Last Date of Support
(when less than five (5) years coverage is available); and
WHEREAS, ten (10) responses / quotes were received, attached hereto as Exhibit
1, one (1) of which was disqualified and subsequently withdrawn due to inaccurate
pricing, as shown below:

WHEREAS, the quote from Axelliant LLC was deemed the lowest responsible and
responsive bid for the required Cisco Systems SMARTnet maintenance and support
renewal; and
WHEREAS, funding is available in the Information Technology operating account
for said purposes; and

WHEREAS, the aggregate annual expenditure thus far through Axelliant LLC has
been $57,201.01, but with the purchase of the Cisco Systems SMARTnet maintenance
and support agreement, at a cost of $59,835.00, will total $117,036.01, thereby requiring
City Commission approval for expenditures in excess of the State of Florida threshold for
Category Three as defined in the F.S. §287.017(3), currently set at $65,000 per City of
Tamarac Code §6-145; and
WHEREAS, it is the recommendation of the Director of Information Technology
and the Purchasing and Contracts Manager that the City Commission of the City of
Tamarac ratify past expenditures with Axelliant LLC in the amount of $57,201.01; award
Bid IQ20230171 to Axelliant LLC; and approve the purchase of the Cisco Systems
SMARTnet Maintenance and Support Agreement, at a total cost of $59,835.00, from
Axelliant LLC; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the business owners, residents, and visitors of the City of Tamarac to
ratify past expenditures with Axelliant LLC in the amount of $57,201.01; award Bid
IQ20230171 to Axelliant LLC; and approve the purchase of the Cisco Systems SMARTnet
Maintenance and Support Agreement, at a total cost of $59,835.00, from Axelliant LLC.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
Section 1. The foregoing recitals are true and correct and hereby adopted as
the legislative and administrative findings of the City Commission; all exhibits attached
hereto are incorporated herein and made a specific part of this Resolution.

Section 2. The City Commission ratifies past expenditures with Axelliant LLC in
the amount of $57,201.01-1 awards Bid IQ20230171 to Axelliant LLC; approves the
purchase of the Cisco Systems SMARTnet Maintenance and Support Agreement, at a
total cost of $59,835.00, from Axelliant LLC; and authorizes the appropriate City Officials
to execute a Purchase Order to Axelliant LLC for the Cisco Systems SMARTnet
Maintenance and Support Agreement, at a total cost of $59,835.00.
Section 3. Funding is available for the purchase of the Cisco Systems
SMARTnet Maintenance and Support Agreement from the appropriate accounts for a
total cost not to exceed $59,835.00.
Section 4. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 5. Any scrivener or typographical errors that do not affect intent of this
Resolution may be corrected with notice to and authorization of the City Attorney and City
Manager without further process.
Section 6. If any clause, section, other part, or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
Section 7. This Resolution shall become effective immediately upon adoption.
