No. 13961 June 28, 2023 Page 1 of 4 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2023- Cq A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE COMMUNITY DEVELOPMENT DEPARTMENT FEE SCHEDULE, ATTACHED HERETO AS EXHIBIT "A", ADOPTING FEES FOR LANDSCAPING AND TREE PRESERVATION, TREE REMOVAL LICENSE MODIFICATION, LANDSCAPE REVIEW, BONUS SLEEPING ROOMS, TEMPORARY SIGN PERMIT AND SALE PERMIT, AND MINOR HOME REPAIR APPICATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Land Development Code of the City of Tamarac Code of Ordinances authorizes the City Commission from time to time, to establish by resolution, the amount of application fees, and WHEREAS, Resolution No. R-2021-037, enacted by the City of Tamarac City Commission on March 24, 2021, established the current development review fees that are listed in the Community Development Department Fee Schedule; and WHEREAS, the City Commission of the City of Tamarac approved Temporary Ordinance No. TO-2530 amending Chapter 10, Article 4, of the Land Development Code of the City of Tamarac, Florida, entitled "Development and Design Standards", by specifically amending Section 10-4.4, entitled "Landscaping and Tree Preservation", to allow the City of Tamarac to adopt and enforce its own tree preservation regulations, by providing for comparably stringent requirements and standards to the Broward County Code of Ordinances, Chapter 27, Article XIV, entitled "Tree Preservation and Abuse Ordinance", by specifically complying with Section 27-407, entitled "Municipal Certification", on First Temp Reso. No. 13961 June 28, 2023 Page 2 of 4 Reading at its June 14, 2023 meeting, and on Second Reading at its June 28, 2023 meeting; and WHEREAS, the proposed amendment would allow for the adoption of fees for Landscaping and Tree Preservation, and Tree Removal License Modification applications; and WHEREAS, Staff has reviewed the amended Community Development Fee Schedule and has determined that the proposed fees for Tree Removal and Tree Removal License Modification applications are comparable with the Broward County Tree Removal License fees, as stipulated in the Broward County Tree Preservation and Abuse Fee Schedule, and are appropriate to adopt for the landscaping and tree preservation needs of the City, in addition to being reasonable and in alignment with current best practices; and WHEREAS, existing applications and processes that were not previously specified in the Community Development Fee Schedule including Landscape Review, Bonus Sleeping Rooms, Temporary Sign Permit and Sale Permit, and Minor Home Repair were identified; and WHEREAS, Staff has reviewed the amended Community Development Fee Schedule and has determined that the proposed fees for Landscape Review, Bonus Sleeping Rooms, Temporary Sign Permit and Sale Permit, and Minor Home Repair are reasonable and in alignment with current best practices; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the Community Development Department Fee Schedule to reflect the applications fees for Tree Removal and Tree Removal License Modification applications as outlined in Section 10- 4.4(F)(2)(b) of the City's Code of Ordinances, in addition to fees for Landscape Review, Temp Reso. No. 13961 June 28, 2023 Page 3 of 4 Bonus Sleeping Rooms, Temporary Sign Permit and Sale Permit, and Minor Home Repair which were not previously reflected in the Fee Schedule. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: That the Community Development Department Fee Schedule amendment attached hereto as Exhibit "A" and made a part hereof, is hereby approved, to become effective immediately upon adoption. SECTION 3: That all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption. Temp Reso.
