R-2023 - ')174 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PROPOSED MILLAGE RATE OF 7.1766 MILLS FOR GENERAL OPERATING PURPOSES; APPROVING SEPTEMBER 14, 2023 AT 5:05 P.M. AT THE TAMARAC COMMISSION CHAMBERS, 7525 N.W. 88TH AVENUE, TAMARAC, FLORIDA, AS THE DATE, TIME AND PLACE FOR THE FIRST PUBLIC HEARING TO SET THE TENTATIVE MILLAGE RATE AND BUDGET FOR FISCAL YEAR 2024; APPROVING SEPTEMBER 26, 2023 AT 5.05 P.M. AT THE TAMARAC COMMISSION CHAMBERS, 7525 N.W. 88TH AVENUE, TAMARAC, FLORIDA AS THE DATE, TIME, AND PLACE FOR THE SECOND PUBLIC HEARING TO ADOPT THE MILLAGE RATE AND BUDGET FOR FISCAL YEAR 2024; AUTHORIZING THE CITY MANAGER TO SEND THE PROPOSED MILLAGE RATE OF 7.1766 AND THE DATE, TIME AND PLACE FOR BOTH THE FIRST AND SECOND PUBLIC HEARINGS TO THE BROWARD COUNTY PROPERTY APPRAISER FOR FISCAL YEAR 2024; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and Temp. Reso. #13953 July 12, 2023 Page 2 of 4 WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, Section 200.065, Florida Statutes (TRIM — Truth in Millage) requires all municipalities, within 35 days of receipt of the city's certification of taxable value (on or around July 1), to advise the Property Appraiser of estimated millage rates to be included in the TRIM notice sent to each taxpayer; and WHEREAS, estimated and tentative millage rates should be proposed which would allow the City Commission latitude in meeting Fiscal Year 2024 budgetary requirements; and WHEREAS, Section 200.065, Florida Statutes requires that a hearing date, other than that scheduled by the Broward County Commission and the Broward County School Board, be set by each municipality to be included in the TRIM Notice sent to each taxpayer; and WHEREAS, the millage rate for general operating purposes is estimated to be 7.1766 mills for Fiscal Year 2024, and that the public hearings to adopt the tentative and final millage rates and budget for Fiscal Year 2024 be set at 5:05 p.m. on September 14, and 5:05 p.m. on September 26, 2023, respectively, in the City Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to direct the City Manager to send an estimated and tentative millage Temp. Reso. #13953 July 12, 2023 Page 3 of 4 rate of 7.1766 mills for general operating purposes to the Property Appraiser and to set a date, time, and place for the first and second public hearing. This proposed operating millage rate is greater than the rollback rate of 6.3441 by 13.12%. THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Section 1: The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2: The City Commission approves and adopts a proposed millage rate of 7.1766 mills for general operating purposes for Fiscal Year 2024. Section 3: The City Commission sets September 14, 2023, at 5:05 p.m. at the City of Tamarac Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321 as the date, time, and place for the first public hearing to set the tentative millage rate and tentative budget for Fiscal Year 2024. Section 4: The City Commission sets September 26, 2023, at 5:05 p.m. at the City of Tamarac Commission Chambers, 7525 N.W. 88th Avenue, Tamarac, Florida 33321 as the date, time, and place for the second public hearing to adopt the millage rate and budget for Fiscal Year 2024. Section 5: The City Manager is authorized to send notification to the Property Appraiser of the proposed millage rate of 7.1766 mills and the date, time, and place of the first and second public hearings to the Broward County Property Appraiser for Fiscal Year 2024. Temp. Reso. #13953 July 12, 2023 Page 4of4 Section 6: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 7: If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
