R-2023- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PROJECTS RECOMMENDED FOR INCLUSION IN THE FISCAL YEAR 2023/2024 ANNUAL ACTION PLAN FOR EXPENDITURE OF THE COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS ESTIMATED TO BE $497,807 FOR THE TWENTY FOURTH PROGRAM YEAR, ATTACHED HERETO AS EXHIBIT "A", - AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SUBMIT SAID ANNUAL ACTION PLAN AND RELATED DOCUMENTS TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT; AUTHORIZING THE MAYOR OR APPROPRIATE CITY OFFICIALS TO EXECUTE FISCAL YEAR 2023-2024 ANNUAL ACTION PLAN FEDERAL APPLICATION FOR FUNDING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, as a condition of funding, the City of Tamarac (City) is required to prepare a Five -Year Consolidated Plan which establishes the City's strategic priorities for the Community Development Block Grant (CDBG) program in accordance with the United States Department of Housing and Urban Development (HUD) requirements and contains a variety of information obtained from the US Census, County, City, and State statistics depicting City -specific housing and population statistics reported in several formats; and WHEREAS, the City Commission adopted the current Five -Year Consolidated Plan for Fiscal Years 2020/2021 to 2024/2025 on July 8, 2020, via resolution R-2020- 063; and Temp. Reso. No. 13959 June 7, 2023 Page 2 of 5 WHEREAS, each year a new Annual Action Plan is required to detail projects, activities, and programs to be funded by that year's allocation in compliance with the adopted 5-Year Consolidated Plan; and WHEREAS, HUD has notified the City of its Fiscal Year (FY 2022) funding allocation in the estimated amount of $497,807 under the Community Development Block Grant ("CDBG") Program for the City's Twenty Fourth Program Year, effective October 1, 2023-,and WHEREAS, funding received for the CDBG program must be utilized for eligible CDBG activities; and WHEREAS, all CDBG eligible activities must meet one of three national objectives, as defined by Congress, including benefitting low and moderate -income people, helping to eliminate slum and blight, or addressing existing conditions that pose a serious or immediate threat to the health and welfare of the community; and WHEREAS, the Annual Action Plan requires a public notice and a public hearing process to solicit community input in the development and review of the plan; and WHEREAS, the Annual Action Plan is posted on the City's website for review and comment from June 7, 2023 to July 12th, 2023 and public hearings held at the June 7, 2023 Planning Board meeting and the City Commission meeting on July 12, 2023 at 7:00 p.m.; and WHEREAS, the Director of Community Development reviewed the item and finds that the Annual Action Plan is consistent with the City's Five -Year Consolidated Plan and the Housing Element of the City's Comprehensive Plan and recommends approval and subsequent submittal to HUD; and Temp. No. 13959 June 7, 2023 Page 3 of 5 WHEREAS, activities funded by the CDBG program have the potential to result in generation, return or repayment of funds, known as CDBG Program Income (PI); and the City of Tamarac is allowed to utilize funds generated from Program Income for activities listed in the adopted Five -Year Consolidated Plan and in accordance with the Citizen Participation Plan; and WHEREAS, the City Commission deliberated on the item at their regularly scheduled July 12, 2023 duly noticed public hearing meeting; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to approve Fiscal Year 2023/2024 Annual Action Plan for expenditure of the U.S. Housing and Urban Development Community Development Block Grant funds estimated to be $497,807 for the Twenty Fourth Program Year and hereby approves the use of Program Income for activities listed in the adopted Five -Year Consolidated Plan and in accordance with the Citizen Participation Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 3: The Mayor or appropriate City officials is hereby authorized to execute the Fiscal Year 2023-2024 Annual Action Plan Federal Application for funding and any related documents including revisions required to receive additional funding not utilized by other entitlement Cities within Broward County that are not subject to an amendment to the Annual Action Plan. SECTION 4: All resolutions or parts of resolutions in conflict herewith be, and the same are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. Introduction The City of Tamarac strives to provide safe, decent, and affordable housing and a suitable living environment for its residents, especially for low -to moderate -income (LMI) households and special needs groups. The City was officially incorporated on July 19, 1963, and is strategically located in the center of Broward County, between Miami -Dade and Palm Beach Counties in South Florida. In 2000, the City became a U.S. Department of Housing and Urban Development (HUD) entitlement community, enabling it to be eligible for federal funds allocated through HUD's Community Planning Development program. The City's Grants Administration Department administers the federal HUD Community Development Block (CDBG) grant funds and ensures compliance of HUD regulations and guidelines. Partnerships with neighborhood nonprofit organizations and other local agencies allow the City to improve the quality of life for its citizens. This PY 2023 Annual Action Plan (AAP) is the fourth year of the Five -Year 2020-2024 Consolidated Plan, and outlines the activities the City will undertake in the program year which runs from October 1, 2023 to September 30, 2024. The AAP describes the strategies implemented by the City in providing Federal Community Development Block Grant (CDBG) funds to promote affordable housing initiatives and socio- economic programs to address identified community development needs. In PY 2023 the City anticipates it will receive $497,807 in CDBG funds to administer these activities. The projects identified in this plan will be primarily used to benefit LMI residents of the City. The Vision statement of the City of Tamarac is "The City of Tamarac, Our Community of Choice -Leading the nation in quality of life through safe neighborhoods, a vibrant community, exceptional customer service and recognized excellence" and its Mission statement is "We are: "Committed to Excellence... Always". It is our job to foster and create an environment that: Responds to the Customer, Creates and Innovates, Works as a Team, Achieves Results, Makes a Difference". The Strategic Goals of the City of Tamarac are: • Tamarac is Home • Tamarac is Safe and People Know It • Tamarac is Economically Resilient • Tamarac is Vibrant • Tamarac is Smart and Connected • Tamarac is a Dynamic Workplace Along with the Vison, Mission and Goals of the City of Tamarac, the AAP also incorporates priorities and programs addressing the basic goals of providing suitable living environment, providing decent housing Annual Action Plan 2023 OMB Control No: 2506-0117(exp. 09/30/2021) and expand economic opportunities while primarily benefitting very low-, low- and moderate -income persons. 2. Summarize the objectives and outcomes identified in the Plan The City of Tamarac has developed its strategic plan based on an analysis of the data presented in this plan and an extensive community participation and consultation process. Through these efforts, the City has identified two priority needs with associated goals to address those needs. The priority needs with associated goals include: Priority Need: Public Services & Quality of Life Improvements GOAL SA Provide Supportive Services LMI & Special Needs: Supportive services for LMI and special need households include senior programs, youth services, and housing counseling programs. Objective: Creating Suitable Living Environments Outcome: Availability/Accessibility Public Service Activities: 82 Persons Assisted Priority Need: Preserve & Develop Affordable Housing GOAL 2A. Preserve Existing Homeowner Housing: The City will assist LMI households with Owner - Occupied Housing Rehabilitation (including Rehabilitation Service Delivery). Objective: Provide Decent Affordable Housing Outcome: Affordability Homeowner Housing Rehabilitated: 6 Household Housing Units 3. Evaluation of past performance The City is responsible for ensuring compliance with all rules and regulations associated with the CDBG grant program. The City's Annual Action Plans and Consolidated Annual Performance and Evaluation Reports (CAPERs) provide details on projects and programs completed by the City. The City recognizes that the evaluation of past performance is critical to ensuring implemented activities are effective and that those activities align with the City's overall strategies and goals. The most recently completely CAPER is PY 2021, and below is a highlight of the accomplishments by priority. Annual Action Plan 4 2023 OMB Control No: 2506-0117(exp. 09/30/2021) Affordable Housing: The City of Tamarac proposed to provide assistance to seven (7) households with rehabilitation of owner -occupied housing in the program year. Although the City was still experiencing some of the lagging effects of COVID-19 and scarcity of certain construction materials, our program, to preserve affordable housing, was successful. Forty-eight (48) households received mortgage, rent, utility and HOA fee assistance through the emergency residential assistance program in this program year with CDBG-CV funding. Notwithstanding the state of the construction industry and material shortage, eight (8) families received rehabilitation assistance in the program year, exceeding our goal. Of the eight projects, four are in the later part of the construction phase due to scarcity and extended lead times for certain construction material. Public/Social Services: The City proposed to provide public service assistance to 150 LMI persons/households through its public service program. Three hundred seventy five (375) households received public/social service assistance during the program year which exceeded the goal. These services include youth intervention, feeding seniors, disaster preparedness education and hurricane supplies, and home maintenance counseling. 4. Summary of Citizen Participation Process and consultation process The City of Tamarac encourages citizen participation and actively encourages citizens, particularly low - and moderate -income households and those with special needs, to participate in the planning and development of the Consolidated Plan and the Annual Action Plan (AAP). The City of Tamarac works to ensure community stakeholders and citizens have adequate opportunities to participate in this planning process. The City's efforts to allow for participation in the development of the PY 2023 Annual Action Plan include Public Hearings and a Public Comment Review Period. Written comments may be returned to the Community Development Department -Housing Division at 7525 NW 88 Avenue, Tamarac, FL 33321. PUBLIC COMMENT PERIOD: A 30-day public comment period will be held from June 7, 2023 to July 12, 2023. The Plan can be downloaded and viewed from the City's website and is available in Spanish upon request. Summary PY 2023 is the fourth program year of the 2020-2024 Consolidated Plan and addresses the priority needs identified in the 5-Year plan through the activities developed in this plan. The development of this plan includes the help of local community stakeholder organizations and community members. The City will continue funding successful programs that work to serve low- to moderate -income households and the special needs community. HUD announced on February 28, 2023 that the City would receive a CDBG allocation of $497,807 for PY 2023. Introduction The City of Tamarac is the lead agency for completing the City's Consolidated Plan and Annual Action Plan under the CDBG program. The City also received other grant funds that help to further community development and affordable housing such as HOME funds through the Broward County HOME Consortium. All grant funds received are administered by the City Community Development Department, Housing Division. The City collaborates with several community stakeholders. Private and nonprofit providers, advocacy agencies, housing developers, social service providers and other key partners play an instrumental role in addressing the needs of the residents of Tamarac. Grant funding does not cover all needs; therefore, external partnerships ensure continuity of resources for all. City staff is regularly familiarized with the needs of the community via the various professional affiliations, committees, memberships and associations. On -going review and consultation is the primary method of providing the best services to residents of Tamarac. The following City departments and local entities were consulted in the development of this PY 2023 AAP Provide a concise summary of the jurisdiction's activities to enhance coordination between public and assisted housing providers and private and governmental health, mental health and service agencies (91.215(I)). The City of Tamarac works with various service providers in the City to meet the needs of its citizens. The City's service providers represent a wide range of individuals with expertise in engineering, planning, social services, economic development and parks and recreation. Agencies are invited to determine feasibility, duplication and consistency with local governmental plans, conformance with local zoning district, environmental impact and cost effectiveness. All projects must be proven feasible prior to receiving HUD funds, as many require documentation indicating financial feasibility and conformance with applicable regulations and constraints (i.e. zoning, land use, flood plan, etc.). Projects will not be funded if the proposed project duplicates an existing program which the public sector administers. Describe coordination with the Continuum of Care and efforts to address the needs of homeless persons (particularly chronically homeless individuals and families, families with children, veterans, and unaccompanied youth) and persons at risk of homelessness. The City is a member of the Broward County Homeless Partnership Initiative, which is the lead agency for the regional (Broward County) Continuum of Care. The City supports the Initiative and its efforts to end Annual Action Plan 2023 OMB Control No: 2506-0117(exp. 09/30/2021) homelessness. Through regular meetings and reports provided by Broward County, the City is kept up to date with Tamarac's homeless population. Broward's Continuum of Care addresses all aspects of homelessness including prevention, outreach, emergency shelter, transitional and permanent affordable housing, and supportive services. This work includes: • Facilitating community, business and governmental involvement in the homeless continuum of care • Direct oversight of the County's three regional Homeless Assistance Centers • Creating new and innovative programs to serve Broward's homeless population (such as the County's first homeless medical respite care facility) The Continuum of Care utilizes the Coordinated Entry System process, which helps to coordinate emergency housing and wraparound services for target homeless groups. These target groups include chronically homeless households; children and families; unaccompanied youth ages 18-24; veterans and their families; and at -risk and difficult to serve Individuals who are not chronic. The Coordinated Entry System helps to prevent these groups from becoming homeless or return to homelessness. Describe consultation with the Continuum(s) of Care that serves the jurisdiction's area in determining how to allocate ESG funds, develop performance standards for and evaluate outcomes of projects and activities assisted by ESG funds, and develop funding, policies and procedures for the operation and administration of HMIS The City of Tamarac is not a recipient of ESG funds and therefore does not participate in the development or use of ESG funds. The City will refer ESG, ESG performance standards, and project outcomes and activities to the Continuum of Care. The Homeless Management Information System (HMIS) is a web -based software application used to collect demographic information and service outcome information on people experiencing homelessness served in the Broward County Homeless Initiative Partnership CoC area. HMIS enables homeless service providers to collect uniform Client information over time. This system is part of an effort to streamline client services, inform public policy decision -makers, improve coordination of services among providers of housing and services to homeless clients, and assist the CoC in establishing policies that result in targeted services to reduce the time persons experience homelessness. Analysis of information gathered through HMIS is critical to accurately calculate the size, characteristics, and needs of homeless populations. The data collected is necessary to service and systems planning, and advocacy. The City is a member of the Broward County HOME Consortium which distributes federal HOME funds to member cities to develop affordable housing in the region. The City also works with the county through the Broward County Homeless Initiative Partnership, which is the lead in the Continuum of Care, helping homeless persons in the region. The age and condition of the housing stock results in a need to provide housing assistance to existing and incoming homeowners. The City of Tamarac continues to insist on high quality housing development, which is affordable to incoming residents, including quality maintenance of the City's existing housing stock. This objective can be achieved over the 5-Year strategic planning period through the housing rehab program. The City has identified vital and essential public services for LMI and the special needs population as a high priority. The senior population continues to rely on the City to provide social services to meet their needs or partner with agencies that can provide various services such as the food delivery service. Activities that serves the youth are needed and are preventive and intervention services as well as a variety of enrichment and education workshops. The CDBG program has grant allocation requirements, which influence project funding. Administration costs have a grant cap of 20% and there is also a 15% grant cap for public services. The major obstacle is funding, or lack thereof. Both federal and state allocations fluctuate from year to year making planning for the future and meeting the needs of the underserved difficult. This project will also fund housing rehabilitation delivery cost and will be carried out on a citywide basis. Annual Action Plan 22 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) AP-50 Geographic Distribution - 91.420, 91.220(f) Description of the geographic areas of the entitlement (including areas of low-income and minority concentration) where assistance will be directed CDBG programming funds are available throughout the City, however funds must be targeted towards low/mod tracts or eligible low- and moderate -income individuals and households, or special needs groups. The City has identified eligible project locations as low/mod census block group tracts. In addition to the HUD LMISD data, the City determines need and location of special projects based on need and demand of its residents, as well as the condition of existing resources. See map Low/Mod Block Group Tracts attached in SP-10 of the Con Plan for low -moderate income areas that will be utilized to plan for eligible activities and services throughout the City. Annual Action Plan 23 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) AP-75 Barriers to affordable housing-91.420, 91.2200) Introduction The City of Tamarac recognizes the importance of promoting affordable housing. The City is experiencing a growth in population size and recognizes the need to identity effective strategies to provide affordable housing. As such, the City participated with Broward County on the 2020 Analysis of Impediments, which was completed on June 1, 2020. The Al identified the following impediments to fair housing and affordable housing. Fair Housing Related Impediments Impediment 1: Displacement of Minorities Due to Gentrification Impediment 2: Income Inequality Between Race or Ethnicity Affordable Housing Related Impediments Impediment 3: Decline in Household Purchasing Power Impediment 4: High Percentage of Renters are Cost Burdened Impediment 5: Increased Rate of Poverty Impediment 6: Funding Shortage for New and Existing Affordable Housing The City will address affordable housing impediments through supporting the rehabilitation of existing affordable housing. Maintaining and preserving the housing stock in Tamarac is key to lowering poverty and maintaining affordable housing for City residents. The City also provides vital public services for LMI and special need groups such as the elderly. These programs help offset other basic living costs LMI residents have while also improving their quality of life. Finally, an education workshop will also be provided for LMI persons about affordable housing, homeownership, lender fair housing laws and lead - based paint hazards. Actions it planned to remove or ameliorate the negative effects of public policies that serve as barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment The City of Tamarac promotes affordable housing and removes barriers to affordable housing by the use of the following strategies: • Expediting the processing of approvals of development orders or permits for affordable housing Annual Action Plan 24 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) projects. • Use of a formal process by which the City considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing. • The City allows for flexible lot configurations, including zero -lot- line, for affordable housing • The City supports development near transportation hubs, major employment centers and mixed use development. Annual Action Plan 25 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) AP-85 Other Actions - 91.420, 91.220(k) Introduction Throughout the year, City staff participate in several community events, outreach efforts, educational workshops, public service announcements, and invitational guest speaking opportunities at various communities, boards, organizations, non -profits, and for -profits to assess the needs of the community and share information with the residents of Tamarac as to the availability of funds. Several members of City staff are members of various boards, committees and sub -committees at which county -wide coordination is reached on issues pertaining to planning, transportation, housing, community development and neighborhood revitalization. This coordination and the activities as outlined in this section are other actions the City takes to address needs in Tamarac. Actions planned to address obstacles to meeting underserved needs In PY 2023, the City will fund programs that work directly to improve the lives of low- to moderate -income households. Activities will include youth prevention and enrichment services that help improve the quality of life for these individuals and senior meal services. The City will also fund housing preservation activities through the housing rehabilitation program. The City's Social Services Division is available at all times to address the needs of the residents. Direct and/or indirect service delivery is coordinated through the City's Social Service staff. Staff has access to both internal and external programs and agencies which may be required to assist underserved needs. Actions planned to foster and maintain affordable housing The City has an Affordable Housing Policy as well as a Minimum Housing Code which lays out the City's plans to foster and maintain affordable housing, ensure future housing needs are met and development is in coordination with the City's Comprehensive and Consolidated Plans. In addition to the long-term goals of the policy, the Community Development Department will continue to promote affordable housing needs of the community. The City participates in local Homebuyer and Foreclosure Prevention workshops and seminars to further assist those in need. Annual Action Plan 26 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) Actions planned to reduce lead -based paint hazards The Housing Division will continue to provide lead -based paint assessments and abatement on properties identified and containing hazards. A lead -based paint review of all properties constructed prior to 1978 is conducted prior to providing assistance. The City will also provide lead -based paint education during mandatory workshops for all clients assisted with CDBG funds under the Owner -Occupied Minor Home Repair program. Actions planned to reduce the number of poverty -level families The activities identified in this PY 2023 AAP work directly to reduce poverty among low- to moderate - income households and special needs groups. Youth prevention and intervention services are provided to help improve the quality of life for these individuals and meal services for the elderly offset other basic living cost. Affordable housing preservation activities such as the Minor Home Repair program maintain housing conditions for low- to moderate -income households. Housing preservation, through rehabilitation activities, protects the value of the home, which is an important driver of wealth. The City will continue to dedicate a majority of its federal and state funding to affordable housing strategies and coordinate with the Broward Coalition for the Homeless and Broward County agencies to support additional programs to limit poverty among the residents of Tamarac. Housing counseling, debt management, credit repair, as well as other social services are provided through various partners available to assist residents in financial crisis. Actions planned to develop institutional structure The City's Housing programs will continue to be administered in-house by City staff. Internal City staff, committees, and Boards will review and recommend activities to be carried out under the Consolidated Plan and subsequent Annual Action Plans. Additional input will be sought from outside agencies for the formulation of unmet needs and activities to address them. The City's Service Delivery System is largely conducted by City staff. Public Services are provided by the City's grant funds, local public services agencies and non-profit agencies. Coordination is strong between the City and subrecipients, however funding is limited. Further, due to CDBG grant regulations, only 15% of grant funds are allowable under public services each year. Actions planned to enhance coordination between public and private housing and social service agencies The City of Tamarac participates in County/City Committees created to coordinate public, private and community -based efforts to expand affordable housing and economic development initiatives through research and program development activities that support community development joint ventures Annual Action Plan 27 2023 OMB Control No: 2506-0117 (exp. 09/30/2021) between the private and public sectors. To further the cause for affordable housing, the City will determine the following actions: • Continue to support the efforts of the City to develop recommendations regarding land use revisions/changes that would provide development incentives for the expansion of affordable rental/owner occupied housing. • Continue the implementation of the State Housing Incentive Partnership (SHIP) Program to promote and diversify available financing and inducement incentives to expand the affordable housing stock in the City of Tamarac. The City of Tamarac Community Development Departmentwill identify publicly owned land/buildings that can be developed for affordable housing initiatives. Discussion The City's Community Development Department will act as the primary entity responsible for the coordinating, planning and implementing of programs and projects internally, and among private and public agencies. The City has a Citizen Participation Plan which gives guidance to the citizen participation process and calls for minimum requirements in soliciting feedback from low- to moderate -income residents and special need groups such as persons with a disability and the elderly in the development of its programs. The City also reports on its programs in the Consolidated Annual Performance and Evaluation Report (CAPER), which is released to the public and submitted to HUD after each program year.
