A RESOLUTION OF THE CITY COMMTSSION OF
THE CITY OF TAMAFI,AC, FLORIDA APPROVINGAMENDMENT NO. 1 TO THE LANDSCAPE
MAINTEhIANCE MEMORANDUM OF AGREEMENT
(MMOA) BETWEEN THE CtTy OF TAMARAC ANDTHE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATTON (FDOI) FOR THE SECTTON OF
STATE ROAD 870 COMMERCTAL BOULEVARD
FROM MILEPOST 3.150 TO MILEPOST 3.221, TO
AMEND THE LIMITS TO INCLUDE STATE ROAD 7(us 441) FROM MILEPOST 14.748 TO MTLEPOST
14.796; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE SAID AMENDMENT NO. 1TO THE LANDSCAPE MEMORANDUM OF
AGREEMENT, PENDING LEGAL REVIEW BETWEENFDOT AND THE CITY OF TAMARAC, FOR
IANDSCAPE IMPROVEMENTS ON STATE ROAD 7(us 441) BETWEEN M|LEPOST 14.748 AND
MILEPOST 14.796; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILTW; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, landscape improvements within the median in the right-of-way of
State Road 7 (US 41,1are to be installed; and
WHEREAS, FDOT requires loca! govemment agencies within which the
landscap6d medians are located to maintain such landscaping by entering into a
Landscape Maintenance Memorandum Agreement (MMOA); and

WHEREAS, the City received notice that the Florida Department of
Transportation ("FDOT") issued Permit No. 2018-L491-OO2 for landscape
improvements within the right-of-way of State Road 870 (Gommercial Boulevard); and
VVI-IEREAS, landscape improvements to be installed will extend on to State Road
7 (US 4,41), and the original Landscape MMOA from Commercial Boulevard from
MILEPOST 3.150 TO MILEPOST 3.221 must be amended to include the right-of-way
along US 4,41; and
WHEREAS, pursuant to FDOT regulations, FDOT only enters into such MMOAs
with other local govemment agencies; and
WHEREAS, the Director of Public Services and the Director of Financial Services
recommend approval of the Amendment to the Landscape MMOA, hereto attached as
Exhibit "1"; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the
best interest of the citizens and residents of the City of Tamarac to execute the
Amendment No. 1 to the Landscape MMOA with FDOT following legal review, hereto
aftached as Exhibit "1"; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing 'WHEREAS" clauses are HEREBY ratifred and
confirmed as being true and correct and are HEREBY made a specific part of this
Resolution. All exhibits attached hereto and referenced herein are expressly
incorporated and made a specific part of this Resolution.
Section 2: The City Commission of the City of Tamarac HEREBY approve the
Amendment No. 1 to the Landscape Maintenance Memorandum of Agreement, hereto
attached as'Exhibit 1" and the appropriate City Officials are HEREBY authorized to
execute said Amendment No. 1 to the Landscape MMOA.
Section 3: All Resolutions in conflict herewith are HEREBY repeated to the
extent of such conflict.
Section 4: lf any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutionat or invalid, in part or in
application, it shall not affect the validity of the remaining portion or applications of this
Resolution.

Section 5: This Resolution shall become effective immediately upon its adoption

W!THNESSETH
WHEREAS, the parties entered into the Landscape Maintenance of Agreement dated,May 7,2018 for the purpose of maintaining the landscaie improvemeni. Oy the AGENCy onState Road 870 (Gommercial Boutevard); aid,
WHEREAS, the DEPARTMENT and the AGENCY have agreed to add additionallandscape to be installed on State Road 870 (Commercial Boulevaill ri the intersection ofState Road 7 (US 441) in accordance with the above referenced Agreement; and,
NOW THEREFORE, for and in consideration of mutual benefits that ftow each to the other,the parties covenant and agree as follows:
1. Pursuant to p_aragraph 7 of the Landscape Maintenance Memorandum of Agreement forState Road 870 (Commercial Boulevarbl UateO May 7, 2018, the DEpARTMENT willallow_an adjacent property owner to conitruct additi6nai landscape improvements or tomodify an improvement located as indicated in Exhibit "h,', St"t" Road g7O
(Commercial Boulevard) M. P. 3. 1 50 to M. P. 3.221 and to include the limits of State Road
1(!Jq 441) from M.P. 14.748 to M.P. 14.796, in accordance with the plans attached asExhibit "8".
2' The AGENCY shall agree to maintain the additional landscape improvements in theAgreement described above according the Exhibit "C" Maintenance plan, of the originalagreement, and as follows:
