CITY COMMISSION MEETING
WEDNESDAY, JANUARY 23, 2019
CALL TO ORDER: Vice Mayor Placko called the Commission Meeting of the City of Tamarac
to order at 9:07 a.m. on Wednesday, January 23, 2019, in City Commission Chambers,
Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner E. Mike
Gelin, and Commissioner Julie Fishman were in attendance.
ABSENT: Mayor Michelle J. Gomez
Also in attendance were City Manager Michael C. Cernech, City Attorney Samuel S. Goren
and City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Vice Mayor Placko led the Pledge of Allegiance.
1. PROCLAMATIONS AND PRESENTATIONS:
a. Presentation of a Proclamation by Vice Mayor Debra Placko to Eliathah Seventh Day
Adventist Church for their Generosity and Support of the Thanksgiving Basket Initiative for
Families in Need. (Requested by Vice Mayor Debra Placko)
b. Presentation of a Proclamation by Vice Mayor Debra Placko Commending Battalion Chief
Cerny, Lieutenant Seaman, Driver Engineer Day, Firefighter Lashin, Firefighter Licata and
Firefighter Scott for their excellent work helping the victims of Hurricane Michael. (Requested
by Fire Chief Percy Sayles)
c. Presentation of a proclamation by Vice Mayor Debra Placko proclaiming January 27, 2019
as "Holocaust Remembrance Day". (Requested by Mayor Michelle J. Gomez)
Vice Mayor Placko moved out of the order of the agenda to read into the record a
proclamation honoring and remembering Dr. Martin Luther King, Jr. (Requested by
Commissioner Marlon Bolton)
Vice Mayor Placko moved back into the order of the agenda to take up item 1 (d) — Employee
Service Awards.
d. Presentation by Vice Mayor Placko of Employee Service Awards:

2. CITY COMMISSION REPORTS:
a. Commissioner Bolton: Commissioner Bolton said Monday was Dr. Martin Luther King, Jr.
Day and thanked the Mayor and Vice Mayor for making sure that the proclamation was
brought forward. Commissioner Bolton said he sent an email out to people in his district
which contained a quote from Dr. King's last speech. Commissioner Bolton said Dr. King
knew his work was controversial, but he stood up for what he believed. Commissioner Bolton
charged everyone to stand up for what you believe and never be silent on the things we
believe in. We need to speak for people who cannot speak for themselves. Commissioner
Bolton reported that he attended the Bermuda Club HOA meeting and hosted the 2"d Annual
Tax Meeting on January 22"d. Commissioner Bolton said he will be at Central Parc at the
Pool Cabana on January 29th at 7:00 p.m. to talk about a possible park for that community.
Commissioner Bolton thanked staff for hosting the DRC/Building Permit Workshop and
thanked Fire Rescue for the smoke detector installation drive in Mainlands 1 & 2.
Commissioner Bolton reported he attended the Jewish Federation of Broward County
Legislative Breakfast with Mayor Gomez and Commissioner Fishman. Commissioner Bolton
wished Vice Mayor Placko a Happy Birthday and said you can reach him at 954-275-3850
and follow him on Facebook.
b. Commissioner Gelin: Commissioner Gelin reported that he attended the Habitat for
Humanity MLK Day celebration in Ft. Lauderdale and talked about the guest speaker's, Don
Mizell's, biography. Commissioner Gelin talked about the life of Dr. King and read a portion
of a letter Dr. King wrote while he was in jail in response to a local pastor who said he should
not be in Washington, D.C., a copy of that letter is on file in the City Clerk's Office.
Commissioner Gelin said he also attended the MLK celebrations in Coral Springs and
Tamarac. Commissioner Gelin talked about a lynching that took place in Broward County in
1935, a Senate Bill that was recently passed making lynching a Federal Crime and reported
that the National Memorial for Peace and Justice will be opening in Montgomery, Alabama.
Commissioner Gelin reported that Governor DeSantis recently pardoned the Groveland 4
who were falsely accused of rape in 1949 on January 11, 2019; rescinded the suspension of
Dr. Brenda Snipes and appointed Gregory Tony as the new Broward County Sheriff.
Commissioner Gelin talked about the Prison Reform Bill: First Step Act. Commissioner Gelin
ended with a collage of pictures of Dr. Martin Luther King, Jr. A copy of Commissioner
Gelin's PowerPoint Presentation is on file in the City Clerk's Office.
c. Commissioner Fishman: Commissioner Fishman reported that she attended the Human
Trafficking Round Table meeting; the Day of Service at Tamarac Elementary School; met
with Dr. Ted Greer of HOPE South Florida and All Saints Lutheran Church Pastor Reginald
Hansome to talk about the homeless situation and also met with Peter Kaldes, President &
CEO of South Florida Institute on Aging. Commissioner Fishman reported that she attended
the Jewish Federation of Broward County Legislative Breakfast and Tamarac's Dr. Martin
Luther King, Jr. celebration. Commissioner Fishman thanked staff for the DRC/Building
Permit Workshop and noted that she recently spoke to a Women's group at All Saints
Lutheran Church about Human Trafficking.
d. Vice Mayor Placko: Vice Mayor Placko said she also attended the Day of Service at
Tamarac Elementary School. Vice Mayor Placko attended an all -day MPO meeting and one
of the most interesting sessions she attended was about the Transportation System

Management for FDOT. Vice Mayor Placko announced that on January 18tn Family Central
was acquired by Kids in Distress and that Dr. Barbara Weinstein is retiring. Vice Mayor
Placko reported that she attended the Rock N Ride event; the ADRC installation of new
officers and celebration honoring the late Executive Director Edith Lederberg; two HOA
meetings about traffic calming and the Dr. Martin Luther King, Jr. celebration

3. CITY ATTORNEY REPORT: City Attorney Goren said yesterday his office sent out the first
formal legislative report. City Attorney Goren went on to highlight several of the following bills
that his office is tracking during the upcoming legislative session which may have an impact
on the City: HB45; SB76; SJR74, S688; HJR 229; HB265 and SB306 among others. City
Attorney Goren said the legislative session begins on March 5, 2019 and his office will keep
the Commission updated as it goes along. City Attorney Goren wished Vice Mayor Placko a
Happy Birthday.
4. CITY MANAGER REPORT: City Manager Cernech wished Vice Mayor Placko a Happy
Birthday.
Upcoming Events: The free Mainlands Concert in the Park at 4500 Monterey Dr. will take
place on Sunday January 27tn from 3:00 p.m. to 5:00 p.m. It will feature the music of the band
"Style". Parking is limited, and free shuttle buses will be provided from Mainlands Clubhouse
1, 2 & 3. The Seniors Domino Tournament for people 40 and over will take place at the
Tamarac Community Center on Saturday, February 2, 2019 beginning at 11:00 a.m. There is
a $20 registration fee (by January 26tn) which includes lunch and dinner. For more
information call 954-597-3635. The Teen Summit, Cyber Talk Edition, for teens 13 to 18, will
take place on Saturday, February 16tn from 9:00 a.m. to noon. The fee is $5 per person and
includes breakfast and lunch. Interested parties must pre -register by Monday, February 11tn
Topics of discussion include: texting, online communication, cyber bullying and setting
boundaries. There will also be a 3rd Annual 3-point Basketball Challenge, raffles and
giveaways.
Past Events: 800 people attended the Rock N' Ride Concert & Car Event on January 12th;
250 people attended the MLK Day celebration at the Community Center on January 18tn
5. PUBLIC PARTICIPATION: Vice Mayor Placko opened Public Participation and the
following individual spoke: Ron Wasserman, 8577 Jade Drive, spoke on various subjects.
With no one else wishing to speak, Vice Mayor Placko closed public participation.
6. CONSENT AGENDA: Vice Mayor Placko asked if there were any changes/additions to the
Consent Agenda and City Manager Cernech said there were no changes/additions to the
Consent Agenda. Commissioner Bolton seconded by Commissioner Gelin moved approval
of the Consent Agenda as presented. Motion passed unanimously (4-0).
a. TR13223 - Scope of Services/Agreement — Miller Legg: Master Landscape Study: A
Resolution of the City Commission of the City of Tamarac, Florida, approving Task
Authorization No. 19-05s and authorizing the appropriate City officials to execute Task
Authorization No. 19-05s with Miller Legg to provide professional services to prepare an

update of the City of Tamarac Master Landscape Study in accordance with the City's
Consulting Engineering Agreement as authorized by Resolution No. R-2016-80, for an
amount not to exceed $91,000.00; approving funding from the appropriate budgeted Utilities
Operational and CIAC accounts; authorizing the appropriate City officials to administer the
contract; providing for conflicts; providing for severability; and providing for an effective date.

b. TR13228 - Ronald L. Book -Agreement Renewal Amendment #16: A Resolution of the City
Commission of the City of Tamarac approving Amendment #16 to the Agreement between
the City of Tamarac and Ronald L. Book, P.A. for Lobbying Services, extending the
Agreement for one year through January 26, 2020, at a cost not to exceed Fifty -Nine
Thousand Four Hundred ($59,400) Dollars per year; authorizing the appropriate City Officials
to execute the Amendment to the Agreement for Lobbying Services; providing for conflicts;
providing for severability and providing for an effective date.

c. TR13221 - Memorandum of Understanding (MOU) between City of Tamarac and Parks &
Recreation Foundation of Tamarac: A Resolution of the City Commission of the City of
Tamarac, Florida, approving and authorizing the appropriate City Officials to execute a
Memorandum Of Understanding (MOU) between the City of Tamarac and the Parks And
Recreation Foundation Of Tamarac (PAROT) establishing a relationship between The City of
Tamarac and PAROT for participation in a National Football League (NFL) Foundation
Grassroots Grant Program Application and Grant Award in the event of approval of the
application; providing for conflicts; providing for severability; and providing for an effective
date.

d. TR13233 - Ferguson Group, LLC - Federal Lobbyist Services - Agreement Renewal
Amendment #10: A Resolution of the City Commission of the City of Tamarac, Florida;
approving Amendment #10 to the Agreement between the City of Tamarac and the Ferguson
Group, LLC, for federal lobbying services, extending the term of the agreement for a one year
period effective February 13, 2019 at a cost not to exceed eighty-five thousand five hundred
($85,500.00) dollars per year; authorizing the appropriate City Officials to execute
amendment #10 to the agreement, providing for conflicts; providing for severability, and
providing for an effective date.

e. TR13232 - Zoning in Progress — 180 Day Moratorium on New Self -Storage Facilities
Citywide: A Resolution of the City Commission of the City of Tamarac, Florida, affirming and
ratifying the City Manager's Administrative Order dated January 8, 2019, attached hereto as
Exhibit 1" and incorporated herein, declaring Zoning in Progress and instituting a 180-day
moratorium on the submission and acceptance of applications for administrative review, land
development permits, and building permits for the use of land for new self -storage facilities
(indoor) in the City of Tamarac, in accordance with Chapter 10, Section 10-5.4(u) of the City
of Tamarac Code of Ordinances; authorizing and directing the City Manager to undertake
study and review of the City's regulations relating to the number and locations of Self Storage
Facilities in the City of Tamarac; providing that upon the adoption of this Resolution affirming
the Administrative Order, no permits shall be issued for any new self -storage facilities not

otherwise exempt during the time period covered by this resolution, providing for conflicts,
providing for severability; and providing for an effective date.

f. TR13230 - Charitable Organizations: A Resolution of the City Commission of the City of
Tamarac, Florida, Amending Resolution R-2018-30, by specifically adding to the List of
Charitable Entities with whom the city of tamarac recognizes a formally approved
relationship; providing for an amended Exhibit "A", attached hereto and incorporated herein,
as may be amended from time to time, for the expressed purpose of compliance with Section
1-19(C)(5)(A)(4) of the Broward County Code of Ordinances; providing for conflicts; providing

g. TR13231 - Fiber Network Expansion (Phase 1): A resolution of the City Commission of the
City of Tamarac, Florida, authorizing the appropriate City Officials to execute a fixed price
contract between Hypower, Inc. and the City of Tamarac to expand the City's fiber network in
the lump sum amount of $1,457,572.65, a contingency of $145,757 (10%), for permits and
unforeseen conflicts only, will be added to the project account for a total project budget of
$1,603,330-1 authorizing the waiver of procurement procedures in the best interest of the City
per the requirements of section 6-148(i) of the Tamarac procurement code; authorizing an
appropriation in the amount of $1,603,330.00; authorizing the City Manager or his designee
to make changes and issue change orders in accordance with the thresholds and provisions
delineated in section 6-1470)(2) of the Tamarac procurement code; providing for conflicts,
providing for severability; and providing for an effective date.

10. ORDINANCE(S) - SECOND READING:
a. T02380 - Code Enforcement Administrative Fines, Costs of Repair & Lien Items: An
Ordinance of the City Commission of the City of Tamarac, Florida amending Chapter 2 of the
City's Code of Ordinances, entitled "Administration" by specifically amending Article III,
entitled "Boards, Committees, Commission," by creating Section 2-73.09 entitled
"Administrative Fines, Costs of Repair and Liens" for Code Enforcement orders not complied
with and repeat violations in accordance with Section 162.09 Florida Statutes; providing for
codification; providing for conflicts; providing for severability; and providing for an effective
date. City Attorney Goren read T02380 by title into the record. Commissioner Bolton
seconded by Commissioner Fishman moved approval of T02380 on second reading. Vice
Mayor Placko opened the Public Hearing and with no one wishing to speak, closed the Public
Hearing. Motion passed unanimously (4-0).
