R-2023 - 100 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AWARDING BID 23-34B TO MILLER ELECTRIC COMPANY, AND APPROVING THE PURCHASE FROM, AND REPLACEMENT OF ACCESS CONTROL SYSTEM (ACS) CARD READERS AND PANELS BY, MILLER ELECTRIC COMPANY AT A COST OF $68,112.81, ALSO TO INCLUDE A CONTINGENCY OF $1,887.19 FOR PERMITS AND OTHER UNFORESEEN NEEDS, PROVIDING FOR A TOTAL PROJECT BUDGET OF $70,000.00, AUTHORIZING EXPENDITURES FROM THE APPROPRIATE ACCOUNTS; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO MAKE CHANGES AND ISSUE CHANGE ORDERS IN ACCORDANCE WITH THE THRESHOLDS AND PROVISIONS DELINEATED IN SECTION 6-147(J)(2) OF THE TAMARAC PROCUREMENT CODE; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER ERRORS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and Temp. Reso. #13996 September 13, 2023 Page 2 of 5 WHEREAS, technology is one of the key components in the efficient delivery of City services, and the City's security infrastructure is critical to ensuring continued operations and protecting City facilities; and WHEREAS, the City has multiple Access Control System (ACS) card readers and panels at various City facilities, which are aging and experiencing frequent malfunctions; and WHEREAS, in order to maintain security and ensure efficient ingress/egress to City facilities, the card readers and panels require replacement; and WHEREAS, the City published Invitation to Bid (ITB) 23-34B to obtain bids from qualified firms for replacement of old card readers, control boards, and reader boards; and integration with the City's Access Control System (ACS) security system software, available on file with the City Clerk's Office; and WHEREAS, four (4) bids were received, available on file with the City Clerk's Office, with costs as indicated below: Miller Electric Company $68,112.81 Security 101 Holdings LLC $87,799.15 Convergint $103,410.89 Johnson Controls Security Solutions LLC $143,437.57 and WHEREAS, the proposal from Miller Electric Company was the lowest responsible and responsive bid; and WHEREAS, funding is available in the Information Technology Security System Repair and Maintenance Services Account; and Temp. Reso. #13996 September 13, 2023 Page 3 of 5 WHEREAS, it is the recommendation of the Director of Information Technology and the Purchasing and Contracts Manager that the City Commission of the City of Tamarac award Invitation To Bid (ITB) No. 23-34B, and issue a Purchase Order, to Miller Electric Company, for the replacement of Access Control System (ACS) card readers and panels, at a cost of $68,112.81, also to include a contingency of $1,887.19, for permits and other unforeseen needs, for a total project budget of $70,000.00-1 and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the citizens and residents of the City of Tamarac to award Invitation To Bid (ITB) No. 23-34B, and issue a Purchase Order, to Miller Electric Company, for the replacement of Access Control System (ACS) card readers and panels, at a cost of $68,112.81, also to include a contingency of $1,887.19, for permits and other unforeseen needs, for a total project budget of $70,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT. - Section 1. The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2. The City Commission awards Invitation To Bid (ITB) No. 23-34B to Miller Electric Company for the replacement of Access Control System (ACS) card readers and panels, at a cost of $68,112.81, also to include a contingency of $1,887.19, for permits and other unforeseen needs, for a total project budget of $70,000.00-1 authorizes the appropriate City Officials to execute a Purchase Order to Miller Electric Temp. Reso. #13996 September 13, 2023 Page 4 of 5 Company for the purchase and replacement of Access Control System (ACS) card readers and panels, at a cost of $68,112.81, also to include a contingency of $1,887.19, for permits and other unforeseen needs, for a total project budget of $70,000.00. Section 3. Funding is available for the purchase and replacement of Access Control System (ACS) card readers and panels, from the appropriate accounts for a total cost not to exceed $70,000.00. Section 4: The City Manager or his designee is hereby authorized to approve and initiate change orders in amounts not to exceed $65,000 per section 6-147 of the City Code and close the contract award which includes but is not limited to making final payment and releasing bonds per section 6-149 of the City Code when the work has been successfully completed within the terms, conditions and pricing of the agreement. Section 5. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6. Any scrivener or typographical errors that do not affect intent of this Resolution may be corrected with notice to and authorization of the City Attorney and City Manager without further process. Section 7. If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
