RESOLUTION NO. R-2023 - J )
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, AWARDING BID 23-31 B
TO INDUSTRIAL COMMUNICATIONS AND
ELECTRONICS, INC., AND APPROVING THE
PURCHASE FROM, AND TURNKEY REPLACEMENT
OF THE MOTOROLA 800MHz RADIO SYSTEM BY,
INDUSTRIAL COMMUNICATIONS AND ELECTRONICS,
INC., AT A COST OF $431,972.50, ALSO TO INCLUDE A
CONTINGENCY OF $48,027.50 FOR PERMITS AND
OTHER UNFORSEEN NEEDS, PROVIDING FOR A
TOTAL PROJECT BUDGET OF $480,000.00;
AUTHORIZING EXPENDITURES FROM THE
APPROPRIATE ACCOUNTS; AUTHORIZING THE CITY
MANAGER OR HIS DESIGNEE TO MAKE CHANGES
AND ISSUE CHANGE ORDERS IN ACCORDANCE WITH
THE THRESHOLDS AND PROVISIONS DELINEATED IN
SECTION 6-147(J)(2) OF THE TAMARAC
PROCUREMENT CODE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SCRIVENER ERRORS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes provide that municipalities shall have the
governmental, corporate, and proprietary powers to enable them to conduct municipal
government, perform municipal functions, render municipal service, and exercise any
power for municipal purposes, except when expressly prohibited by law; and
WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac
("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions
as may be required for the proper governing of the City; and

WHEREAS, technology is one of the key components in the efficient delivery of
City services, and the City's telecommunications infrastructure, including the City's 800
MHz radio system, is critical to ensuring continued communications and operations; and
WHEREAS, successful radio communications are necessary to provide City
agencies with an effective means of communication between departments and other local
governmental agencies; and
WHEREAS, the existing equipment has been in service for fifteen (15) years and
has outlived its useful life; and
WHEREAS, the Information Technology Department has recognized the need to
acquire updated replacement radio communications equipment in order to facilitate
effective communications capabilities; and
WHEREAS, the City published Invitation to Bid (ITB) 23-31 B to obtain bids from
authorized Motorola Solutions partners/resellers for the purchase of a Turnkey
replacement of the City's Motorola 800 MHz Radio System with an 800 MHz Motorola
MOTOTRBO digital radio and antenna system; and
WHEREAS, two (2) bids were received, available on file with the City Clerk's
Office, with costs as indicated below:
Industrial Communications and Electronics, Inc. $431,972.50
Signal Communications $491,028.18
and
WHEREAS, the proposal from Industrial Communications and Electronics, Inc.
was the lowest responsible and responsive bid; and

WHEREAS, funding is available in the FY2023 Information Technology Capital
Maintenance Program (CMP) (Project IT23A) budget, account 303-8100-513.64-01, in
the amount of $480,000.00-1 and
WHEREAS, it is the recommendation of the Director of Information Technology
and the Purchasing and Contracts Manager that the City Commission of the City of
Tamarac award Invitation To Bid (ITB) No. 23-31 B, and issue a Purchase Order, to
Industrial Communications and Electronics, Inc. for the replacement of the City's Motorola
800 MHz Radio System, at a cost of $431,972.50, also to include a contingency of
$48,027.50, for permits and other unforeseen needs, for a total project budget of
$480,000.00-1 and
WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best
interests of the citizens and residents of the City of Tamarac to award Invitation To Bid
(ITB) No. 23-31 B, and issue a Purchase Order, to Industrial Communications and
Electronics, Inc. for the replacement of the City's Motorola 800 MHz Radio System, at a
cost of $431,972.50, also to include a contingency of $48,027.50, for permits and other
unforeseen needs, for a total project budget of $480,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:
Section 1. The foregoing recitals are true and correct and hereby adopted as
the legislative and administrative findings of the City Commission; all exhibits attached
hereto are incorporated herein and made a specific part of this Resolution.

Section 2. The City Commission awards Invitation To Bid (ITB) No. 23-31 B to
Industrial Communications and Electronics Inc. for the turnkey replacement of the City's
Motorola 800 MHz Radio System, at a cost of $431,972.50, also to include a contingency
of $48,027.50, for permits and other unforeseen needs, for a total project budget of
$480,000.00-1 authorizes the appropriate City Officials to execute a Purchase Order to
Industrial Communications and Electronics, Inc. for the purchase and turnkey
replacement of the City's Motorola 800 MHz Radio System, at a cost of $431,972.50, also
to include a contingency of $48,027.50, for permits and other unforeseen needs, for a
total project budget of $480,000.00.
Section 3. Funding is available for the purchase and replacement of the City's
Motorola 800 MHz Radio System, from the appropriate accounts for a total cost not to
exceed $480,000.00.
Section 4: The City Manager or his designee is hereby authorized to approve and
initiate change orders in amounts not to exceed $65,000 per section 6-147 of the City
Code and close the contract award which includes but is not limited to making final
payment and releasing bonds per section 6-149 of the City Code when the work has been
successfully completed within the terms, conditions and pricing of the agreement.
Section 5. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 6. Any scrivener or typographical errors that do not affect intent of this
Resolution may be corrected with notice to and authorization of the City Attorney and City
Manager without further process.

Section 7. If any clause, section, other part, or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

Section 8. This Resolution shall become effective immediately upon adoption.
