CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- 2023 I
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, APPROVING AND
AUTHORIZING AN INCREASE IN THE HOURLY RATE
OF COMPENSATION FOR THE CITY'S SPECIAL
MAGISTRATES FROM ONE HUNDRED FIFTY
DOLLARS ($150.00) PER HOUR TO TWO HUNDRED
($200.00) PER HOUR; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on January 26, 2000, the City Commission of the City of Tamarac,
Florida (hereinafter referred to as the "City") adopted Resolution No. R-2000-32,
appointing Mark E. Berman, Eugene M. Steinfeld, and Alan L. Gabriel to serve as the
City's Special Magistrates for the purpose of code enforcement; and
WHEREAS, the Special Magistrates were appointed at a rate of one hundred
dollars ($100.00) per hour; and
WHEREAS, on June 27, 2007, the City Commission via Resolution R-2007-095
increased the hourly rate of compensation for the City's Special Magistrates to One
Hundred and Twenty -Five ($125.00) Dollars per hour; and
WHEREAS, an additional increase from $125.00 per hour to One Hundred and
Fifty ($150.00) Dollars per hour was granted to Special Magistrates Eugene M. Steinfeld
and Alan L. Gabriel; and
WHEREAS, parts of the State of Florida, including the City of Pembroke Pines are
currently paying the same Special Magistrates at a rate of Two Hundred Fifteen Dollars
($215.00) per hour; and

WHEREAS, a request for an increase to Two Hundred ($200.00) Dollars per hour
was received from Special Magistrate Alan L. Gabriel, on July 19, 2023; and
WHEREAS, the City Commission, in an effort to remain competitive, deems it to
be in the best interests of the City to increase the hourly rate of City's Special Magistrates
Eugene M. Steinfeld and Alan L. Gabriel from One Hundred and Fifty Dollars ($150.00)
per hour to Two Hundred Dollars ($200.00) per hour.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
SECTION 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed
as being true and correct and are hereby made a specific part of this Resolution.
SECTION 2. The City Commission of the City of Tamarac hereby approves and
authorizes an increase in the hourly rate of compensation for the City's Special
Magistrates Eugene M. Steinfeld and Alan L. Gabriel from One Hundred and Fifty Dollars
($150.00) per hour to Two Hundred ($200.00) Dollars per hour.
SECTION 3. All resolutions or parts of resolutions on in conflict herewith be, and
the same are hereby repealed to the extent of such conflict.
SECTION 4. If any clause, section, other part or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions or applications of this
Resolution.

SECTION 5. This Resolution shall become effective immediately upon its passage
and adoption.
