RESOLUTION NO. R-2023- 13 -7
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, GRANTING SITE PLAN
APPROVAL (MAJOR) WITH CONDITIONS TO ALLOW FOR
THE DEVELOPMENT OF THE SUBJECT PROPERTY,
FORMERLY KNOWN AS THE WOODLANDS GOLF
COURSE, TO PERMIT THE CONSTRUCTION OF THREE
HUNDRED THIRTY-FIVE (335) SINGLE FAMILY HOMES IN
EIGHT (8) SEPARATE PODS FOR PROPERTIES LOCATED
SOUTH OF W COMMERCIAL BOULEVARD, NORTH OF NW
44 STREET, EAST OF NW 64 AVENUE, AND WEST OF
ROCK ISLAND ROAD, SITUATED ON VARIOUS PORTIONS
OF THE FORMER "WOODLANDS GOLF COURSE",
TAMARAC, FLORIDA (CASE NO. 14-SP-19); PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Michael Nunziata, 13th Floor Woodlands HB GP, designated agent for
the property owner, Clublink US, LLC, is requesting Site Plan Approval (Major) to allow for
the development of the subject property, formerly known as the Woodlands Golf Course, to
permit the construction of three hundred thirty-five (335) single family homes in nine (9)
separate pods located south of W Commercial Boulevard, north of NW 44 Street, east of
NW 64 Avenue, and west of Rock Island Road (Case No. 14-SP-19); and
WHEREAS, the subject property received approval on Second Reading of a Large
Scale Land Use Amendment and Rezoning from the City Commission on March 22, 2023,
changing the Future Land Use designation of the subject property from "Commercial
Recreation" to "Low Density Residential", restricted to 0-3 dwelling units per acre and the
zoning of the subject property from "RC, Recreation", to "RE, Residential Estate",
respectively, to allow for the single family home development; and
WHEREAS, the purpose of the Residential Estate zoning district is to provide for

primarily large -lot, single-family neighborhoods; and
WHEREAS, staff has determined that the standards outlined in Section 10-5.4(H)(6)
of the Land Development Code (LDC) for Site Plan (Major) approval have been met; and
WHEREAS, pursuant to the City's LDC, the appropriate public meetings have been
advertised in accordance with applicable law of the date, time, and place of the meeting
regarding the review of the application for Site Plan (Major) approval; and
WHEREAS, Director of Community Development recommends approval (with
conditions); and
WHEREAS, the Planning Board recommended approval (with conditions) on
October 4, 2023; and
WHEREAS, Staff has examined the application, and the forwarding
recommendations of the Planning Board; and
WHEREAS, the City Commission has determined that the application complies with
all elements of the Comprehensive Plan, or will be in compliance with all elements of the
Comprehensive Plan, prior to the issuance of a Certificate of Occupancy for the
development; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the business owners, residents and visitors of the City of Tamarac,
Florida to grant Site Plan Approval (Major) with conditions to allow for the development of
the subject property, formerly known as the Woodlands Golf Course, to permit the
construction of three hundred thirty-five (335) single family homes in eight (8) separate
pods located south of W Commercial Boulevard, north of NW 44 Street, east of NW 64
Avenue, and west of Rock Island Road (Case No. 14-SP-19).

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA-
SECTION 1: The foregoing recitals are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Ordinance upon adoption
hereof. All exhibits referenced herein are incorporated into this Resolution and made a
specific part hereof.
SECTION 2: The application for Site Plan Approval (Major) with conditions to
allow for the development of the subject property, formerly known as the Woodlands Golf
Course, to permit the construction of three hundred thirty-five (335) single family homes in
eight (8) separate pods located south of W Commercial Boulevard, north of NW 44 Street,
east of NW 64 Avenue, and west of Rock Island Road (Case No. 14-SP-19), is
APPROVED subject to the following conditions:
1. Separate Site Plan Approval (Major) application required for clubhouse and
amenities.
2. Separate Site Plan Approval (Minor) application required for all gating and roadway
improvements proposed by the Traffic Impact Analysis, including off -site signalized
intersections and on -site unsignalized intersections.
3. Construction is to be in complete compliance with the plans and specifications
submitted by the developer to the City of Tamarac and approved engineering
drawings.
4. Commencement of construction shall begin no later than one (1) year from the date
of this approval. If the development does not commence construction within one (1)
year, this approval is null and void unless an extension has been granted in

accordance with applicable regulations.
5. The Development Order is assignable, but assignment does not discharge any
assignee from strict compliance with the order unless the City Commission consents
to modify any of the original requirements.
6. All requirements from the Development Agreement between the City of Tamarac
and Woodlands Club Holdings, LLLP, shall be adhered to as part of this application.
7. Prior to any paving, grading and drainage activities, a copy of Broward County's
Environmental Resource Permit shall be provided to the City. Any modifications to
the site, due to the surface water permit requirements, shall be reflected on the site
plan.
8. Satisfaction of the minor outstanding Development Review Committee comments
from the review of the Site Plan Approval (Major) for the Woodlands Residential SP
project, Case No. 14-SP-19.
9. Site Plan to be revised and submitted to the Community Development Department,
prior to the filing of any building permit application to show the elimination of Pod E
(to include the 7 lots contained in POD E) from the Site Plan.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part, or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in
part or in application, it shall not affect the validity of the remaining portions or applications
of this Resolution.
