R-2023 - / L f 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING THE NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY CYBERSECURITY FRAMEWORK AS THE CYBERSECURITY STANDARD FOR THE CITY OF TAMARAC, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENER ERRORS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac ("City") empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and WHEREAS, technology is one of the key components in the efficient delivery of City services, and the security of the City's network infrastructure, server infrastructure, data and facilities is critical to ensuring continued operations; and WHEREAS, State of Florida Statute 282.3185, the "Local Government Cybersecurity Act," establishes cybersecurity requirements for county and municipal governments; and WHEREAS, State of Florida Statute 282.3185 (4) states, "Each local government shall adopt cybersecurity standards that safeguard its data, information technology, and Temp. Reso. #14061 December 13, 2023 Page 2 of 4 information technology resources to ensure availability, confidentiality, and integrity. The cybersecurity standards must be consistent with generally accepted best practices for cybersecurity, including the National Institute of Standards and Technology Cybersecurity Framework;" and WHEREAS, State of Florida Statute 282.3185 (4) requires municipalities with a population of 25,000 or more to adopt a cybersecurity standard by January 1, 2024; and WHEREAS, the Department of Information Technology of the City of Tamarac, Florida, has selected the National Institute of Standards and Technology Cybersecurity Framework as a baseline cybersecurity standard to which all cybersecurity policies of the City of Tamarac, Florida, will adhere; and WHEREAS, it is the recommendation of the Chief Information Officer that the City Commission adopt the National Institute of Standards and Technology Cybersecurity Framework as a baseline cybersecurity standard to which all cybersecurity policies of the City of Tamarac, Florida, will adhere; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to adopt the National Institute of Standards and Technology Cybersecurity Framework as a baseline cybersecurity standard to which all cybersecurity policies of the City of Tamarac, Florida, will adhere. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: Temp. Reso. #14061 December 13, 2023 Page 3 of 4 Section 1. The foregoing recitals are true and correct and hereby adopted as the legislative and administrative findings of the City Commission; all exhibits attached hereto are incorporated herein and made a specific part of this Resolution. Section 2. That the National Institute of Standards and Technology Cybersecurity Framework shall be the guiding cybersecurity standard for all cybersecurity policies adopted by the City of Tamarac, Florida and the Department of Information Technology. Section 3. That the City of Tamarac, Florida and the Department of Information Technology may further use any standards, guidelines, and best practices from within any generally accepted cybersecurity standard to establish cybersecurity policies for the City of Tamarac, providing all such policies are as stringent or more stringent than those provided by the National Institute of Standards and Technology Cybersecurity Framework. Section 4. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 5. Any scrivener or typographical errors that do not affect intent of this Resolution may be corrected with notice to and authorization of the City Attorney and City Manager without further process. Section 6. If any clause, section, other part, or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
