CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2023- /,56
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA, APPROVING THE SPECIAL EXTENDED HOURS
PERMIT FOR 19 RESTAURANT & NIGHTCLUB LOCATED AT 5305
NORTH STATE ROAD 7, TAMARAC, FLORIDA, ALLOWING ALCOHOL
SALES AND CONSUMPTION ON -PREMISES ONLY FROM 2:00 A.M. TO
4:00 A.M. ON THURSDAYS, FRIDAYS, AND SATURDAYS, IN
ACCORDANCE WITH SECTION 3-4 OF THE CITY OF TAMARAC CODE
OF ORDINANCES ; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City may extend the times for service and sale of alcohol pursuant
to Section 3-4 entitled "Special Permit Required for Extended Hours", of the City of
Tamarac Code of Ordinances; and
WHEREAS, Section 3-4(a)(4) specifically allows the vendor to sell and serve
alcoholic beverages for consumption on -premises only on a Thursday, Friday and
Saturday until 4:00 a.m. (i.e. two (2) hours later than the standard 2:00 a.m. on -premises
sale) pursuant to the granting of a special permit by the City Commission; and
WHEREAS, the applicant, Emmanuel Daphins, submitted an application to the
Community Development Department to have the City Commission consider an extended
hours special permit for the business G Bar & Grill dba i9 Restaurant & Nightclub located
at 5305 North State Road 7, Tamarac, Florida on September 19, 2023, pursuant to
Section 34(c); and
WHEREAS, the City Commission may grant and terminate the privilege of a
special permit for extended hours pursuant to Section 3-4(b); and

WHEREAS, the City desires to enhance its economic vitality and continue to
promote the growth and success of local businesses within the community; and
WHEREAS, attracting and retaining businesses are in alignment with the City's
economic development goals and the ability to obtain a "Special Extended Hours Permit"
to allow on -premises alcohol sales and consumption until 4:00 a.m. encourages
businesses who desire to do so, and provide them with an opportunity to thrive and grow
within their own City; and
WHEREAS, the City believes neighboring jurisdictions that permit the responsible
sale and consumption of alcohol on -premises after 2:00 a.m. are direct competitors to the
licensed establishments that sell alcoholic beverages within the City's jurisdictional
boundaries; and
WHEREAS, the Director of Community Development recommends approval of the
resolution and finds that extending the hours of on -premises alcohol sales and
consumption from 2:00 a.m. to 4:00 a.m. on Thursdays, Fridays, and Saturdays for the i9
Restaurant & Nightclub located at 5305 North State Road 7, Tamarac, Florida meets the
standards outlined in Section 3-4 of the Code and significantly enhances the City's
economic vitality and market competitiveness;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clause is hereby ratified and confirmed
as being true and correct and is made a specific part of this Resolution upon adoption
hereof.

SECTION 2: The City Commission of the City of Tamarac, Florida, hereby
approves the resolution to grant the Special Extended Hours Permit for G Restaurant &
Nightclub located at 5305 North State Road 7, Tamarac, Florida, allowing alcohol sales
and consumption on -premises only from 2:00 a.m. to 4:00 a.m. on Thursdays, Fridays,
and Saturdays for a period of one (1) year, and finds that the standards outlined in Section
3-4 of the Code have been met, as there are no substantially adverse impacts on the
surrounding area based on the following criteria;
1. Increased parking demands;
2. Increased law enforcement demands;
3. Increased environmental and aesthetic impact, including generation of noise,
light and odors;
4. Increased adverse effects on existing properties within the immediate
neighborhood;
5. The ability of the establishment's owners or management to minimize the above -
listed effects.
Additionally, the approval is contingent upon the following conditions:
1. Special Extended Hours Permit is effective for One (1) Year and shall expire
exactly One (1) Year from date of first use.
2. Any future Special Extended Hours Permit requires a new application and fee and
City Commission approval.
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part, or application of this Resolution is
held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 5: This Resolution shall become effective immediately upon its adoption.
