R- 2024— ot) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROVE THE PURCHASE OF REPLACEMENT HEAVY EQUIPMENT VAC -CON; UTILIZING CONTRACT 101221-VAC AWARDED BY SOURCEWELL TO VAC -CON, INC.; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $634,628.00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Adopted Fiscal Year 2024 Capital Equipment Program Budget authorized the purchase of replacement heavy equipment Vac -con for the Public Services Department; and WHEREAS, the timely replacement of City equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, the City Staff determined the utilizing Contract 101221-VAC awarded by Sourcewell to Vac -Con, Inc. was advantageous to the City and Vac -Con, Inc. is best - suited to provide the equipment to best meet the City's needs and within the FY 2024 Adopted Budget allocated for said purpose; and WHEREAS, the quote, per Contract No. 101221-VAC and in the amount $634,628.00, is attached hereto as Exhibit 1"; and WHEREAS, the Director of Public Services and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase replacement equipment utilizing Contract No. 101221-VAC awarded by Sourcewell to Vac -Con, Inc.; and WHEREAS, the City Commission deem it to be in the City's best econmic interests Temp. Reso. # 14047 January 10, 2024 Page 2 of 3 to purchase replacement equipment utilizing Contract No. 101221-VAC awarded by Sourcewell to Vac -Con, Inc., and authorize an expenditure not to exceed $634,628.00 from the appropriate account. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. SECTION 2: The purchase of replacement heavy equipment utilizing Contract No. 101221-VAC awarded by Sourcewell to Vac -Con, inc. in an amount not to exceed $634,628.00 is hereby approved. SECTION 3: Adequate funding exists in the Stormwater Fund and was included in the Fiscal Year 2024 Adopted Budget. SECTION.A: An expenditure in the amount of $634,628.00 for said purpose is hereby authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions Temp. Reso. # 14047 January 10, 2024 Page 3 of 3 or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are declared to be severable.
