R-2024- 01S A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING AND AUTHORIZING THE PURCHASE OF ONE (1) NEW FORD F150 CREW CAB PICK-UP FROM DUVAL FORD UTILIZING FLORIDA SHERIFF ASSOCIATIONS CONTRACT NO. FSA23-VEL32/FSA 23VEH21 HEAVY EQUIPMENT AND TRUCKS IN AN AMOUNT NOT TO EXCEED $43,843.25; RATIFYING THE PAST ADMINISTRATIVELY APPROVED PURCHASE OF A FIRE -RESCUE VEHICLE FROM DUVAL FORD IN THE AMOUNT OF $39,595.40 FOR A TOTAL AGGREGATE EXPENDITURE OF $83,438.65; AUTHORIZING THE CITY MANAGER TO APPROVE NEW PURCHASES FROM DUVAL FORD UP TO A TOTAL OF $65,000.00 IN ACCORDANCE WITH TAMARAC PROCUREMENT CODE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, funds were appropriated in the Adopted Fiscal Year 2024 Budget for the purchase of one (1) new Ford F150 Crew Cab Pick-up for a new Utilities Project Manager Position due, in part, to the realignment of positions within Public Services; and WHEREAS, the timely purchase and replacement of City vehicles and equipment is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase equipment which is the subject of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing Temp. Reso. #14088 February 14, 2024 Page 2 of 5 vehicles and heavy equipment; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic interests to purchase one new Ford F150 Crew Cab Pick-up as identified in Exhibit 1", attached hereto, from Duval Ford through Florida Sheriff Associations Contract Number FSA23-VEL31/FS 23VEH21, incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, on October 12, 2023, the purchase of a budgeted Fire -Rescue Vehicle, in the amount of $39,595.40 was approved administratively; and WHEREAS, per City Ordinance and Procurement Policy, the purchase of the Fire -Rescue Vehicle did not require Commission Approval, as the purchase price did not exceed $65,000.00, however, including this administratively approved purchase of $39,595.40, the cumulative expenditure with Duval Ford is $83,438.65, and therefore requires Commission approval; and WHEREAS, funds for the new vehicle to be assigned to the Utilities Project Manager, in the amount of $44,1000.00 exist in the FY 2024 Adopted Budget in the Utilities Fund; and WHEREAS, it is the recommendation of the Director of Public Services, the Director of Financial Services, and the Purchasing and Contracts Manager that the City Commission ratify paste expenditures with Duval Ford at a cost of $39,595.40 and that the purchase of a Ford F-150 Crew Cab at a cost not to exceed $43,843.25 utilizing Florida Sheriff Associations Contract No. FS23-VEL3 1 /FSA 23VEH21, per the quote attached hereto as "Exhibit 1 ", and to further authorize a cumulative total expenditure of $83,438.65 with Duval Ford; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to ratify past expenditures with Duval Temp. Reso. #14088 February 14, 2024 Page 3 of 5 Ford at a cost of $39,595.40, that the appropriate City Officials be authorized to take the necessary steps to effectuate the purchase of the Ford F-150 Crew Cab, as identified in "Exhibit 1 ", be purchased from Duval Ford through Florida Sheriff Associations Contract No. FS23-VEL31/FSA 23VEH21, at a cost not to exceed $43,843.25, and to further authorize a cumulative total expenditure of $83,438.65 with Duval Ford. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All exhibits referenced and attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac does HEREBY ratify past expenditures with Duval Ford at a cost of $39,595.40, approve and authorize the purchase of a new Ford F150 Crew Cab Pickup to be assigned to the Utilities Project Manager at a price not to exceed $43,843.25; and a copy of pricing proposal is attached hereto as "Exhibit 1 ", for a total aggregate expenditure of $83,438.65. SECTION 3: Funds totaling $44,100.00 under Account Number 425-6020-533.64-05 were allocated in the Fiscal Year 2024 Adopted Budget in the Utilities Fund for the purchase of the new vehicle. Temp. SECTION 5: The City Manager or designee is hereby authorized to approve additional new purchases from Duval Ford up to a total of $65,000.00, in accordance with the Tamarac Procurement Code, during the current Fiscal Year and for succeeding fiscal years for the duration of this agreement. SECTION 6: All resolutions or parts of resolutions in conflict herewith are HEREBY repealed to the extent of such conflict. SECTION 7: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
