RESOLUTION NO. R-2019 -�
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING THE GRANTING
OF A PERPETUAL EASEMENT TO FLORIDA POWER AND
LIGHT FOR THE INSTALLATION OF UNDERGROUND
UTILITY FACILITIES AT THE COLONY WEST CLUBHOUSE
PROJECT LOCATED AT 6800 NW 88T" STREET;
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
EXECUTED SAID PERPETUAL EASEMENT TO FLORIDA
POWER AND LIGHT FOR THE INSTALLATION OF
UNDERGROUND UTILITY FACILITIES AT THE COLONY
WEST CLUBHOUSE PROJECT LOCATED AT 6800 NW
88th STREET; AUTHORIZING AND DIRECTING THE CITY
CLERK TO RECORD SAID AGREEMENT IN THE PUBLIC
RECORDS OF BROWARD COUNTY, PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Colony West Clubhouse Project located at 6800 NW 88th
Street will require the installation of underground utility facilities ; and
WHEREAS, a perpetual easement is required by Florida Power Light for the
installation, maintenance, and operation of necessary underground utility facilities;
and
WHEREAS, the City, as owner of the Colony West Clubhouse Project has
offered a perpetual easement (a copy of which is attached and hereto as "Exhibit
1 ") to Florida Power and Light ; and
WHEREAS, the Director of Public Services recommends that this perpetual
easement be granted to Florida Power and Light; and

WHEREAS, the City Commission of the City of Tamarac, deems it to be in
the best interests of the citizens and residents of the City of Tamarac to approve a
perpetual easement for the installation of underground utility facilities, and to
authorize the appropriate City Officials to execute said perpetual easement for the
installation of underground utility facilities to Florida Power and Light at the Colony
West Clubhouse Project located at 6800 NW 88th Street.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Resolution. All exhibits attached hereto are incorporated herein and made a
specific part of this Resolution.
SECTION 2: The City Commission of the City of Tamarac hereby
authorizes the granting of a perpetual easement to Florida Power and Light for the
installation of underground utility facilities at the Colony West Clubhouse Project
located at 6800 NW 88th Street; and the appropriate City Officials are hereby
authorized to execute said easement.
SECTION 3: The City Clerk is hereby authorized and directed to record
said Agreement in the Public Records of Broward County.
SECTION 4: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or
invalid, in part or application, it shall not affect the validity of the remaining portions
or applications of this Resolution.
SECTION 6: This Resolution shall become effective immediately upon
adoption.

The undersigned, in consideration of the payment of $1.00 and other good
and valuable consideration, the adequacy and receipt of which is hereby
acknowledged, grant and give to Florida Power & Light Company, its affiliates,
licensees, agents, successors, and assigns ("FPL"), a non-exclusive
easement forever for the construction, operation and maintenance of
overhead and underground electric utility facilities (including wires, poles,
guys, cables, conduits and appurtenant equipment) to be installed from time
to time; with the right to reconstruct, improve, add to, enlarge, change the
voltage as well as the size of, and remove such facilities or any of them within
an easement described as follows:

Together with the right to permit any other person, firm, or corporation to attach wires to any facilities hereunder and lay cable
and conduit within the Easement Area and to operate the same for communications purposes- the right of ingress and egress
to the Easement Area at all times; the right to clear the land and keep it cleared of all trees, undergrowth and other obstructions
within the Easement Area; the right to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous trees or
limbs outside of the Easement Area, which might interfere with or fall upon the lines or systems of communications or power
transmission or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights
hereinabove granted on the Easement Area heretofore described, over, along, under and across the roads, streets or highways
adjoining or through said Easement Area.
