R-2019- 30 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA SUPPORTING THE BROWARD COUNTY BOARD OF COUNTY COMMISSIONERS RESOLUTION ADOPTED ON DECEMBER 4, 2018, ATTACHED HERETO AS EXHIBIT "A", SUPPORTING THE FULL FUNDING OF THE SADOWSKI HOUSING TRUST FUND AND SENATE BILL 70 AND ANY COMPANION BILLS FILED DURING THE 2019 REGULAR LEGISLATIVE SESSION TO PREVENT THE DIVERSION OF MONIES THAT SHOULD PROPERLY REMAIN IN THE STATE AND LOCAL GOVERNMENT HOUSNG TRUST FUNDS.; PROVIDING FOR CONFLICTS; PROVIDING SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the William E. Sadowski Act of 1992 provides a dedicated revenue source for the State and Local Government Housing Trust Funds for the production and preservation of affordable housing, including funding for local State Housing Initiatives Partnership Program (SHIP), and WHEREAS, Sadowski Act monies provide funding for the City's First Time Homebuyer and Owner Occupied Minor Home Repair Programs which are funded through the SHIP program, and WHEREAS, the SHIP program provides funds to local governments as an incentive to create partnerships that produce and preserve affordable homeownership and housing for very low, low, and moderate -income families; and WHEREAS, the City of Tamarac's projected SHIP allocation for 2019-2020 is $777,147 if funds are fully appropriated to the Sadowski Trust Funds, and Temp Reso #13266 April 18, 2019 Page 2 WHEREAS, these funds would further the provision of affordable housing by assisting the over 300 families on the City's waiting list by providing decent and affordable housing; and WHEREAS, by supporting the Broward County December 4, 2018 Resolution, (hereby attached as Exhibit A), the City agrees that it is imperative that the Legislature appropriate all funds in the State and Local Government Housing Trust Funds for their intended purpose — affordable housing; and WHEREAS, approval and support of the Broward County December 4, 2018 Affordable Housing Support Resolution is necessary to influence and urge the Florida House Leadership to reconsider their position and fully appropriate the Sadowski Trust Funds solely for Florida's housing programs; and WHEREAS, it is the recommendation of the Community Development Director that Tamarac support the Broward County December 4, 2018 Resolution of Support of the Sadowski Trust Funds; and WHEREAS, the City Commission of the City of Tamarac, Florida deems that the support of the Broward County Resolution is in the best interest of the health, safety, and welfare of the City, its residents, citizens and visitors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: 1 Temp Reso #13266 April 18, 2019 Page 3 SECTION 1: That the foregoing 'WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits referenced herein are incorporated and made a specific part of this Resolution. SECTION 2: That the City Commission of the City of Tamarac does hereby approve and support the Broward County December 4, 2018 Resolution of Support of the Sadowski Trust Funds (Exhibit A) and urge the Legislature to appropriate all funds in the State and Local Government Housing Trust Funds for their intended purpose — affordable housing. SECTION 3: That the City Commission of the City of Tamarac hereby directs the City Manager to transmit a certified copy of this resolution to the Governor, Senate President, Appropriation Chair, House Speaker and Appropriation Chair Representative. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: All If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. (Sponsored by Commissioner Nan H. Rich) WHEREAS, the William E. Sadowski Act of 1992 provides a dedicated revenue source for the State and Local Government Housing Trust Funds for the production and preservation of affordable housing, including funding for the local State Housing Initiatives Partnership Program (SHIP); WHEREAS, Sadowski Act monies provide funding for the County's SHIP program; WHEREAS, the SHIP program provides funds to local governments as an incentive to create partnerships that produce and preserve affordable homeownership and multifamily housing for very low, low, and moderate income families; WHEREAS, Broward County has a substantial affordable housing need and is one of the most cost -burdened markets in the nation for affordable housing; WHEREAS, a diversity of housing options along income ranges is an essential component of economic development and new job creation; WHEREAS, affordable housing is housing that is affordable to our workforce, seniors, individuals with special needs, veterans, youth aging out of foster care, and homeless individuals; 1 WHEREAS, there are over 84,000 renters in Broward County with incomes at or 2 below 60 percent of average medium income who are cost -burdened and paying 30 3 percent or more of their income for housing; 4 WHEREAS, in FY18, Broward County contributed $33,978,783 to the State and 5 Local Government Housing Trust Funds pursuant to the Sadowski Act through the 6 documentary stamp tax on real estate transactions, but was only reallocated $2,457,924 7 in SHIP funding to use towards affordable housing; 8 WHEREAS, Broward County budgeted a total of $10,000,000 in local funding in 9 FY18 and FY19 for the development of approximately 395 affordable units, made land 10 valued at $5,000,000 available and priced at below market cost for the development of 11 150 mixed use units in downtown Fort Lauderdale, and conveyed free of charge 40 lots 12 to nonprofit affordable housing developers to construct new single family homes, 13 demonstrating the Broward County's commitment to address this problem; 14 WHEREAS, excess documentary stamp dollars placed in the State and Local 15 Government Housing Trust Funds have historically been swept, fully or in part, and 16 used to balance the state budget; 17 WHEREAS, it is projected that during FY18-19, the documentary stamp tax will 18 generate over $314 million for the State and Local Government Housing Trust Funds; 19 WHEREAS, the full appropriation of the State and Local Government Housing 20 Trust Funds would create approximately 30,000 jobs and $4 billion of positive economic 21 benefit for Florida; and 22 WHEREAS, it is imperative that the Legislature appropriate all funds in the State 23 and Local Government Housing Trust Funds for their intended purpose —affordable 24 housing, NOW, THEREFORE, 2 1 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF 2 BROWARD COUNTY, FLORIDA: 3 4 Section 1. The Board supports Senate Bill 70, State Funds, filed by Senator 5 Kathleen Passidomo, and any companion bills filed in connection with the 2019 regular 6 legislative session to prevent raiding of the State and Local Government Housing Trust 7 Funds. 8 Section 2. The Board supports appropriating all monies in the State and Local 9 Government Housing Trust Funds solely for Florida's affordable housing programs. 10 Section 3. The Board directs the County Administrator to transmit a certified 11 copy of this resolution to the Governor, Senate President, House Speaker, and the 12 Chair and all members of the Broward County Legislative Delegation. 13 Section 4. The Board directs the County's state lobbyists to advocate for the 14 passage of the legislation set forth in Section 1 above and authorizes and directs the 15 Intergovernmental Affairs/Boards Section to include this item in its future legislative 16 priorities packages. 17 Section 5. Severability. 18 If any portion of this Resolution is determined by any court to be invalid, the 19 invalid portion will be stricken, and such striking will not affect the validity of the 20 remainder of this Resolution.
