ORDINANCE NO. 65 -- 1
AN ORDINANCE REQUIRING THAT ALL PERSONS ENGAGING
IN OR MANAGING A BUSINESS IN ".CITE CITY SHALL HAVE A
CITY OCCUPATIONAL LICENSE; PROVIDING FOR IIALF-YEAR
LICENSES; PROVIDING FOR TRANSFER OF LICENSES IN
CERTAIN CASES; PROVIDING PENALTIES FOR DELINQUENT
PAYMENT OF LICENSE FEES; .PROVIDING FOR THE APPOINT-
MENT OF A LICENSE INSPECTOR; PROVIDING FOR THE
AMOUNT OF LICENSE FEES DUE; PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION.I. Required; application.
Every person engaging in or managing any business in the
city required to have a license shall, on or before April first
of each year, and always before engaging in any business, profession
- or occupation, make application for a license and register in a
book on file, to be kept for that purpose by the city tax collector,.
his name, profession or occupation and the location of the proposed
place of business. Such application shall be made by the individual,
one of the partners, or an officer of the corporation, as the case
may be. No person shall engage in or manage or be in charge of any
business, profession or occupation until a city occupational license
for the current year has been obtained for such business, profession
or occupation, and the proper occupational license tax paid therefor.
SECTION 2. Expiration date; half year licenses.
All licenses issued under this chapter shall expire on the
thirty-first day of March of each year. No license shall be issued
for more than one year. For each license obtained between April
first and October first, the full tax for one year shall be paid,
except as herein otherwise provided, and for each license obtained
from October first to March thirty-first one-half the full tax for
one year shall be paid, except as herein otherwise provided.
SECTION 3. Transfer or occupational licenses.
Any license, which is transferable, shall, be transferable
with the approval of the tax collector. Before such license shall
be considered as transferred, the holder of the license shall endorse
,a proper transfer on the back of the occupational license showing
the exact, correct name of the person to whom such license is
transferred, and the correct address at which such license shall be
used. Such transfer shall be signed by the person in whose name or
names such license is issued if the registered holder is an individual
or individuals, or by a member of the partnership if the registered
holder is a partnership, or by the president or vice-president
if the registered holder is a corporation. Evidence of a bona fide
sale must be produced before the tax collector within 10 days after
such sale, and the license, properly transferred, must likewise be
produced before the tax collector for endorsement. The tax collector

No person claiming to be transferee of a license shall engage in bus-
iness under such license until such transfer has been duly registered
and recognized by the city tax collector.
SECTION 4. Definitions.
For the purpose of this Ordinance the following words shall
have the following meaning, to -wit:
(1) "Person" shall mean any person, firm, corporation,
association, partnership, executor, administrator,
trustee, or other legal entity, singular or plural., as
the context requires.
(2) "Merchandise" shall mean any goods, wares or commod-
ities bought or sold in the usual course of trade or
business.
(3) "Merchant" shall mean any person engaged in the
business of selling merchandise at retail or wholesale.
(4) "Retail merchant" shall mean any merchant who sells
to the consumer, or for any purpose other than resale.

(5) "Wholesale merchant" shall mean any merchant who
sells to another for the purpose of resale.
(6) "Sale" shall mean the transfer of ownership, title or
possession, whether conditional or otherwise for a
consideration.
(7) "Employee" shall mean, all persons directly connected
with the business (owner or operator).
(8) "Person in charge" shall mean the person in the place.
of business at any time who is charged with the duty
of supervising, operating or managing such business at
such time.
SECTION 5. Display of License.
Every person having a license shall exhibit same when called
upon to do so by an authorized officer of the city, and all licenses
must be conspicuously displayed at all times.

SECTION 6. Evidence .�—_..��_
The fact that any person represented himself as being en-
gaged in any business, occupation or profession for which a license
is required for the transaction of business or the practice of ;such
profession, shall be evidence of the .liability of such person to
obtain a license, regardless of whether such a person actually trans-
acts any business or practices a profession. Displaying a sign or
advertisement indicating the conduct of a business or profession at
a given location, advertising a business or profession in the class-
ified section of the telephone directory or city directory or other
media shall be evidence that such person is holding himself out to
the public as being engaged in a business or profession.
SECTION 7. Separate licenses required for each business; duration
of license.
Whenever an occupational license is levied against any pro-
fession, trade, shop or business, classified in section.22 hereof,
such occupational tax shall be required to be paid to carry on such
business, whether it be connected or operated in conjunction with
any other business, or not, unless the contrary intention appears.

The occupational licenses levied against any trade, :shop or
business described in section 22 hereof shall be paid by each pcx.�on
engaged in such trade, running or operating such shop or business,
unless the contrary intention appears.
The occupational licenses levied against the various proy-
fessions, trades and businesses described in section 22 hereof
shall be for a yearly privilege, unless the contrary intention appear;.
SII.,CTI"ON 8. Rcbal;es of fees.
No portion of any occupational license tax herein assessed
shall be rebated, unless it clearly appears that such license tax
was collected by mistake or error, and before making such rebate to
a licensee, all amounts payable under a proper license shall be
paid by such licensee.
SECTION 9. Merchants to pay merchants' tax unless specificall
classified.
Any person engaged in selling goods, wares and merchandise,
which is specially classified, shall pay the specially classified
occupational license tax, and not the merchants' occupational
license tax; but any person not specially licensed, and engaged in
such business, shall pay the merchants' occupational license tax.
SECTION 10. Payment of tax not to authorize commission of offense.
The payment of a license under this Ordinance shall not
authorize or legalize in any manner whatsoever the commission of any
offense or crime against the city, the county, the state, or the
United States of America.
SECTION 10.01. Notto conduct business in violation of zonin
,regulations.
Each applicant for an occupational license shall, definitely
state and set out the exact location at which such business shall be
operated. Each applicant for a professional license shall state
whether he intends to practice his business at a definite business
location or not, and if he intends to maintain a place of business
for the practice of such business, he shall definitely state and set
out the exact location of such place of business. Before issuing a
license it shall be the duty of the building inspector to check the

zoning applicable to such listed place of business, and if the
applicable zoning regulations do not permit the practice of such
profession o r the conduct of business at such intended business
location and the building inspector shall so certify, the tax
collector shall refuse to issue a license for a business location
in a prohibited zone, unless the applicant can show a "vested right
for nonconforming use" or board of adjustment variance permit; and
in such instances the particular exception must be endorsed upon
the license. Where a professional license is issued for general use,
and the applicant maintains no particular place of business, such
license shall be marked "No business address - general use."
SECTION 11. Tax on interstate business imposed upon business done
within state only.
The tax imposed by this chapter on persons engaged in inter-
state commerce, is imposed upon the business actually done by any
such person within the city and to and from points within the state,
and is not imposed upon any business done for the United States
Government or upon interstate business.
. SECTION 12. Disposition of funds.
All revenue derived from license taxes hereby imposed shall
be paid into the general fund of the city.
SECTION 13. Making false affidavits to procure license.
It shall be unlawful for any person wilfully to make any
false written affidavit for the purpose of procuring a license for
a less sum than is lawfully payable by the affiant, or his principal,
and any such license so obtained shall be void.
SECTION 14. Penalty for delin uent payment.
A penalty of five percent of the license tax imposed by the
provisions of this chapter is hereby assessed in the event the same
is not paid within thirty days from the date the same shall become
due and payable, and a penalty of ten percent of the license tax
imposed by the provisions of this chapter is hereby assessed in the
event the same is not paid within thirty-one days from the date the
same shall become due and payable. The penalties hereby imposed
shall be collected in addition to the amount of the license tax,
and the payment of such penalty shall not be pleaded in bar in any

proceedings charging the offense of doing business without a
license under this ordinance.
SECTION 15. Appointment of license inspector, assistants; ditties.
It is hereby made the duty of the city clerk to appoint a
license inspector of the city, and such part time or full time
assistants as he may deem necessary. Every place of business in
the city shall be inspected at least twice a year to see that the
proper license has been obtained for the conduct of all business
operated upon the premises. Such license inspector or assistant
shall have the authority to investigate al'l-businesses, occupations,
and professions in the city, and to make such inquiry as shall be
necessary to determine whether or not a license has been procured
for such business or occupation, and shall report to the city tax
collector the names of all persons engaged in business without a
license. Such license inspector shall have the power to make
arrest of any persons violating this ordinance and any person
refusing said license inspector permission to investigate and
inquire for the purpose of determining whether such person has
such license, shall, upon conviction, be fined or imprisoned as
provided in section 22 of this ordinance.
SECTION 16.. Duty of officers of corporations.
It shall be the duty of all officers, agents or persons in
charge of the place of business of any corporation to see that such
corporation complies with the provisions of this chapter. All
officers or agents of any corporation required by this chapter to
be licensed, which shall do business without having paid the license
tax imposed and procured such license, shall be subject to the
penalties imposed by this ordinance upon persons violating this
ordinance.
SECTION 17. Trucks to display name of business.
Any and all trucks or motor driven vehicles operated or
used in connection with any business, oc..-,,)ation or profession in
the city shall have painted upon a prominent place upon such truck
or motor driven vehicle the name and address of the business in
which such truck or motor driven vehicle is used.
SECTION 18. Licenses subject to ordinance.
40 No license shall be issued or granted to any applicant to

engage in the business of selling or disposing of merchandise of
any kind, at retail or wholesale, or the practice or pursuit of
any profession or occupation in the: city, except upon the terms and
conditions and subject to the provisions of this ordinance.
SECTION 19 Unclassified occupations.
Every business, occupation, profession, or exhibition,
substantial, fixed or temporary, engaged in by any person, whether
in a building, tent, or upon the street, vacant lot or anywhere: in
the open air, within the city and not specifically classified in
this ordinance, shall pay a license fee of fifty dollars.
SECTION 20. Penalty.
Any person, and any and all members, agents, or persons in
charge of the place of business of any firm or corporation that
shall carry on, conduct or manage any business or profession, or
who shall keep and use, upon the streets of the city any vehicle
for which a license is required, without first having obtained a
license, or who shall fail to display or exhibit such license as
provided in this ordinance or otherwise violate this ordinance shall,
upon conviction, be punished as provided in section 22 of this
ordinance. The conviction and punishment of any persons for trans-
acting any business without a license shall not excuse or exempt
such person from the payment of any license due or unpaid at the
time of such conviction.
SECTION 21. Amount of tax to be paid.
Licenses shall be issued to cover only one location, and only
one of the occupations of business classifications hereinafter set
out, unless permitted hereunder. The amounts assessed as license
taxes against the various trades, businesses and professions are hereby
fixed as follows:
(1) ALCOHOLIC BEVERGAGES.

For the purpose of this subsection insurance

semi-annual, or quarterly premium paying basis,
and (B) bonds, including fidelity, court, con-
tract and surety bonds and financial guarantee,

bonds and securities, safe burglary and hold-up
and messenger robbery. (D) liability insurance,
including employers, public and other forms of
liability insurance and automobile liability for
personal injury, property damage and collision,

ective insurance issued to employers of labor.
2. FIRE INSURANCE COMPANIES, writing policies of
insurance against hazards of fire, tornado, and
windstorms, use and occupancy, profits, rents,
lease hold, insurrection, riot and civil comm-
otion, sprikler leakage, rain, fire, theft,

SECTION 22. Same -- Penalties.
. Whoever violates this ordinance (sections )
shall .be fined not more than twenty-five dollars
($25.00) or imprisoned for not more than ten (10) days,
or both. Any such violation shall constitute a separate
offense on each successive day continued.
SECTION 23. Effective Date.
This ordinance shall become in full force and effect on the
first day of July, 1965 and all persons in the City shall be required
to obtain licenses with respect to their business, profession or
occupation on or before said date and to pay the license fee herein
required, said fee to be prorated as provided by Section 2 hereof.
