AN ORDINANCE REPEALING ORDINANCE NO. 64-3; REPEALING
ORDINANCE NO. 70--39 ; PROVIDING FOR WATER AND SEWER
RATES FOR RESIDENTIAL CONSUMERS PURCHASING WATER AND
SEWER SERVICES THROUGH THE CITY; PROVIDING AN r,FFECTIVE
DATE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING A SAVINGS CLAUSE.
WHEREAS, the previously existing water rates charged to
individual residential consumers by the City as reimbursement to the
City for their share of the total bulk water charges made by
suppliers of water to the City has been insufficient to fully cover
the actual costs of water, and
WHEREAS, the City Council has studied this situation and has re-
ceived various recommendations and is now desirous of setting new
costs for water and a new procedure for implementation, and
WHE REAL, the City Council is now desirous of setting charges
for sewer services provided to the consumer through the City of
Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
City of Tamarac, Florida:
SECTION 1: Ordinance Nos. 64-3 and 70-39 are hereby specifical-
ly repealed in their entirety.
SECTION 2: For purposes of determining the monthly charge for
water to consumers purchasing through the City on an unmetered basis,
the City shall be divided into two (2) areas based upon the two sup-
pliers of water to the City of Tamarac. The two (2) areas are those
serviced by Tamarac Utilities, Inc., and the City of Fort Lauderdale.
SECTION 3: The charge for water to the residential consumer in
the areas supplied by the City of Ft. Lauderdale shall be determined
for each home on a monthly basis. First by dividing this area into
two (2) sub -areas pursuant to those homes served by each of the two
master meters metering waters supplied to this area. The total
water bill for each of the master meters in this area shall be divi-
ded by the total number of residential consumers in establishing a
per home cost. To said cost a charge for administration in the amount
of twenty-five cents ($.25) per home shall be added.
. SECTION 4: For those consumers in the area serviced by
Tamarac Utilities the charge per home on a monthly basis for
domestic water shall be determined by establishing a net usage
of domestic water cost and thereafter dividing same by the total
number of residential consumers and adding thereto an administrative
cost of twenty-five cents
($.25)
per month

Shall be
determined as follows:
(a) the total dollar charge or cost of water for the entire area
serviced by Tamarac Utilities; (b) substract therefrom construc-
tion water charges; (c) also subtract therefrom total irrigation
water charges.
Construction water charges shall be determined by multiplying
$3.75 times the total number of units under construction.
Total irrigation water charges shall be determined by multi-
plying $.45 per 1,000 gallons of total irrigation water.
Total irrigation water shall be determined by determining the
average per home gallonage for .irrigation water for each monthly
period in Sections 8 and 9 of the Mainlands and thereafter multiply-
ing said average monthly per home figure by the total number of
residential consumers within the area served using domestic water
to supply their irrigation or sprinkler system. Those consumers
using domestic water for irrigation purposes shall include resi-
dences in Sections 5, 6, 7, 8 and 9 of the Mainlands and all
Sections of the Woodlands.
SECTION 5: Each consumer using domestic water for irrigation
purposes shall pay $.45 per 1,000 gallons of irrigation water as
determined for average consumer irrigation water as hereinabove re-
ferred to.
If the consumer of irrigation water is also purchasing water
for domestic purposes through the City of Tamarac then the afore-
mentioned irrigation charge shall be in addition to the charges for
domestic water. If the consumer is not purchasing domestic water
through the City of Tamarac and only purchasing irrigation water
through the City of Tamarac, then he shall pay the aforementioned
sum of $.45 per 1,000 gallons per month plus $..25 administration
costs per month.

The irrigation water charges shall only apply so long as the
individual Section purchases its irrigation water through the City
of Tamarac and not directly from Tamarac Utilities, Inc. Further,
in no case, shall the irrigation water charges apply to consumers
whose sprinkler systems are served by water from canals or other
waterways and not domestic water.
SECTION 6: This ordinance shall not be effective for domestic
water charges as to consumers who are presently metered and shall
become ineffective as to each consumer that is hereinafter metered
at the time of such metering.
SECTION 7: Notwithstanding any other formula or computation
as hereinabove outlined or any Section of this Ordinance there shall
remain and be in effect a minimum charge of $3.75 per consumer for
domestic water.
SECTION 8: For all areas in the City of Tamarac wherein con-
struction water is purchased on an unmetered basis through the City
of Tamarac, there shall be a $3.75 per structure charge per month
plus a $.25 per month charge for the cost of administration. Said
charge shall apply whether the structure is under construction for
a total monthly period or any part of a month. Said construction
period shall begin when construction begins and shall terminate upon
the issuance of the certificate of occupancy. After the issuance of
the certificate of occupancy, said structure shall be charged for
water as hereinabove provided for other consumers.
SECTION 9: Sewer charges for consumers receiving water in the
areas serviced by Tamarac Utilities, Inc., shall be pursuant to the
following rates:
(a) For residential Unit containing 1 bath - $3.50 per month
(b) For residential Unit containing 2 baths- $4.50 per month
(c) For residential Unit containing 3 baths -$5.50 per month
(d) For residential Unit containing 4 baths -$6.50 per month
(e) For residential Unit containing 5 baths -$7.50 per month
Sewer charges as herein outlined shall only apply so long as
the individual user of said services is being billed and purchasing
said services through the City of Tamarac and not directly from
Tamarac Utilities, Inc.

SECTION 10: This Ordinance and the procedure and rates out-
lined herein shall become effective on the 1st day of February,
1971.
SECTION 11: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 12: Should any section or provision of this ordinance
or any portion hereof, or any paragraph, sentence or word be declared
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole or
any part hereof, other than the part declared to be invalid.
