AN ORDINANCE REQUIRING THE INSTALLATION OF WATER
METERS FOR ALL NON-RESIDENTIAL CONSUMERS PUR-
CHASING WATER THROUGH THE CITY IN THE AREA SUP-
PLIED BY THE CITY OF FORT LAUDERDALE; REQUIRING
FOR THE PAYMENT FOR SUCH INSTALLATIONS; PROVID-
ING FOR WATER DEPOSITS; PROVIDING FOR WATER
AND SEWER RATES FOR COMMERCIAL USERS IN THE
AREAS SERVED BY THE CITY OF TAMARAC AND SUPPLIED
BY THE CITY OF FORT LAUDERDALE; PROVIDING AN
EFFECTIVE DATE; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; PROVIDING A SAVINGS CLAUSE.
WHEREAS, it has come to the attention of the Council of the
City of Tamarac that all non-residential consumers within the area
supplied water by the City of Fort Lauderdale are not being served
through individual meters, and
WHEREAS, the City Council is now desirous of requiring that
all non-residential users within the aforementioned area be served
through individual water meters, and
WHEREAS, the City Council is now desirous of requiring that
the consumer pay the cost of the meter and the cost of installation
of same, and
WHEREAS, the City Council is now desirous of setting a water
deposit for non-residential consumers, and
WHEREAS, the City Council is now desirous of setting the rates
for water for non-residential consumers in the area supplied by
the City of Fort Lauderdale, and
WHEREAS, the City Council is now desirous of reaffirming and
resetting the cost for sewer services in the areas served by the
City of Tamarac, Florida:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
City of Tamarac, Florida: ►"?"
SECTION 1: That each and every non-residential consumer noW'
existing within the area of the City of Tamarac wherein water is
supplied by the City of Fort Lauderdale shall within 30 days from
the passage hereof install or have installed a water meter or water
meters sufficient and adequate to meter water for each individual
consumer.
All new non-residential consumers within the aforementioned
area after the effective date of this ordinance shall prior to being
served with water install or have installed water meters adequate to
serve the individual requirements.
SECTION 2: Existing non-residential consumers shall install
meters within the required period of time only after having received
a permit, for which there will be no charge, from the Building Depart-
ment of the City of Tamarac authorizing such installation.
In the event any of the existing non-residential consumers
shall fail within the required period of time to install a meter or
meters, then and in that event, the City of Tamarac may cause to
be installed a meter or meters and charge to the consumer the cost
of such meter or meters and the cost of installation thereof. If
in the event it is necessary for the City of Tamarac to take such
action this shall be considered as a special assessment against
the individual consumer.
SECTION 3: Thirty (30) days after the effective date of this
ordinance no non-residential consumer shall be served through the
City of Tamarac any water unless said water shall be served through
an individual meter for each individual consumer.
SECTION 4:_ Any meters installed as required hereunder shall
be installed only after a permit has been issued by the Building
Department of the City of Tamarac and shall meet all requirements
as required by the Building Department of the City of Tamarac.
SECTION 5: Each non-residential consumer at the time of
obtaining metered service shall place with the City of Tamarac:& „"
deposit, pursuant to the schedule indicated upon Exhibit A attached';"
hereto and made a part hereof, to act as security for payment
of bills and said deposit shall be refundable upon the termination
of water service and the full payment of all outstanding bills.

SECTION 5: Water rates for individual non-residential
consumers shall be in those amounts on a gallonage basis per
month as indicated upon Exhibit B attached hereto and made
a part hereof.
SECTION 7: Sewer charges for commercial service within
the area served by the City of Tamarac shall be that amount as
indicated for same within Ordinance No. 70-40. Said ordinance
specifies.that the monthly charge for sewer service for commer-
cial accounts shall be equal to 100% of that month's water bill
but in no event shall it be less than $8.72 per month.
SECTION 8: This ordinance and the procedure and rates
outlined herein shall become effective on the Is. day of June,
1971.
SECTION 9: All ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 10: Should any section or provision of this
ordinance or any portion hereof or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
