HomeMy WebLinkAboutCity of Tamarac Ordinance O-1971-017CITY OF TAMARAC, FLORIDA ORDINANCE NO.1 AN ORDINANCE REQUIRING THAT ALL APPLICATIONS FOR BUILDING PERMITS OTHER THAN THOSE FOR SINGLE FAMILY RESIDENCE BE REFERRED TO THE PLANNING AND ZONING BOARD FOR APPROVAL; ESTABLISHING CRITERIA FOR APPROVAL OR DISAPPROVAL; PROVIDING FOR APU2MMENT AND APPEAL; REPEALING ALL ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CIAUSE. WHEREAS, the Planning and Zoning Board of the City of Tamarac, Florida, has reccnuended that the City require that all applications for building permits other than those for a single family residence be referred to that Board for approval, and, WHEREAS, the City of Tamarac does not have a planning department or official in its employ, and, WHEREAS, the Council deems it important to the public health, safety and welfare that building plans be checked to determine compliance with zoning regulations including set -backs, easements for public utilities and availability of streets, water and sewer lines and compliance with and sub -division and land development codes which may be applicable; now therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: All applications for building permits for struc- tures other than single family residences shall be referred by the building official to the planning and zoning board for the pur- poses herein stated. SECTION 2: The Planning and Zoning Board shall examine such application to determine whether the property involved is: A. Zoned for the purpose for which the permit is re- quested; B. Serviced by streets or roads meeting the requirements s of City Ordinance; C. Serviced by adequate water and sewer mains; D. In compliance with set -back requirements, minimum lot area, minimum structure size and other criteria contained in the zoning laws of the City; I fn conformity with any subdivision or land develo�ment ordinance of the City and apy comprehensive.plan which may have been adopted. SECTION 3: Should the application be rejected the applicant shall be promptly notified of the reasons for the rejection and be given the opportunity to amend his application to correct the defect or defects noted. SECTION 4: That the application shall be acted upon within 14 days of its receipt by the building department and should the Planning and zoning Board for any reason fail to act within such time, the building official shall forthwith make the deter- minations called for by this ordinance. SECTION 5: That the applicant shall have the right to appeal the decision of the Planning and Zoning Board to the Council should he believe that they have acted arbitrarily and without authority, but if a variance from the zoning ordinances is necessary the applicant shall be required to apply to the Board of Adjustment. SECTION 6: This ordinance shall take effect immediately upon its adoption as to all applications for building permits filed subsequent to its adoption. SECTION 7: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence of word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 8: All ordinances or parts of ordinances in -2- conflict herewith be and the same are hereby repealed.
