CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE PROHIBITING THE ISSUANCE OF A
BUILDING PERMIT UNLESS THE PROPERTY INVOLVED
IS SERVED BY ABUTTING STREETS, WATER AND SEWER
MAINS MEETING CERTAIN SPECIFICATIONS; PROVIDING
FOR THE POSTING OF BOND IN THE .ABSENCE OF SUCH
FACILITIES; PROVIDING EXCLUSIVE VARIANCE
JURISDICTION IN THE CITY COUNCIL; REPEALING
ALL ORDINANCES IN CONFLICT; AND PROVIDING A
SAVINGS CLAUSE.
WHEREAS, the Planning and Zoning Board of the City of Tamarac,
Florida, has recommended that building permits not be granted unless
provision has been made for public streets and for water and sewer
services for the structure to be erected; and the City Council
has examined and considered the recommendation and deems it necess-
ary to the public health, safety and welfare that such facilities
be provided for; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: No building permit shall be issued by the City
of Tamarac until it has been determined that the building or
structure to be erected abuts a dedicated public paved street or
road meeting City, County, State or Federal specifications.
SECTION 2: No building permit shall be issued by the City
of Tamarac until it has been determined that the building or struct-
ure to be erected is to be served by existing water and sewer
mains abutting the property and that such mains are of sufficient
capacity to carry the increased load arising from such proposed
contruction.
SECTION 3: In the event that street construction or water
and sewer main installation are necessary to service the property,
an application for building permit may be made to the City Council
accompanied by certified engineering plans for street and/or
sanitation facilities and by a bond for not less than 125% of the

estimated costs of such public improvements.
SECTION 4: variances from the requirements of this ordinance,
if any, shall not be considered by the Board of Adjustment, but
shall be within the exclusive authority of the City Council upon
relation of the Planning and Zoning Board.
SECTION 5: This ordinance shall take effect i=medi.ately
upon its adoption as to all applications for building permits filed
subsequent to its adoption.
SECTION 6: Should any section or provision of this ordinance
or any portion thereof, or any paragraph, sentence or ward be
declared by a court of campetent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be
invalid.
SECTION 7: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed,
