AN ORDINANCE REQUIRING THE OCCUPANTS OF HOMES
AND BUSINESSES IN THE CITY OF TAMARAC TO USE
THE SERVICES OF A FRANCHISED GARBAGE COIIECTOR;
FORBIDDING THE USE BY OCCUPANTS OF PROPERTY OF
THE GARBAGE DISPOSAL FACILITIES OF ANOTHER;
PROVIDE A SAVINGS CLAUSE; REPEALING ALL
ORDINANCES IN CONFLICT; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Council of the City of Tamarac deems it essential
to the health and welfare of the residents of the City that
garbage and trash be disposed of in a safe and sanitary manner,

WHEREAS, it appears that there have been frequent instances of
dangerous, unsightly and illegal dumping of garbage and trash
both within and without the municipal limits, and
I%M� EAS, there have been numerous instances of "doubling-
up°1 on garbage service thus defrauding the franchised collector
of compensation for his services,
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, TAMARAC, FLORIDA:
SECTION 1. That each occupant of residential and non-residential
property within the City of Tamarac shall arrange for the collection
and disposal of his or her garbage and trash through the use of a
franchised collector. Such services may be suspended during periods
when the premises is not occupied for one or more months.
SECTION 2: Occupants of non-residential property may provide for
the collection of garbage and/or trash through a licensed but
non -franchised collector.
SECTION 3: It shall be unlawful for any individual firm
or corporation to use the disposal facilities of another person,
firm or corporation in order to avoid the payment of collection
fees to a franchised and/or licensed collector.
SECTION 4: Any person who shall violate any of the terms and
provisions of this Ordinance shall, upon conviction, by the judge
of municipal court, be subject to a fine not exceeding two hundred
fifty dollars or by imprisonment not to exceed thirty days or

by both such fine and imprisonment within the discretion of the
judge.
SECTION 5: Should any section or provision of this Ordinance
or any portion thereof, or any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be
invalid.
SECTION 6: All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 7: Effective date of this Ordinance shall be September
1,1971.
