ORDINANCE NO. �� M
AN ORDINANCE ESTABLISHING THE CLOSING HOURS FOR
SALE, SERVICE AND DISTRIBUTION OF ALCOHOLIC
BEVERAGES BOTH ON AND OFF PREMISES; PROVIDING
PENALTIES FOR VIOLATION; REPEALING ORDINANCES
IN CONFLICT; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING'AN EFFECT11 DATE.'
WHEREAS, the City has no ordinance regulating the hour sale
of alcoholic beverages within the City, and /
WHEREAS, the City Council deems it to be inZthbe interest
of the health, safety and welfare of the inhabiregulate
the hours of sale of alcoholic beverages within City, and
WHEREAS, Section 562.14 (3) FLORIDA .9TA and Section 11 d
of the City Charter authorize the City to �ulate the hours of
sale of alcoholic beverages within the City,
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:

SECTION 1: No person, vendo distributor who holds a liquor
license or a beer and wane ., is the agent of such person,
shall sell or offer for sale deli er or serve or permit to be
consumed upon the premises or
such.person, vendor, or distributor,
any liquor, beer or wi ardless of the amount of the alcoholic
contefit, any day tween the hours of 2:00 A. M. and 8:00 A. M.
SECTI 2: rson, vendor or distributor who holds a
J'liquo�, ce a beer and wine license, or is the agent of such
perso , sh 1 sell or offer for sale or deliver any liquor, beer
or wine by package, bottle or container, on any day between the
hours of 2:00 A. M. and 8:00 A. M.
SECTION 3: Any person who shall violate any term or provision
of this ordinance shall, upon conviction, be subject to a fine
not exceeding two hundred fifty dollars or by imprisonment not
exceeding sixty days, or both such fine and imprisonment in the
discretion of the Municipal Judge. Each day of violation of any
tem or provision of this ordinance shall constitute a separate
and distinct offense.

SECTION 4: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 5: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be de-
clared by a Court of competent jurisdiction to be inlaid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof other than the part declared to be in-
valid.
SECTION 6: This ordinance becomes effective imTediately
upon its final passage.
