HomeMy WebLinkAboutCity of Tamarac Ordinance O-1971-035CITY OF TAMARAC, FLORIDA ORDINANCE NO. - AN ORDINANCE ESTABLISHING THE CLOSING HOURS FOR r SALE, SERVICE AND DISTRIBUTION OF ALCOHOLIC BEVERAGES BOTH ON AND OFF PREMISES; PROVIDING PENALTIES FOR VIOLATION; REPEALING ORDINANCES IN CONFLICT; CONTAINING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City has no ordinance regulating the hours of sale of alcoholic beverages within the City, and WHEREAS, the City Council deems it to be in the best interest of the health, safety and welfare of the inhabitants to regulate the hours of sale of alcoholic beverages within the City, and WHEREAS, Section 562.14 (3) FLORIDA STATUTES and Section 11 d of the City Charter authorize the City to regulate the hours of sale of alcoholic beverages within the City, NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: No person, vendor or distributor who holds a liquor license or a beer and wane license, or is the agent of such person, shall sell or offer for sale or deliver or serve or permit to be consumed upon the premises or such person, vendor, or distributor, and liquor, beer or wine regardless of the amount of the alcoholic content, on any day between the hours of 2:00 A.M. and 8:00 A.M. SECTION 2: No person, vendor or distributor who holds a liquor license or a, beer and wine license, or is the agent of such person, shall sell or offer for sale or deliver any liquor, beer or wine by package, bottle or container, on any day between the hours of 2:00 A.M. and 8:00 A.M. SECTION 3: Any person who shall violate any term or provision of this ordinance shall, upon conviction, be subject to a fine not exceeding two hundred fifty dollars or by imprisonment not exceeding sixty days, or by both such fine and imprisonment in the discreation of the Municipal Judge. Each day of violation of any term or provision of this ordinance shall constitute a separate and distinct offense. I I 0A SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word by de- clared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
