HomeMy WebLinkAboutCity of Tamarac Ordinance O-1972-001CITY OF TAMARAC2 FLORIDA ORDINANCE NO.=,�- AN EMERGENCY ORDINANCE PROVIDING FOR EX- TENDING THE DATE FOR SUSPENSION OF ISSUANCE OF ALL BUILDING PERMITS IN THE CITY OF TAMARAC EXCEPT FOR PERMITS FOR SINGLE FAM- ILY DWELLINGS AND PROVIDING FOR RELIEF IN CERTAIN CASES? PROVIDING AN EFFECTIVE DATE1 PROVIDING A SAVINGS CLAUSE AND REPEALING ALL ORDINANCES IN CONFLICT2 AND FOR OTHER PURPOSES. WHEREAS, the City Council has heretofore by Ordinance No. 71-30 of the City of Tamarac instituted a moratorium on the issuance of building permits for other than single- family residences and WHEREAS, the City Council believes it necessary to ex- tend the effective date of the moratorium for a short period in order to receive reports from the zoning Commission and to enact recommended Ordinances; and WHEREAS, the Council finds that an emergency exists. NOW2 THEREFORE2 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION l: No city official or employee shall cause, allow or permit a building permit to be issued from the City of Tamarac which will authorize the construction, erection or alteration of any structure other than one intended, de- signed and to be used as a single family detached. dwelling or one owned by the City of Tainarac. SECTION 2: Upon the showing of a special hardship the City Council of the City of Tamarac u-pon written application made may grant an exception to the prohibition imposed by this ordinance if the said Council shall determine that said special exception shall not be harmful to the peace, property, r 4• health or safety of other property or inhabitants in the community and the application for the building permit otherwise complies with the requirements of the ordinances of the City, its charter and the laws of Florida. SECTION 3: That the Zoning Comilli.ssion shall: A. Make a study of and a report to the Council on all emergency needs for road safety improvementsi including traffic lights2 traffic signs and pedestrian crossings; B. Review the capability for expansion of existing water and sewer systems serving the City; C. Initiate proceeding to adopt a comprehensive plan for the city' adopt zoning classifications; regulations and districts and zone or rezone all lands lying within the city. SECTION 4: This ordinance shall beconie effective iui- niediately upon its passage, and shall expire and be of no further force and effect �`o � days after its effective date. SECTION 5: Should any section or provision of this ordinance or any portion thereof2 or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the reinainder thereof' other than the part declared invalid.. SECTION 6: All ordinances or parts of ordinances in conflict herewith are repealed for the period of operation of this ordinance.
