AN ORDINANCE AMENDING ORDINANCE #1--64 OF THE CITY OF
TAMARAC BY ADDING SECTION 10.41 PROVIDING FOR SPECIAL
USE EXCEPTIONS TO PERMIT THE SALE AND CONSUMPTION ON
THE PREMISES OF ALCOHOLIC BEVERAGES AS AN ACCESSORY
USE TO A RESTAURANT LOCATED IN A B-1 DISTRICT;
PROVIDING FOR LIMITATIONS ON ADVERTISING, SIGNS AND
FLOOR AREA; ESTABLISHING PROCEDURES; AND, PROVIDING
AN EFFECTIVE DATE.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE City
of Tamarac, Florida:
SECTION 1: That Ordinance No. 1-64 City of Tamarac be
amended by adding thereto the following section:
SECTION 10.41 - SPECIAL USE EXCEPTION. The City Council,
following the procedures adopted by the City of Tamarac
for rezoning of land, may, by resolution, grant a special
use exception permitting the sale and consumption on the
premises of alcoholic beverages as an accessory use to a
restaurant located in the B-1 District. The restaurant
shall have all licenses required by the State of Florida
for such use; there shall be no outside advertising or
signs with respect to the sale of alcoholic beverages;
and not more than 10% of the gross floor area of the
restaurant shall be used exclusively for the sale and
consumption of alcoholic beverages. Provided, however,
that no such special use exception shall be granted for
any property located within 500 feet of property zoned for
single family use.
SECTION 2: Should any section or provision of this ordinance
or any portion thereof, or any paragraph, sentence or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be
invalid.
SECTION 3: This Ordinance shall become effective immediately
upon its
final passage.
