AN ORDINANCE ADOPTING BY REFERENCE RULES
OF
OF THE DIVISION OF HEALTHI DEPARTMENT
HEALTH AND REHABILITATIVE SERVICES STATE
OF FLORIDA PERTAINING TO FOOD SERVICE
FOOD PROCESSING AND FOOD OUTLETS; ADUT-
ING BY REFERENCE CHAPTERS 385 AND 386
FLORIDA STATUTES; DESIGNATING BROWARD
COUNTY HEALTH DEPARTMENT AND ITS OFFICIALS
AS CITY HEALTH OFFICERS; PROVIDING A PEN-
ALTY FOR VIOLATION; REQUIRING APPROVAL OF
CERTAIN BUILDING PLANS BY BROWARD COUNTY
HEALTH DEPARTMENTS; REQUIRING CERTIFICATES
OF INSPECTION FOR FOOD ESTABLISHMENTS;
PROVIDING A SAVINGS CLAUSE; REPEALING LAWS
IN CONFLICT; AND, PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the City does hereby adopt be reference,
pursuant to Chapter 381 FLORIDA STATUTES the following Rules
of the STATE OF FLORIDA Department of Health and Rehabi.litive
Services, Division of Health, in toto:
A. Chapter 1OD-13.
B. Chapter 1OD-14.
C. Chapter IOD-15.
SECTION 2: That the City does hereby adopt by reference
all of Chapter 385, FLORIDA STATUTES.
SECTION 3: That the City does hereby adopt by reference
all of Chapter 386, FLORIDA STATUTES.
SECTION 4: That the City hereby designates pursuant to
the authority of the Section 134 of the City Charter, The
Broward County Health Department and any of its officials as
The City Health Officers, with full power to enforce the
Ordinances of the City.
SECTION 5: That any violation of this Ordinance may be
punished by a fine of not more than $500.00 or imprisonment
for not more than 60 days or by both such fine and imprison -
meat in the discretion of the Municipal. Judge.
SECTION 6: That no building permit be issued by the
building department for the construction or renovation of any
food establishment until the plans therefor have been approved
by the Broward County Health Department.
SECTION 7: That no occupational license shall be issued
or renewed by the city for food establishments until proof is
furnished that such establishment has been inspected and ap-
proved by the applicable state or county agency or agencies.
SECTION 8: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the
part declared to be invalid.
SECTION 9: All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 10: This Ordinance shall become effective immediately
upon its final passage.
