CITY OF TAiVARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE REPEALING ORDINANCE NO. 70.3 7 EFFECTIVE
OCTOBER 1, 1972; PROVIDING FOR OCCURATIONAL LICENSES
AND FEES '11EREFORE; PROVIDING RUMS, REGULATIONS,
AUTHORIZATION, AND PROCEDURE FOR COLLECTION OF LICENSE
FEES, ISSUANCE OF LICENSES, AND TI$i CARRYING OUT OF
TTIE TERMS AND INTENT OF THIS ORDINANCE; PROVIDING A
PENALTY FOR THE VIOLATION HEREOF; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS
CLAUSE.
WHERTAS, Chapter 72-306 LN';S OF FLORIDA, 1972 Regular Session,
creates a new Chapter 205 FLORIDA STATUTES, and
MEREAS, Section 205.042 authorizes municipalities to .levy
an occupational license tax consistant therewith for the twelve
month period beginning October 1, 1972, and
1�11EREAS, such.chapter ratifies the existing occupational
license ordinances of cities and towns only until October 1, 1972.
N(yff, THERFORE, BE IT O.RDAINT-D BY 'I1TE COUNCIL of the City
of Tamarac, Florida:
ARTICLE I
That Ordinance No. 70--37 be and it is hereby specifically
repealed, effective October 1, 1972.

LICENSES
SECTION 1: CONSTRUCTION.
Each provision of this ordinance and each license tax imposed
hereby is intended to be separate and independent, and this ordinance
is intended to be construed distributively.
SECTION 2: DEFINITIONS.
As used in this ordinance, the following terms shall mean:
(1) Merchant. Under this classification are included
a great many businesses engaged in selling goods, wares and
merchandise in retail or wholesale. Any occupation engaged in
selling goods, wares and merchandise, which is specially classified,
shall pay the specially classified occupational license tax, and not the
merchants occupational license tax; but any business not specially
licensed, and engaged in such business, shall pay the merchants
occupational license tax. Any person who is both a wholesale and
retail merchant, as defined Herein, is required to make separate
reports for the wholesale business and for the retail business and
to obtain licenses accordingly.
(2) Manufacturers and Manufacturing. Under this class-
ification are included a great many businesses engaged in man-
ufacturing articles for sale, under this license, such concern
is entitled to sell its articles so manufactured at wholesale
only. If the establis}mient engaged .in sale at retai-1, it shall
it
be compelled to take out, in addition, a retail merchants :license.
If such.concern is specially classified, it shall pay the license
tax of such special classification.
(3) Professional. Under this classification are included
persons engaged in the practice of certain professions, each of
which are marked. A separate professional license for each person
engaged in the practice of such profession is required. It is a
personal license and not transferable.
(4) Traveling Dealers. All traveling dealers who shall
bargain to sell any goods, wares or merchandise from house to house,
for cash, or otherwise., by sample, or in any other manner, for
present or future delivery, skull be deemed peddlers, hawkers or
itinerant vendors within the meaning of this ordinance, except those
persons doing business in interstate commerce as otherwise provided
herein, or unless such license tax is prohibited by Section 8 of
Article l of the United States Constitution.
(5) Contractor. Any person who shall accept orders or be
engaged in the business of accepting orders or contracts on a cost plus,
fixed :fee, stated sum, percentage basis or any combination thereof,
-or for compensation other than wages for doing work on or in any
building or structure requiring the use of paint, stone, brick,
mortar, cement, wood; structural steel or iron, sheet iron, metallic
piping, tin, lead or any other building material;- or to do any paving
or curbing on sidewalks or streets, on public or private property,
using asphalt, brick,. stone, cement or wood or any combination; or
to excavate for foundations or any other purpose, or to construct
bridges, construct sea walls and bulkheads of any and all description;
and who is engaged in the business of building, remodeling, repairing,
razing or moving, whether it be by.contract, fixed fee or sublet,
percentage, or any combination thereof, or for compensation other than
wages, shall be deemed to be a contractor.
(6) Merchandise. Merchandise means any goods, wares or
canmodities bought or sold in the usual course of trade or business.
(7) Retail Merchant. Retail merchant means any merchant
who sells to the consumer, or for any purpose other than resale.
(8) Wholesale Merchant. Wholesale merchant means any
merchant who sells to another for the purpose of resale.
(9) Sale. Sale means the transfer of ownership, title
or possession, whether conditional or otherwise for a consideration.
(10) Person In Charge. Person in charge means the person
in the place of business at any time who is charged with the duty
of supervising, operating or managing such business at such time.
(11) Person. Person shall mean any person, firm, corporation,
association, partnership, executor, administrator, trustee or other
legal entity, singular or plural as the context requires.
(12) Employee. Employee means all persons directly connected
with the -business (owner or operator).
SECTION 3 : REQUIRED; UNL�VUFLJL OPERATION.
(1) It shall be unlawful for any person to transact
business within the city limits without first obtaining a license
to do business under this ordinance.
(2) Any person who maintains a permanent business location
outside of the municipal business boundaries and who does not
in;aintain a permanent location or branch office within the City of
Tamarac shall not be required 'to have a City of Taniara.c occupational
license. Such person shall be required to present evidence of his
being licensed elsewhere by :furnishing a copy of his occupational
license for such other location ant/or by affidavit.

(3) Each days selling or disposing of merchandise, or
engaging in business without making the affidavit, as required in
this ordinance, and obtaining proper license, shall constitute a
separate and distinct violation of this ordinance.
SEUPION 4: WAREHOUSES.
(1) Firms operating i,,hat are known as warehouses (no
sale) from which they furnish and replenish their stores, are
required to obtain a separate storage license for each distributing
house or place in the city operated for the purpose of distributing
goods, wares and merchandise anon;; his or its retail stores.
(2) Any classified warehouse or storage depot conducting
merchandise sales must secure a proper license in the classification
which anulies to the operation.
SECTION 5 : LICENSES SUBJECT TO ORCIIHANCE .
No license sliall be issued or granted to any applicant to
engage in the business of selling or disposing of merchandise of
any kind, at retail or wholesale, or the practice or pursuit of any
profession or occupation in the city, except upon the terms and
conditions and subject to the provisions of this ordinance.
SECTION 6: APPLICATION: DAU-a DUE.
Every person engaged in or managing any business in the
city is required to have a city license, mid shall, on or before
October 1, of each year, and always before engaging in any business,
profession or occupation, make application for a license and register
in a boot: on file, to be kept for that purpose by the city tax
collector, their names, professions or occupation, and the location
of the proposed place of business; and such application shall be
made by the individual, one of the partners or an officer of the
corporation, as the case may be; and no person shall engage in and
manage any such business, profession or occupation until after
having been so registered, and without first having obtained the
required license, and paid the amount of such occupational license tax.
SECTION 7: LOCATION OF BUSINESS OF APPLICANT; APPLICATION
OF ZOiVING REGULLL4'I'IONS. T
(1) Each applicant for an occupational license shall
definitely state and set out the exact location at which such business
shall be operated.
(2) Each applicant for a professional license shall state
whether Ire intends to practice his business at a definite business
location or not, and if he intends to maintain a place of business
for the practice of such business, lie shall definitely state and
set out the exact location of such place of business.
(3) Before issuing a license it shall be the duty of the
tax collector to check the zoning applicable to such listed place
of business, and if the applicable zoning regulations do not pernit
the practice of such profession or -the conduct of business at such
intended business location, the tax collector shall refuse to issue
a license for a business in a prohibited zone, unless the applicant
can show a "vested right for non -conforming user or zoning board of
adjustment variance permit, and in such instances the particular
exception must be endorsed upon the license. I'"rhere a professional
license is issued for general use, and the applicant maintains no
particular place of buiness, such license should be marked "No business
address ---general use."

(4) Anyone who has a business telephone installed
within the City of 'Tamarac shall be deemed to have established a
business location or branch office unless evidence's presented that
such installation is for a period Of thirty days or less.
SFC'lION 8: PAYPIINT OF TES i1JT TO AUTi-IORI2E CO l�'iTSSION OF OifiENSE•
The payment of a license under this ordinance shall not
authorize or legalize in any manner whatsoever file conniiission
of any offense or crime against the City, the County, the State or
the United States of America.
SECTION 9: E)U111RATION DUPNFION, HALF-YDkIR LICENSE, TP.ANSFER.
(1) License shall expire on the 30t1i day of September
of each.year.
(2) No license shall_ be issued for more than one year,
and for each license obtained between October 1st and April lst,
the .full tax for one year shall be paid, except as herein provided,
and for each license obtained from April. 1st to September 30th,
one-half the full tax for one year shall be paid, except as herein
otherwise provided.
(3) Any license which is transferable shall be transferable
with the approval of the tax collector, and with the business for
wiZich it is taken out, when there is a bona fide sale and transfer
of the property used and employed in the business as stock and
trade, and not otherwise; provided such transfer shall be made
after such bona fide sale has taken place; upon presentation of
evidence of the sale and the original license and payment of a
fee of $3.00.
(4) Before such license shall be considered as transferred,
the holder of the license shall endorse a proper transfer on the
back of the occupational license showing the exact, correct name
of the person to whom such license is transferred, and the correct
address at which such license shall be used. Such transfer shall
be signed by the person in whose name or names such license is
issued if the registered holder is an individual or individuals,
or by a member of the partnership if the registered :Holder is a
partnership, or by the president or vice-president if the registered
holder is a corporation. Evidence of a bona fide sale must be
produced before the tax collector, and the license, properly
transferred must likewise be produced before the tax collector for

(5) No person claiming to be transferee of a license
shall engage in business under such license until such transfer
has been duly registered and recognized by the city tax collector -
SECT ION 10: TRANSFER Or PROFESSIORM, LICENS1iS.
No license issued to a professional may be transferred.
SECTION 11: PAYffiNT OF PERSONAL PROPII= TXXFS--PRERE UISTTE
No person shall bo issued a license under the provisions of
this ordinance until any and all personal property -taxes levied and
assessed against such person iay the city, which l;iay be duc and pa.--
ablo at the time of filing 'the apZ;lication for such license, small
have been paid.

SECTION 12: SAti--CASII BOND IN LIEU OF PAYMENT.
(1) All persons desiring to be issued a License under the
provisions of this ordinance, w1no have heretofore not been levied
and assessed personal property taxes by the city and who shall, by
reason of engaging in business or occupation in the city, be subject
to a levy for personal property taxes by the city against personal
property used in such business, shall before receiving a license,
deposit with. the city a cash bond to guarantee payment of such
personal property taxes as may be reasonably anticipated to be
assessed for the succeeding calendar year, the amount of such deposit
to be based upon a reasonable esti-hate of the valuation of such personal
property acid millage assessed for the previous calendar year.
(2) On the date upon which. personal property taxes small
beco-Me delinquent, as provided by law, the city may apply the
amount of such deposit to the payment thereof, and any surplus
shall be delivered back to the licensee, and in the event such
personal tax shall be paid by the licensee; the full amount of the
deposit shall be returned to the licensee.
SECTION 13: FINANCIAL STATE4ENT PREREQUISITE OF ISSUANCE
OF .. 1 LICENSE.
(1) In all cases where the amount required to be paid for a
license depends upon the amount of capital invested, or value of
goods or stock, or property used in the business, it shall be the
duty of the person applying for such license to render to the city
tax collector a sworn statement of the amount of such capital, or
value of such stock, goods or other property, and such.other proof,
including insurance carried, and as a condition for the issuance
of any such license the applicant shall be bound to submit for
inspection and examination by the city tax collector either before
or after the license is issued, inventories last taken, or stock
books, to show the amount of capital invested, or the value of 'the
stock. of goods, wares, or merchandise, or other property carried
or used in such.business.,
(2) The city tax collector may refuse to issue the license
until such.statement is filed, and such inspection and examination
is permitted; and it shall be unlawful for any licensee to refuse
to allow such inspection and examination by the city tax collector.
SECTION 14 : SAME - -- k ALSE STATI ,1EN'TS UNLAL PLJL .
It shall be unlawful .for any person willfully to make any
false written affidavit as to the amount of the capital invested,
or of the value of stock, goods or other property invested in the
business, and file such affidavit with the city tax collector, or
any other city official, for the purpose of procuring a license for
a less sum than is lawfully payable by the affiant, or his principal,
and any such license so obtained shall be void.
SECTION IS: EVIDENCE OF LIABILITY FOR LICENSE.
(1) The fact that any person represented himself as being
engaged in any business, occupation or profession for which a
license is required for the transaction of business or the
practice of such profession, shall be evidence of tide liability
of such person to pay a license, regardless of whether such person
actually transacts any business or practices a profession. Dis-
playing a sign or advertisement indicating the conduct of a business
or profession at a Liven location, advertising a business or
profession in the classified section of the telephone directory
or city directory of other media shall be evidence that such
person is holding himself out to the public as being engaged in
a business or profession.

(2) Before a license can be issued to a.contractor, said
contractor must provide sufficient evidence of a Certificate of
Competency issued by either Broward County or a imuricipality within
Broward County that is deemed acceptable by the City Building and
Inspection Department.
SECTION 16: PENALTY FOR LATE PAM-NT.
(1) A penalty of five percent of the license tax imposed by
the provisions of this ordinance is hereby assessed in the event
the same is not paid within 30 days from the date the sane shall
become due and payable, and a penalty of ten percent of the license
tax imposed paid within 60 days from the date the same shall become
due and payable.
(2) The penalties hereby imposed shall be collected in
addition to the amoup_% of the license tax, and the payment of such
penalty shall not be pleaded in bar in any proceedings charging
the offense of doing business without a license under this Ordinance.
SECTION 17 : EMTTIONS : WAIVER.
(1) Confirmed invalids, cripples, widows and persons 65
years of age or over, dependent solely upon their own exertions
for support, who are bona fade residents of the city and incapacitated
for the performance of manual labor, upon filing with the city
tax collector satisfactory proof of such conditions, shall be
allowed to engage solely upon their own account and with capital
not exceeding $500.00 in the business of merchant for the sale
of merchandise other than drugs, medicines and liquors, without
being required to pay the license tax, as provided in this ordinance
for any such.business.
(2) Any exemption permitted and provided for by Florida
Statutes shall be allowed and shall be implemented in accordance
with the teals and provisions of the applicable statute.
(3) Upon written application on a form to be provided
by the city cleric, charitable, educational, eleemosynary and
other similar organizations, persons or groups may be .relieved
from the necessity of obtaining an occupational license otherwise
required by this ordinance; such relief to be granted in the follow-
ing main-.e r :
(a) By action of the city council where (i) the
application reveals a request for the use of publicly owned
property such as, but not limited to, streets, parks, public
buildings; or (ii) where the application.reveals that the applicant
desires to use, conduct or sponsor a circus, carnival or similar
type of amusement by an amusement organization or professional
amusement persons, in which event there shall accompany the
application a copy of an executed contract between the applicant
and such circus, carnival or similar type of: amusement organization
or professional amusement persons reflecting that not less than
fifty percent of the net profits will be paid to the applicant,
or in lieu of such copy, an affidavit to the same effect, sworn
to and signed by the applicant. All applications for waiver
required to be passed upon by the city council shall be accompanied
by a certificate of the city clerk certifying that the applicant
is in fact a non-profit, charitable, educational, eleemosynary or
other similar organization, person or group.
[b) By action of the city clerk for any application not
required to be passed upon by the city council; provided, however,
that prior to any such waiver tiie city clerk shall determine that
the applicant is in fact a non --profit, charitable, educational,
eleemosynary or other similar organization, person or group, and
attach his certificate to that effect to the application.
SECTION 18: YEARLY PRIVILEGE.
(1) Whenever an occupational license is levied against any
profession, trade, shop or business, classified herein, such
occupational tax shall be required to be paid to carry on such
business, whether it be connected or operated in conjunction with
any other business, or not, unless contrary appears.
(2) The occupational licenses levied against the various
professions, trades, and businesses described in this ordinance
shall be for a yearly privilege, unless the contrary appears.
SF.C'TTON 19 _ REBATES OF FEES PROHIBITED, EXCEPTION_
No portion of any occupational License tax herein assessed
shall be rebated, unless it clearly appears that such license tax
was collected by mistake or error, and before making such rebate
to a licensee, all amounts payable under a proper license shall
be paid by such licensee. Provided however, that holders of
valid "licenses to the year 1971--1972 shall be entitled to a credit
of 1/12th of the fee paid .for such licenses toward a renewal
thereof under this ordinance.
SECTION 20: DUTTY OF OFFICERS OF CORPORATIONS.
It shall be the duty of all officers, agents or persons of
any corporation to see that such corporation complies with the
provisions of this ordinance. All officers or agents of any
corporation required by this ordinance to be licensed which shall do
business without having paid the license tax imposed and procured
such license, shall be subject to the penalties imposed by this
ordinance upon persons and members of firms and corporations violating
this ordinance.
SECTION 21: LICENSE TO BE POST13D.
It is hereby made the duty of any person exercising the
privilege of conducting a business, occupation or profession
for which a license is hereby required, to post his license in a
conspicuous place in or about this place of business where it
may be seen upon inspection by and city official, and for his fail-
ure to do so, he shall, upon conviction, be punished as hereinafter
set out.
SECTION 22: AFFIXING LICENSE TO VEFIICLES, IvYWHINES, ETC.
(1) 1henever a license or a tax is required to be paid on
any machine, trade board, vehicle, etc., such license or other
evidence of payment of tax must be affixed in a prominent place
upon such machine, trade board, vehicle, etc., as designated by
the license inspector. Whenever a license tax is required to be
paid upon any machine or instrument such as required herein, and a
distributor's license is required to be paid by the distributor
who distributes, services, collects for use of, or manages or
supervises such machines, the tax collector shall require the
distributor to pay the distributor's license, before issuing a
license for any such machine. Any person using any one of such
machines shall disclose the name of his distributor, and satisfy
himself that a distributor license has been paid before such
machine is operated in his place of business. It shall be unlawful
to operate any such machine in any place of business in the city until
the tax for such machine has been paid, and proper tax paid by the
person who distributes, services, collects for the use of, or
manages or supervises such machine. 1Vhenever a license or tax
is required to be paid on any machine, vehicle, etc., such license
or other evidence of payment of tax auust be affixed in a
permanent place upon suchma.chin.e, vehicle, etc., as designated
by the license inspector.

(2) Whenever the tax collector shall find a vending machine
required to be licensed under this ordinance, being operated
without a current license, he shall attach to the machine a notice
of delinquent taxes. Any person who removes notice of delinquent
taxes or who removes any moneys from the machine before license
tares are paid, shall be guilty of a violation of the ordinances
of the City of 'Tamarac.
S13CTION 23: DISPLAY OF LICENSE.
Every person having a license shall exhibit saaite when called
upon to do so by an authorized officer of the city, and all licenses
must be conspicuously displayed at all times.
SECTION 24: INTERSTATE CO,.MN CARRIERS AND PUBILIC UTILITIES.
The tax unposed by this ordinance on express companies, rail-
road companies, telephone companies, telegraph companies and other
companies engaged in interstate coriunerce, is imposed upon the business
actually done by any such company within the city and to and from
points within the State, and is not imposed upon any business done
for the United States government or upon interstate business.
SECTION 25: DISPOSITION OF PROCEEDS FROM LICENSE.
All .revenue derived from license taxes Hereby imposed shall
be paid into the general fund.
SECTION 26: INSURANCE RE UIR.RdWrS.
(1) Every contractor granted a license shall be reu:.iired to
maintain at all tines, in an insurance company authorized to do
business in the State, employees liability insurance or workmen's
compensation insurance and public liability insurance with minimum
limits on each not less than $50,000.00 for one person and $100,000.00
for more than one person, in any one accident, and public property
damage insurance with.a minimum limit of not less than $5,000.00
for any one accident.
(2) At the time application is made for a license and before
a license can be issued, the contractor shall file with the building
inspector a certificate signed by a qualified agent for the insurance
company stating that a policy or policies are issued by the licensee.,
or a form certifying that the contractor does not employ three men
or more and is not liable for Florida Workmen's Compensation.
SECTION 27: LICENSE TAX ON BANKRUPT, AUCTION, ETC., SALES.
Before any person shall sell or be engaged in -the business
of selling goods, Meares, merchandise or other personal property such
sales being advertised as banJcrgpt, insolvent, insurance, assignee,
trustee, testator, executor, administrator, receiver, auction,
syndicate, railroad or other wreck, wholesale, or manufacturers
or closing -out sale, or as goods damaged by smoke, fire, water or
otherwise, such person shall pay a license tax of $350.00; but
the provisions hereof shall not apply to bona fide sales of general
assignees for the benefit of creditors or bona fide trustees selling
under power of sale in any deed of trust or mortgage or lien,
executors and administrators selling goods of their decedent, or
to any officer selling the property under legal process, or to
regularly licensed auctioneers, selling bona fade at public outcry
in the usual course of their business, or bona fide merchants in
selling or disposing of stocks of merchandise who were the original
owners of said stocks of merchandise and a license has been already
paid by such merchant prior to the bankruptcy proceedings. TIie
license required by this section shall not be transferable. `The
use of any of the descriptive words or phrases referred to in this
section as a part of a trade or _Eirim narle shall be construed
to require the obtaining of the license herein provided Cor.
SECTION 28: NO SANXRUPT STOCK I-14PORTED.
No person shall bring in for sale within the city limits
any baz-�krupt stock idiich has been purchased outside of the city
limits.
SECTION 29 : NIDTO R VEHICLES OF LICENSEES TO COM'AIN SIGN;
CONTENTS.
Any and all trucks or motor driven vehicles oporated or
used in connection with any business, occupation or profession
in the city shall have painted upon a prominent place on such
truck or motor driven vehicle the name and addre5s of the business
in which such truck or motor driven vehicle is used.
SECTION 30: TRUCKS AND VEHICLES SELLING MI:RCIIANDISE ON
STR6.1"l"S -C SSI _ TI N.
Trucks or moving vehicles propelled by gasoline or oil or
other propellants operating upon the streets of the city for the
purpose of this section are classified as follows:
(1) Trucks or moving vehicles onga7ed in the business
of delivery goods, wares and merchandise, where no money is received
upon the delivery and no orders taken for goods, wares or merchandise
to be delivered in the future.
(2) Trucks or moving vehicles operating from and in
connection with a place of business in the city, upon which a local
occupational license has been paid.
(3) Trucks or moving vehicles from which vegetables and
farm and ;rove products raised and produced by the oi�ner of the
truck are offered for sale at wholesale only in the city.
(4) Trucks or moving vehiicles from which vegetables and
farm and grove products not raised and produced by the owner
of the true. are offered for sale at wholesale in the city.
(5) Trucks or moving vehicles from which goods, wares
and merchandise (except vegetables or farm and grove products)
are offered for sale at wholesale in the city.
(G) Trucks or moving vehicles operating from a wholesale
place of business located outside the limits of the city, which
place of business holds a county wholesale license, issued by some
county in the State and a wholesale occupational license issued
by come city in the State.
(7) Trucks or moving vehicles selling goods, wares,
merchandise, farm products, grove produces, citrus, shrubbery, etc.,
at retail or rendering services for which a charge is made, such
as sharpening knives, repairing., towel or linen service, etc.,
in the city.
SECTION 31: SMIE T,ICENSE RF UIRED FOR CERTAIN TRUCKS.
(1) Trucks and moving vehicles described under paragraphs
4, 5, and 7 of Section 30.hereof are required to pay for an occupational
license under the applicable classification, as set out in this
ordinance.
(2) Operators of trucks and moving vehicles described under
paragraph 4 of Section 30 hereof shall be required to register
with the police depar-biient before receiving a metal plate or
decal permit to be attached to the outside of such 'truck or juovi-Lig
vehicle.
(3) Operators of trucks and ,iioving ve,iicle s described ?eider
paragrapil 5 of Section 30 hereof sE;all be required to register
With the police department before receivinsT a metal. plate or

decal peps -,lit to be attached to thhe outside of such truck or moving
vehicle.
(4) Operators of trucks and moving vehicles described under
paragraph 7 of Section 30 hereof shall be.required to pay an
occupational license tax as specified in this ordinance, and to
register with the police department before receiving a metal plate
or decal permit to be attached on the outside of such truck or moving
vehicle.
(5) Nothing herein shall be construed to authorize the
imposition of a license fee on any vehicle contrary to 205.062

SECTION 32: REGISTRATION_ OF CERTAIN TRUCKS; ATTACHING PER,CI'IS.
Operators of trucks and moving vehicles described under
paragraphs 3, 4, 5, 6, and 7 of section 30 hereof are required
to register a description of the truck and motor vehicle, the
name and address of the owner, and the place of business from
which such truck operates with the police department of the city
and to secure a metal plate or decal permit to be attached to such
truck or moving vehicle, before doing business in the city or
using the public streets. The police department shall keep a
book for registration of such trucks or moving vehicles.
SECTION 33: SAT,E-=CERTAIN TRUCKS TO HAVE GROWF� ,RS CEI IEIQ.11.
Operators of trucks and moving vehicles described under
Paragraph 3 of Section 30 hereof shall be required to produce a
grower certificate of the State and register the description of
the automobile and name and address of the owner with the police
department and upon so doing shall be entitled to secure a metal
plate or decal permit to be attached on the outside o:LE such truck
or moving vehicle.
SECTION 34 : SAi,!E- -CERTAIN TRUCKS TO -1-7AVE, CITY AND SPATE
[^7r1O1,ESALE LICENSE.
Operators of trucks and moving vehicles.described under
paragraph 6 of Section 30 hereof shall be required to present
to the police department a State and county occupational license
issued by some county in Florida, as well as a city occupational
license for a wholesale dealer issued by cone city in the State,
both of such licenses to be for the current year before receiving
a metal plate or decal Permit to be attached to the outside of such
truck or moving vehicle. Provided that where either the county
or city of the operators principal place of business do not issue
occupational licenses, evidence of such fact may be accepted in
lieu of such licenses.
SEGIION 35: CIRCUSES, CARNIVALS AND OUTDOOR SHOWS---INFOR-\iAIION
I-0 BE FIT.ED PRIOR_ TO ISSUANCE OF LICEiyS.E.
Any applicant applying for an occupational license for the
holding of a circus, carnival, show or outdoor exhibition in the
city shall at the time of securing such license be required to file
with the city license inspector the following:
(1) An affidavit that permission has been secured from
the owner of the land upon which the circus, carnival or siho' is
intended to be held.
(2) A bond, collateral agreement or other securh.ty con-
ditioned to clean the premises of all rubbish and debris after
use by such applicant.
(3) A written statement from the building departr.lent
of the city that the site upon which the circus, carnival or
outdoor show, or other public gathering or e)chibition is intended
to be held is not within any prohibited area.
(4) A written statement of the fire deA,c.rtr�er�.t se rvi-

the city that -the tents or temporary buildings or structures
under which the operations are to be held are fireproof material
and will not constitute a fire hazard.
SECTION 36: SAME -- LICENSE TAX
No circus, carnival, show or public exhibition shall be
permitted to begin erecting its tents, booths or other installations
in a permitted area. in the city without the payment of the full
amount of occupational license tax as prescribed in this Ordinance.
Such occupational License tax shall be paid in :full before any
equipment is brought upon the location where such circus, carnival,
show, etc., intends to operate.
SECTION 37 : SN,M PAl DES.
A parade through the streets of the city shall not be
permitted unless permission is secured from the city clex•k of the
city in writing prior to the beginning of such parade, and the
occupational license tax :for staging the parade as provided for in
this Ordinance is paid.
SECTION 38 : PRIVA`CE DETECTIVF,S-APPLICATION FOR LICENSE:
EX vII NAT ION .
Before any occupational licenses for private detective may be issued,
the applicant must first presont to the city license inspector the
following information:
(a) A certificate from the police depar-Mont of the city
showing that the applicant has been -Finger-printed and that he
has no past record of a felony conviction.
(b) A certificate from the chief of police showing the
applicant has successfully obtained, a State license.
SR(,TT()N 30: SM13-REGISTRATION OF UNLICENSID DETECTIVES OPERATING
All private detectives or criminal investigators not licensed
by the city are required to register with tree police department
before conducting any operation within the corporate limits of the city.
SEC' ON 40: SUSPENSION OR REVOCATION; REI UNIi_OF FEE, NOTICE.
(a) Any license issued by the city may be temporarily suspended
or absolutely revolted or cancelled by a majority vote of the city
council, when the council shall have ascertained and deter.PLined, in
the exercise of its sound discretion, that such action will promote
the public peace, health, safety, welfare, harmony or good order
of the neighborhood in which the licensee's place of business is
located or serves; provided, however, that in the case of the
revocation and cancellation of such License, the city shall refund
to licensee the prorated unearned or unused portion of his or its
license; provided further, that no refund shall be made i�fnere the
license is temporarily suspended.
(b) Prior to any such revocation or suspension -as mentioned
herei.nabove the city ceancil shall notify the holder of said license
ofsaid proposed action and shall by ordinary letter, mail or notice,
personally served by the police department, notify the licensee holder
of the time and place of the hearing in which the city council shall
determine maid find whether Vie license shall be revoked or suspended.
The holder of said license shall be given an opportLini.ty to preset
his defenses to said proposed action at the hearing and may be
represented by counsel.

this chapter, the various kinds of classes of
insurance are hereby defined to be as follows:
Casualty and liablity, fire, industrial and
funeral benefits and life. In the event there
shall be more than one local agent represent-
ing an insurance company in the selling of any
one of the above kinds or classes of insurance,
then the sum of $60.00 shall be paid on account
of each separate agency).
For the purpose of taxation under this
chapter insurance companies are classified
as follows:
1. CASUALTY AND LIABILITY INSURANCE
COMPANIES.
Including bonding companies, writing
(a) accident and health insurance only,
on annual, semi-annual or quarterly
premium paying basis, and
(b) bonds, including fidelity, court,
contract and surety bonds and finan-
cial guarantee, the title insurance
or guarantees;
(c) burglary insurance, including resi-
dence, bank, stocks, bonds and
securities, safe burglary and hold-
up and messenger robbery;
(d) liability insurance, including em-
ployers, public and other forms of
liability insurance and automobile
liability for personal injury, prop-
erty damage and collision;
(e) plate glass. insurance;
(f) workman's collective insurance issued
to employers of labor.
2. FIRE INSURANCE COMPANIES,
writing policies of insurance against
hazards of fire, tornado, and wind-
storms, use and occupancy, profits,
rents, lease, hold, insurrection, riot
and civil commotion, sprinkler leakage,
rain, fire, theft, automobile collision,
stranding or sinking.
3. INDUSTRIAL INSURANCE C014PANIES
(including funeral benefit associations
or companies), writing life and/or acci-
dent and health insurance and funeral
benefits on a weekly, bi-monthly pre-
mium basis.

Sec. 42. LICENSE FEE WHERE NOT OTHERWISE PROVIDED.
Every business, occupation, profession, or exhibition, sub-
stantial, fixed or temporary, engaged in by any person, whether
in a building, tent, or upon the street, vacant lot or anywhere
in the opera air, within_ the City not reasonably similar to
a designated classification or not specifically designated
in this Ordinance, shall pay a license fee of Seventy -Five
Dollars ($75.00).
Sec. 43. LICENSE INSPECTOR.
(1) It is hereby made the duty of the City Manager„to-appoint
` _ 35, ,
a License inspector of the City, and such part-time or full-
time assistants as he may deem necessary. The said inspector
and assistant inspectors shall have police powers and shall
have the authority to implement and carry out the terms and
intent of this Ordinance. The License Inspector's duty and
authority shall include but not be limited to:
(a) Investigate all businesses, occupations,
and professions in the City;
(b) Make such inquiry as shall be necessary to
determine whether or not a license has been procured
for such business or occupation;
(c) Report to the City Clerk and City Tax
Collector, the names of all persons engaged in
business without a license;
(d) The power to serve notices of violation
of the terms of this Ordinance;
(e) The power to serve summons for the violation
of the terms of this Ordinance;
(f) The power to make arrest of any person
violating this Ordinance.
(2) Any person refusing the License Inspector or Assistant
License Inspector's permission to investigate and inquire for
the purpose of determining whether such person has complied
with the terms of this Ordinance and properly obtained an Occupa-
tional License, shall., upon conviction, be fined or imprisoned
as hereinafter set out under the Penalty Provisions of this
Ordinance.
(3) The License Inspector and Assistant License Inspectors
shall have concurrent power and authority, under the terms
of this Ordinance, with the City Tax Collector, and therefore,
may carry out any and/or all of the functions and duties that
are set forth in this Ordinance for the City Tax -Collector.
(4) The City License Inspector'shall have the power and
authority to request the aid of and thereby utilize the services
of the Police Department of the City of Tamarac in order to
enforce and implement the provisions of this Ordinance.
(5) The Police Department of the City of Tamarac is authorized
and empowered to perform any function deemed necessary to imple-
ment, carry out and enforce the provisions of this Ordinance,
when requested to do so by either the City Manager, the City
Tax Collector, or the City License Inspector. This authority
shall include but not be limited to the power to serve notices,
summonses and make arrests.
Sec. 44. PENALTY
(1) Any person, and any and all members, agents, or persons
in charge of the place of business of any firm or corporation
that shall carry on, conduct or manage any business or profession,
or who shall keep and use, upon the streets of the City any
vehicle for which a license is required, without first having
obtained a license, or who shall, fail to display or exhibit
such license as provided in this Ordinance or otherwise violate
this Ordinance shall, upon conviction, be punished as provided
in part two (2) of this section. The conviction and punishment
of any persons for transacting any business without a license
shall not excuse or exempt such person from the payment of
any license due or unpaid at the time of such conviction.
(2) Any person who shall be convicted of a violation of
this Ordinance shall be punished by a fine not exceeding the

stun of Five Hundred ($S00.00) Dollars or by haprisonment for
not more than ninety days or both such fine and imprisonment.
SECTION 45:
EFFECTIVE DATE.
The terms and provisionss of this Ordinance shall become
effective upon its final passage.
SECTION 46: EXISTING LICENSES.
A new license shall be obtained, by every person, firm or
corporation, required to have a license under the terms of this
Ordinance, on or before October 11, 1972. Any person, firm or
corporation holding a license prior to the effective date of this
Ordinance, shall be required to obtain a new license under the
terms of this Ordinance, notwithstanding the _fact that they hold such
a prior license. However, persons holding prior .licenses shall be
entitled to a credit toward the fee for the issuance of a new
license as required for October 1, 1972, in a sum equal to 1/12th
of the amount of money paid for the prior license. This shall not
affect the normal fee required for the :issuance of new licenses for
subsequent years. License sales under this Ordinance shall commence
September 1, 1972.
SECTION 47-
That nothing in this Ordinance shall be deemed to impose on
occupational license on any business or occupation except as
authorized by Chapter 72-306 LAWS OF FLORIDA, regular Session, 1972.
SEC.TTON 48:
All Ordinances or parts of Ordinances in conflict Herewith
are hereby repealed to the extent of such conflict.
SECTION 49:
Should any Section or provision of this Ordinance or any
portion hereof, or any paragraphs, sentence or word be declared
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole
or any part hereof, otxxer than the part declared to be invalid..
