AN ORDINANCE REQUIRING SUBMISSION AND APPROVAL OF A SITE PLAN PRIOR TO THE ISSUANCE OF A BUILDING PERMIT WITH CERTAIN STATED EXCEPTIONS; PROVIDING FOR REVIEW OF SITE PLANS BY THE CITY COUNCIL UNDER CERTAIN CONDITIONS; ESTABLISHING STANDARDS FOR PREPARATION OF SITE PLANS; PROVIDING A SAVINGS CLAUSE; REPEALING LAWS IN CONFLICT• AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: No building permit shall be issued until the applicant has submitted a site plan in accordance with the standards set forth in this Ordinance, except that no such site plan shall be required in the following cases: A. For a single-family residence. B. For one two-family residence. (Where the developer contemplates two or more two-family residences on adjacent lots, he shall submit a site plan of the overall development, prior to issuance of the first building permit). C. Where the permit is for an addition to or alteration of an existing structure which will not increase the overall size thereof more than 20%. D. Where the permit is to complete or alter the interior of an existing structure or one for which a site plan has previously been approved, provided that such alteration will not increase the parking requirements under applicable Ordinances. SECTTON 2: That this Ordinance shall also establish additional standards for site plans required by the various zoning classifications. SECTION 2A: That each site plan shall be accompanied by a site plan fee in accordance with the schedule attached hereto and marked Exhibit "A". SECTION 3: That site plans as required herein shall be examined and approved by the Chief Building Inspector and the City Planner and the City Engineer prior to issuance of a building permit. That upon disapproval of a site plan the applicant may appeal the decision of the administrative officials to the City Council which shall then consider the site plan at a public meeting and shall thereupon approve or disapprove such site plan. SECTION 4: That upon the administrative approval of a site plan it shall be posted on the bulletin board in City Hall for 72 hours, prior to the issuance of a building permit. If prior to the issuance of the permit any person makes a written request therefor, stating that a specified ordinance has been violated, such site plan shall be reviewed by the City Council at a public meeting and the approval of the City Council shall be a pre -requisite to the issuance of the building permit. SECTION 5: All site plans shall contain all of the information required by applicable laws and Ordinances governing the approval of subdivisions, and, in addition, shall show the following: A. The proposed title of the project and the name of the engineer, architect, or landscape architect, and the developer. B. The northpoint, scale, and date. C. Existing zoning. D. The boundaries of the property involved, all existing easements, and property lines, existing streets, buildings water- courses, water -ways, or lakes, and other existing physical features in or adjoining the project. if any. E. Proposed changes in zoning to the applicant property, F. The location, dimensions, and character of construction of proposed streets, alleys, driveways, curb cuts, entrances and exits, loading areas (including numbers of parking and loading spaces), outdoor lighting systems, storm drainage and sanitary facilities. G. The location and dimensions of proposed lots, setback lines, and easements, and proposed reservations for parks, playgrounds, open spaces and other common areas. H. Location with respect to each other and to lot lines of all proposed buildings and structures, or major excavations, accessory and main. I. Preliminary plans and elevations of the building or buildings, as may be necessary. J. Location, height and material of all fences, walls, screens, screen planting and landscaping. K. Location, character, size and height and orientation of proposed signs, if any. L. A tabulation of the total number of dwelling units of various types in the project and the over-all project density in square foot of lot area per dwelling unit, gross or net as required by district regulations. M. Topgraphy of the project area with contour intervals on one foot or less. N. The location and sizes of sanitary and storm sewers, water mains, culverts, and other underground structures in or near the project. SECTION 6: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, word or sentence be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof, other than the part declared to be invalid. SECTION 7: All Ordinances or parts of Ordinances in conflict herewith he and the same are hereby repealed. SECTION 8: This Ordinance shall become effective immediately upon its final passage.
