HomeMy WebLinkAboutCity of Tamarac Ordinance O-1972-017'This ORDINANCE was introduced 11 CITY OF TAMARAC, FLORIDA ORDINANCE NO. -�( AN ORDINANCE AMENDING ORDINANCE NO.72-5 OF THE CITY OF TAMARAC BY REQUIRING CURBING OF CERTAIN LANDSCAPED AREAS; BY REQUIRING THAT ALL LAND- SCAPED AREAS BE PROVIDED WITH AN UNDERGROUND IRRIGATION SYSTEM; BY REQUIRING THAT THE GROWTH OF VEGETATION SHALL BE PREVENTED WHERE - EVER ROCK OR PEBBLES ARE USED AS GROUND COVER; PROVIDING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION l: That Section 4 (a) of Ordinance No. 72-5 of the City of Tamarac be amended to read as follows: (a) Installation. All landscaping shall be installed in a sound workmanship like manner and according to accepted good planting procedures with the quality of plant materials as herein- after described. All elements of landscaping exclusive of plant material except hedges shall be installed so as to meet all other applicable ordinances and code requirements. Landscaped areas shall require protection from vehicular encroachment as herein provided in Section 3(b). Where a landscaped area is a median or an island, it shall be completely curbed. Where two accessways meet, all landscaped areas along the curved radius shall be curbed. A qualified representative of the agency charged with the issuance of building permits shall inspect all landscaping and no certificates of occupancy or similar authorization will be issued unless the landscaping meets the requirements herein provided. SECTION 2: That Section 4 (b) of Ordinance No. 72-5 of the City of Tamarac be amended to read as follows: (b) Maintenance. The owner, or his agent, shall be responsible for the maintenance of all landscaping which shall be maintained in good condition so as to present a healthy, neat and orderly appearance and shall be kept free from refuse and debris. All landscaped areas shall be provided with an under- ground irrigation system. SECTION 3: That Section 4 (c) 5 of Ordinance No. 72-5 of the City of Tamarac be amended to read as follows: (5) Ground covers. Ground covers used in lieu of grass in whole or in part shall be planted in such a manner as to present a finished appearance and reasonably complete coverage within three months after planting. Whereever rock or pebbles are used as ground cover, the installation shall be in such a manner as to prevent vegetation growth through such ground cover. SECTION 4: Should any section or provision of this Ordinance or any portion hereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: All Ordinances or part of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
