AN ORDINANCE PLACING 90 DAY MORATORIUM ON ALL REZONING OF PROPERTY INVOLVING RESIDENTIAL ZONING CLASSIFICATIONS AND REVIEW OF ALL RESIDENTIAL SITE PLANS AND BUILDING PERMITS DURING THE PENDANCY OF AMENDMENT TO THE VARIOUS RESIDENTIAL ZONING DISTRICTS RELATIVE TO THEIR PER- MITTED DENSITY; PROVIDING FOR REVIEW OF EXCEPTIONAL CIRCUMSTANCES; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Tamarac, Florida has determined that an emergency exists in terms of the density permitted under existing City Ordinances, which density directly and adversely and imminently affects the health, welfare and safety of the citizens of Tamarac and WHEREAS, the City Council has commenced a compre- hensive amendment of the residential zoning districts to reduce density in the City of Tamarac to a level compatible with the City's ability to provide municipal services and sustain the community in keeping with its present state of health, safety and welfare and WHEREAS, the City Council deems it urgently necessary to place a moritorium on rezonings involving residential districts, review of all site plans relative to residential projects and the issuance of building permits with respect to such projects NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA Section 1: That the City Council finds and determines that an emergency situation imminently affecting the health, safety and welfare of the citizens of Tamarac exists by virtue of the permitted densities in the City's present residential zoning ordinances. Section 2: That a moratorium is hereby placed on the rezoning of any lands involving residential districts in the City of Tamarac; and further a moratorium is placed on the Ll review of all site plans of residential projects and the issuance of building permits with respect to any residential projects. Provided, however, that where final site plan and platting approval have been granted by the City of Tamarac, then, in that event, a building permit may be issued. Section 3: The Board of Adjustment of the City of Tamarac is hereby granted authority during the period of this moratorium to grant variances from the terms of this Ordinance, where the Board finds that such variance will not be adverse to the health, safety and welfare of the citizens of the City of Tamarac, and further where the Board finds that a genuine hardship would result from the literal enforcement of this Ordinance. Section 4: The moratorium on rezoning lands involv- ing residential districts, the review of site plans involving residential projects, and the issuance of building permits involving residential projects shall be in effect for a period of 90 days from date of this Ordinance, or until the City shall adopt a comprehensive ordinance or set of ordinances relative to density in residential districts in the City of Tamarac, whichever is earlier.
