ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO.
71-23 OF THE CITY OF TAMARAC AND
THE SUBDIVISION IMPROVEMENT REGU-
LATIONS AS ATTACHED THERETO BY
PROVIDING FOR STREET LIGHTING SYSTEMS;
PROVIDING AN -,EFFECTIVE DATE; REPEALING
ALL LAWS IN CONFLICT; AND PROVIDING
A SAVINGS CLAUSE.
WHEREAS, the City Council for the City of Tamarac,
Florida is cognizant of the fact that poor street lighting
within new subdivisions in the City has resulted in the
occurrence of several accidents; and,
WHEREAS, this situation not only constitutes a dan-
ger for vehicular and pedestrian traffic in these areas
at night, but also creates a threat to the health, safety,
and welfare of the citizens of the City; and,
WHEREAS, Section VIII of the Subdivision Improve-
ment Regulations as attached to and made a part of Ordinance
No. 71-23 was deleted by Ordinance No. 71-37, thus leaving
the City without regulations on street lighting; and,
WHEREAS, the City Council deems it necessary for
the protection of the public health, safety and welfare
to establish a street lighting system ui thin all sub-
divisions within the City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: Ordinance No. 71-23 is hereby amended by adding to
the Subdivision Improvement Regulations as attached thereto the
following Section:
SECTION XIII - STREET LIGHTING
A. General
A street lighting system shall be
provided in all subdivisions.
B. Standards of Design and Construction
1. All plans for lighting shall
be approved by the City Manager.
2. The installation of poles and
wiring shall be completed during
the construction of the sub-
division itself.
3. Wiring for street lighting shall
be underground except in areas
where primary distribution conductors
are overhead. Subject to the approval
of the City Manager, the primary poles
may be used for street lights and
associated wiring.
4. All luminaries shall be a minimun
of 4500 lumen mercury vapor lights,
mounted on concrete poles.
C. Enforcement
1. No building permit shall be issued in
any subdivision unless the site plans
therefore contain adequate provisions for
street lighting.
2. No certificate of occupancy shall be
issued to any structure until the said
street lighting is completed and operable.
3. The provisions of this subdivision may be
waived by the City Council where it is shown that
the strict application hereof will constitute
irreparable injury or hardship and that a variance
would not be detrimental to the public health,
safety or welfare of the citizens of Tamarac.
SECTION 2: Should any section or provision of this Ordinance or any
portion thereof, or any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not affect
the validity of the remainder hereof, other than the part declared to be
invalid.
SECTION 3: All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed.
SECTION 4: This Ordinance shall become effective immediately upon its
final passage.
