CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 7 47— /
AN ORDINANCE AMENDING ORDINANCE NOS. 1-64
AND 72-6 OF THE CITY OF TAMARAC BY AMENDING
ARTICLE X THEREOF, B-1 NEIGHBORHOOD BUSINESS
CENTER DISTRICT; AMENDING ARTICLE XI THEREOF,
B--2 PLANNED COMMUNITY BUSINESS DISTRICT;
ELIMINATING ARTICLE XII THEREOF, B-2A
PLANNED BUSINESS CENTER DISTRICT; AMENDING
ARTICLE XIII THEREOF, B-3 GENERAL BUSINESS
DISTRICT; CREATING ARTICLE XVII THEREOF,
MASTER LIST OF BUSINESS AND COMMERCIAL USES;
CREATING ARTICLE XIX THEREOF, ACCESSORY USES;
RE-CLASSIFYING LANDS PRESENTLY ZONED B-2A to
B-2 ZONING; REPEALING ALL LAWS IN CONFLICT;
PROVIDING A SAVINGS CLAUSE AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: Ordinance Nos. 1-64 and 72-6 of the City of
Tamarac are hereby amended by deleting therefrom Article X thereof
and substituting therefore the following language;
ARTICLE X: B-1 NEIGHBORHOOD BUSINESS CENTER
DISTRICT
SECTION 10.1: PURPOSE OF DISTRICT
The B-1 Neighborhood Business Center District
is intended primarily to meet the neighborhood
shopping and service needs of surrounding
residential areas.
SECTION 10.2: PERMITTED USES
In a B-1 District, no building, structure, or
land and water use shall be permitted except
for one or more of the uses permitted by the
master list of business uses as set forth
in Article XVII.
SECTION 10.3: PROPERTY DEVELOPMENT REGULATIONS
1. Minimum Lot area and dimensions
Area 1/2 acre
Width 100 feet
Depth 200 feet
Frontage 100 feet
2. Minimum yard setback requirements
Front 50 feet
Side (interior) 25 feet
Side (corner) 35 feet
Rear 25 feet
3. Maximum building height and total floor
area.
Maximum building height 35 feet
Maximum total floor area 35% of the
total lot area
EXCEPTION: The maximum building height may
be increased by 10 feet to accommodate elevator
towers, mechanical equipment and screening
including parapet walls, clock towers, or
other ornamental devices; provided, however,

that the top horizontal area of all height
encroachments shall not exceed more than
15 % of the area of the roof.
SECTION 10.4: SPECIAL REGULATIONS
1. Enclosed Uses.
All uses shall be operated entirely
within enclosed buildings.
2. Lighting.
Artificial lighting used to illuminate
the premises and/or advertising copy shall
be directed away from any adjacent resi-
dential property.
3. Outdoor Storage.
Outdoor storage of merchandise is pro-
hibited.
4. Offstreet Parking and Loading.
No offstreet parking or loading space
or vehicular drive except for ingress
or egress shall be located within 25
feet of any abutting residential dis-
trict property. No trash receptacle
fixed or mobile shall be located in a
required setback area.
5. Fences and Walls.
A 6 foot wall shall be required along
any site perimeter which directly abuts
a residential district.
SECTION 2. Ordinances 1-64 and 72-6 of the City of Tamarac
are hereby amended by deleting therefrom Article XI thereof and
substituting therefore the following language:
ARTICLE XI: B-2 PLANNED COMMUNITY BUSINESS DISTRICT
SECTION 11.1 PURPOSE OF DISTRICT
The purpose and intent of the B-2 District
is to encourage the development of an inten-
sive commercial facility, providing a wide
range of goods and services, located adjoin-
ing at least one major arterial roadway and
servicing a consumer market of several
neighborhoods of a substantial territory.
SECTION 11.2 PERMITTED USES
In a B--2 Planned Community Business District,
no building, structure, or land and water use
shall be permitted except for one or more of
the uses permitted by the master list of busi-
ness uses as set forth in Article XVII.
SECTION 11.3 PROPERTY DEVELOPMENT REGULATIONS

whenever abutting property is in a resid-

(not including mall space) lot area
EXCEPTION: The maximum building height may
be increased by 10 feet to accomodate ele-
vator towers, mechanical equipment and
screening including parapet walls, clock
towers, or other ornamental devices; provided,
however, that the top horizontal area of all
height encroachments shall not exceed more
than 15% of the area of the roof.
SECTION 11.4 SPECIAL REGULATIONS
1. Enclosed uses.
All uses shall be operated entirely within
enclosed buildings unless otherwise approved
on a site development plan. Any exposed
activities such as garden supplies or auto-
motive installations, shall be fully screened
from horizontal view from any point off the
site.
2. Lighting.
Artificial lighting used to illuminate the pre-
mises and/or advertising copy shall be directed
away from any adjacent residential project.
3. Outdoor Storage.
Outdoor storage of merchandise shall be per-
mitted only when incidental to the commercial
use located on the same premises, provided
that:
a. The storage area shall not be located in
any of the required setbacks or yards.
b. The stored merchandise shall not protrude
above the height of the enclosing walls
or buildings.
4. Offstreet parking and loading.
No offstreet parking or loading space or
vehicular drive except for ingress or egress
shall be located within 25 feet of any abutting
residential district property. No trash
receptacle fixed or mobile, shall be located
in required setback area.
5. Fences and walls.
A 6 foot wall shall be required along any site
perimeter which directly abuts a residential
district.

SECTION 4: Ordinances 1-64 and 72-6 of the City of Tamarac
are hereby amended by deleting therefrom Article XIII thereof and
substituting therefore the following language:
ARTICLE XIII: B-3 GENERAL BUSINESS DISTRICT
PURPOSE OF DISTRICT
The purpose and intent of the B-3 District is
to provide space on arterial streets and traffic
ways where business establishments primarily
not of a neighborhood or community service type
may properly be located to serve large sections
of the community and metropolitan area.
SECTION 13.2 PERMITTED USES
In a B--3 General Business District, no building,
structure, or land and water use shall be permitted
except -for one or more of the uses permitted by
the master list of business uses as set forth in
Article XVII.
SECTION 13.3 PROPERTY DEVELOPMENT REGULATIONS
1. Lot area and dimensions.
There are no minimum or maximum lot area or
dimension requirements.
2. Minimum yard setback requirements.
Front 50 feet
Side 25 feet
Rear 25 feet
EXCEPTION: The minimum side or rear yard
setback shall be multiplied by two (2) when-
ever abutting property is in a residential
district.
3. Maximum building height and total floor area
Maximum building height 50 feet
Maximum total floor area 407o of the total
(not including mall space) lot area

are hereby amended by creating Article XVII thereof to read as follows:
ARTICLE XVII: MASTER LIST OF BUSINESS AND COMMERCIAL USES
SECTION 17.1 INTENT AND APPLICATION
It is the intent of this article to provide in
tabular form a listing (herein called the master
list) of the uses that shall be permitted in the
various business districts as they exist from
time to time as shown on the zoning district maps.
Any use similar to the listed uses shall be
permitted.
Where an "X" appears on the same line as a listed
use said use shall be permitted in the district
as indicated by the column heading in which the
"X" appears.
Where no "X" appears on the same line as a listed
use, said use shall be prohibited in the district
as indicated by the column heading in the same
manner.
Where an "X" is followed by a number, the listed
use shall be subject to the limitations and
restrictions set forth in the corresponding
supplemental regulations.
Where an "X" is followed by an asterisk (*)
listed use shall be subject to, or modified by,
the regulation set forth in the use column.
SECTION 17.2 VALIDITY OF MASTER LIST
Where a use is permitted or prohibited by the
master list as set forth in Section 17.1 of this
article, such indication shall have the same
validity as if the use were listed as permitted or
prohibited in the district regulations of this
ordinance.

The master list may be amended in the same
manner as any other section of this ordinance.

SECTION 6: Ordinances 1-64 and 72-6 of the City of Tamarac
are hereby amended by creating Article XIX thereof to read as follows:
ARTICLE XIX: ACCESSORY USES
SECTION 19.1 Accessory uses which are naturally and customarily
incidental to, subordinate to, and subservient to
the principal use of the premises shall, be
permitted.
SECTION 19.2 An accessory building or structure shall not be of
greater height than a principal building on the plot.
SECTION 7: All lands in the City presently zoned B-2A are
hereby re-classified from B-2A zoning to B-2 zoning. The Official
Zoning Map of the City of Tamarac shall be changed to reflect this
change of zoning, said change to be initialed by the Mayor and the
City Clerk.
SECTION 8: Should any section or provision of this
Ordinance or any portion hereof, or any paragraph, sentence or word
be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be invalid.
SECTION 9: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 10: This Ordinance shall become effective immedi-
ately upon its final passage.
