AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES; PROVIDING FOR THE RE -ZONING OF CERTAIN REAL PROPERTY FROM R-3U TO R-OA; PROVIDING FOR AMEND- MENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; AND PROV- IDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein; and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Zoning Commission of the City of Tamarac, Florida; and, WHEREAS, public hearing has been held on Petition No. 13-Z-74 by the City Council pursuant to the Charter, and WHEREAS, the Zoning Commission has recommended to the City Council that said zoning change be approved after the public hearing thereon. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA. SECTION 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from R-3U class- ification to R-OA classification, subject to site plan approval. SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect this change of zoning, said change to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. �l 0 SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This Ordinance shall become effective immed- iately upon its final passage.
