CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 74-55
AN ORDINANCE AMENDING ORDINANCE NO. 71-23 OF THE
CITY OF TAMARAC AND THE SUBDIVISION IMPROVEMENT
REGULATION AS ATTACHED THERETO BY SETTING THE
GRADE OF BUILDINGS AND GRADE RULES; PROVIDING
AN EFFECTIVE DATE; REPEALING ALL LAWS IN CONFLICT;
AND PROVIDING A SAVINGS CLAUSE.
WHEREAS the City Council of the City of Tamarac, Florida,
a flood prone area, is cognizant of the fact that many sections of
the City are plagued with constant flooding; that one of the
causes is low elevation of the slab and improper grading, and
WHEREAS the City Council deems it necessary for the pro-
tection of the public health, safety and welfare to set proper
standards,
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: Ordinance # 71-23 is hereby amended by adding to
the subdivision improvement regulation as attached thereto
the following section: SECTION XIV: GRADE OF BUILDING
A. The top or suface of all floors of buildings shall be
not less than 24 inches above the highest point of the
crown of all streets adjacent to the plot upon which
such buildings are located.
B. The Chief Building Official, upon notification from the
permit holder or his agent, must not only inspect the slab
or foundation as to height as set .forth, but also as
to its relation to the adjacent buildings. No deviation
of more than one inch lower or higher shall be permitted.
No further inspections shall be made or approved until
the height regulations are met.

C. No Certificate of Occupancy shall be issued until the
grading has been thoroughly inspected and the Chief
Building Official certifies that the flow of rainwater
is away from the homes, that swales are properly laid
out so that the water does not lay on the lawns or
streets in pools or lakes, but drains directly to the
catch basins which are to be certified as cleaned and
unclogged and unrestricted in its flow through properly
constructed culverts to the canals.
SECTION 2: Should any section or provision of this Ordinance
or any portion thereof, or any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof
as a whole or any part hereof, other than the part declared to
be invalid.
SECTION 3: All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4: This Ordinance shall become effective immediately
upon its final passage.
