HomeMy WebLinkAboutCity of Tamarac Ordinance O-1975-001This Ordinance introduced by: ti CITY OF TAMARAC, FLORIDA ORDINANCE NO, 7 AN ORDI&�NCE PROVIDING FOR THE SUBMISSION OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF TAMARAC TO REFERENDUM; PRO- VIDING FOR THE REAFFIRMATION OF BASIC RIGHTS IN PUBLIC OFFICIALS; EXPRESSLY RE- PEALING ANY AND ALL PROVISIONS OF THE CHARTER OF THE CITY OF TAMARAC IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the provisions of Florida Statute, Chapter 166 - Municipal Home Rule Powers Act - Section 166.031., thereof, provides a method for Municipal Charter amendments, and WHEREAS, said Section 166.031, Florida Statutes, provides for the submission of a proposed Municipal Charter amendment to the registered electors of the Municipality; and WHEREAS, said Section 166.031, Florida Statutes, provides for the adoption of the proposed amendment to the Charter of the Municipality by a majority of the electors voting in a referendum upon such amendment, and WHEREAS, the City Council of the City of Tamarac, Florida, recognizes the inalienable rights of the citizens of the United States of America and the State of Florida as same are afforded protection under the Constitution of the United States of America and the Constitution of the State of Florida, and WHEREAS, the City Council of the City of Tamarac, Florida, is desirous of reaffirming the position that public servants and officers indeed possess the inalienable rights; and WHEREAS, the City Council of the City of Tamarac, Florida, is desirous of amending the Charter of the City of Tamarac to signify such reaffirmation, NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC OF TH15 STATE OF FLORIDA, AS FOLLOWS: SECTION 1: That the City Council of the City of Tamarac, Florida, does hereby submit and direct the submission of the following proposed amendment of Article XX - Miscellaneous Provisions - of the Charter of the City of Tamarac, to the electorate for referendum to be held on the 4th day of March, 1975; said provision to be designated Sec. 'i - C: Sec.E��C. Guarantee of Constitutional rights Notwithstanding any and all provisions to the contrary appearing herein, each and every member of the elective bodies comprising, in part, the municipal government of the City of Tamarac, shall have the absolute and inalien- able right to become a member of, belong to, hold office in and otherwise function as an officer or agent of any civic, political, religious and/or non-profit organization, with- in or without the corporate limits of the City of Tamarac, and such membership and/or position shall not be deemed to constitute a conflict of interest as otherwise described herein. SECTION 2: That the Election Board is hereby directed to. place the proposed amendment, set forth immediately above, on the ballot pertaining to the general election to be held on the 4th day of March, 1975, as follows: Shall Article XX - Miscellaneous Provisions - of the Charter of the City of Tamarac be amended by the addition of the following Section: Sec. I_ rights Guarantee of Cdnstitutional Notwithstanding any and all provisions to the contrary appearing herein, each and every member of the elective bodies comprising, in part, the municipal government of the City of Tamarac, shall have the absolute and inalien- able right to become a member of, belong to, hold office in and otherwise function as an officer or agent of any civic, political, - 2 - religious and/or non-profit organization, with- in or without the corporate limits of the City of Tamarac, and such membership and/or position shall not be deemed to constitute a conflict of interest as otherwise described herein. SECTION 3: Should any section or provision of this Ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
