HomeMy WebLinkAboutCity of Tamarac Ordinance O-1975-002r ' This Ordinance introduced by: C"� ii�� �l (IGX,4" c0Li-.C' Temp. 271 CITY OF TAMARAC, FLORIDA ORDINANCE NO: 7S-- 2— AN ORDINANCE PROVIDING FOR THE SUBMISSION OF AN AMENDMENT TO ARTICLE XIV - FINANCIAL PROCEDURES - OF THE CHARTER OF THE CITY OF TAMARAC, FLORIDA, TO THE ELECTORATE; PRO- VIDING FOR THE EXPENDITURE OF REVENUES COLLECTED PURSUANT TO CHAPTER XX, SECTIONS 20-42, 20-46 AND 20-47 OF THE TAMARAC CITY CODE, FOR THE PURCHASE OF RECREATIONAL FACILITIES; EXPRESSLY REPEALING ANY AND ALL PROVISIONS OF THE CHARTER OF THE CITY OF TAMARAC IN CONFLICT; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the provisions of Florida Statute, Chapter 166 - Municipal Home Rule Powers Act - Section 166.031, thereof, provides a method for Municipal Charter amendments, and WHEREAS, said Section 166.031, Florida Statutes, provides for the submission of a proposed Municipal Charter amendment to the registered electors of the Municipality; and WHEREAS, said Section 166.031, Florida Statutes, provides for the adoption of the proposed amendment to the Charter of the Municipality by a majority of the electors voting in a referendum upon such amendment, and WHEREAS, the City Council of the City of Tamarac has been advised of and deems it wise to provide for the expenditure of certain designated funds for the purpose of the purchase of recreational facilities to be used and enjoyed by the residents of the City of Tamarac, their guests and invitees, and WHEREAS, the City Council of the City of Tamarac is desirous of submitting the proposed amendment to said Charter to the electors, NOW, THEREFORE, BE IT ORDAINED_BY THE CITY COUNCIL OF THE CITY OF TAMARAC OF THE STATE OF FLORIDA, AS FOLLOWS: SECTION 1: That Article XIV - Financial Procedures - of the Charter of the City of Tamarac shall be amended by the addition �. of the followign Section IQ'1` : Sec. 103A purchase of recreational LJ I facilities and _equipment with moneys collected pursuant to the requirements contained within Chapter 20-Plattin - Article IV, thereof, of the Tamarac City Code. Notwithstanding any other provision of this Charter to the contrary, and without limit as to the amount respecting the expend- iture of public funds contained herein, all fees collected from builders, developers or others coming within the requirements of Article IV, Chapter 20 and in no event from tax revenues, pursuant to the requirements of Article IV, Acquisition and Development of Park and Recreation sites, Chapter 20 - Platting of the Tamarac City Code, may be used pursuant to the provisions of this Charter with respect to the expenditure of public funds, for the purchase of recreational sites and recreational facilities including, but not limited to, equipment, both perishable and non-perishable, and improvements, without the need of submitting such proposed expendi- tures) to the electorate by referendum as may otherwise be required herein. SECTION 2: That the Election Board is hereby directed to place the proposed amendment, set forth immediately above, on the ballot pertaining to the general election to be held on the 4th day of March, 1975, as follows: Shall Article XIV - Financial Procedures - of the Charter of the City of Tamarac be amended by the addition of the following Sectior. : Sec. 103A. Purchase of recreational facilities and e ui meat with moneys collected pursuant to the re uirements contained within Cha ter 20 - Platting - Article IV, thereof, of the Tamarac Citv Code. Notwithstanding any other provision of this Charter to the contrary, and without limit as to the amount respecting the expenditure of public funds contained herein, all fees collec- ted from builders, developers or others coming within the requirements of Article IV, Chapter 20 and in no event from tax revenues, pursuant to the requirements of Article IV, Acquisition and Development of Park and Recreation sites Chapter 20 - Platting - of the Tamarac City Code, may be used pursuant to the provisions of this Charter with respect to the expenditure of public funds, for the purchase of recreational sites and recreational facilities including, but not limited to, equipment, both perish- able and non-perishable, and improvements, without the need of submitting such proposed expenditure(s) to the electorate by referendum as may otherwise be required herein. - 2 SECTION 3: Should any section or provision of this Ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
