HomeMy WebLinkAboutCity of Tamarac Ordinance O-1975-007This introduced by. 2 7-2- CITY OF TAMARAC, FLORIDA ORDINANCE NO. 7 6- 7 AN ORDINANCE REGULATING DAY NURSERIES; PROVIDING FOR ADOPTION OF STANDARDS PROMULGATED BY BROWARD COUNTY, FLORIDA; PROVIDING ADDITIONAL STANDARDS FOR ESTABLISHMENT OF DAY NURSERIES IN TAMARAC; REPEALING ALL LAWS IN CONFLICT, PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac, Florida, is concerned with the health, safety and welfare of the minor children who would attend day nurseries established within the corporate limits of the said City; AND WHEREAS, the City Council of the City of Tamarac is desirous of adopting those regulations promulgated by Broward County, Florida, for the regulation and operation of child care centers; WHEREAS, the City Council of the City of Tamarac, Florida, is further desirous of promulgating additional requirements that must be met for the establishment of a day nursery within the said City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, CITY OF TAMARAC, FLORIDA: SECTION 1: There is hereby established Chapter 12A of the Code of Ordinances of the City of Tamarac, Florida: Section 12A-1 PURPOSE OF ARTICLE. The purpose of this article is to protect the health, safety and general welfare of those minor children who attend day nurseries within the City of Tamarac, Florida. Section 12A-2 BROWARD COUNTY REGULATIONS FOR THE OPERATION OF CHILD CARE CENTERS ADOPTED BY REFERENCE. a. Chapter 61-1955 Acts of Florida 1961 and amended by Chapter 63-1171 Acts of Florida 1963 and Chapter 65-1325 Acts of Florida 1965 and Chapter 67-1169 Acts of Florida 1967 and Chapter 74-447 Acts of Florida 1974 are hereby adopted by reference as part of this article. 12A-3 PHYSICAL FACILITIES No set back or yard area required by the zoning ordinances of the City of Tamarac, shall be used as usable area of outdoor space per child as defined in Section 6 (d) of the Regulations for the Operation of Child Care Centers in Broward County, Florida, nor shall said yard or set back area be calculated to arrive at the necessary usable area of the outdoor space per child as required in said section. 12A-4 PROHIBITION OF DAY NURSERIES CONTIGUOUS TO ESTABLISHMENTS EMITTING NOXIOUS OR OFFENSIVE ODORS. It shall be prohibited to establish a day nursery in any area of the"City of Tamarac wherein said day nursery would be immediately contiguous to a business which would from time to time emit noxious or offensive odors, or from which would be emitted fumes which could be detrimental to the health, safety or welfare of minor children. 12A-5 SPECIAL REQUIREMENT FOR PARKING IN DRIVEWAY FOR EXCESS VEHICULAR TRAFFIC. All day nurseries shall be required to provide sufficient driveway and parking facilities so as to allow excess vehicular traffic during those periods of time when children are being delivered or picked up from the said facility. The establishment of the sufficiency of the parking facilities and driveway area shall be at the discretion and recommendation of the Planning Commission, subject to approval by the Council. SECTION 2: Should any section or provision of this Ordinance or any portion hereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
