CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE REQUIRING THE SUBMISSION OF A SEALED SURVEY
PURSUANT TO AN APPLICATION FOR A BUILDING PERMIT, AND THE
REQUIREMENT FOR SUBMISSION OF A LOCATION CERTIFICATION
UPON LAYOUT OF THE STEMWALL OR POURING OF THE SLAB;
PROVIDING A SAVINGS CLAUSE; REPEALING LAWS IN CONFLICT;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning Commission of the City of Tamarac, Florida
has determined that it is in the interest of the City of Tamarac that
a sealed survey be required when an application for a building permit
is received in the City of Tamarac; and
WHEREAS, the Planning Commission of the City of Tamarac, Florida
has further determined that it is in the interest of the City of
Tamarac to require the submission of a location certification upon
layout or construction of a building foundation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION l: That all applications for a building permit shall
be accompanied by a plan on which is shown the proposed location
of the building in reference to property lines, in addition to
other information required in Section 302.2 (f) of the South Florida
Building Code, with a registered Land Surveyor's seal affixed thereon.
SECTION 2: That upon layout of the t temwall or pouring of the
slab or other foundation, construction reference points or the
"as -built" foundation perimeter and elevation shall be verified in
writing by a registered Land Surveyor. Such certification, with the
registered Land Surveyor's seal affixed thereon and which shall
indicate that all set -back requirements have been met and that the
building location is in all respects in accordance with the applicable
ordinances of the City of Tamarac, shall be required to be submitted
to the Building Department of the City of Tamarac, Florida before
building construction continues.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared
by a Court of Competent Jurisdiction to be invalid, such decision..._
shall not affect the validity of the remainder hereof as a whole or
any part hereof other than the part declared to be invalid.
SECTION 5: This ordinance becomes effective immediately upon
its final passage.
