AN ORDINANCE AMENDING ORDINANCE NO.
74-29 BY INCREASING THE MEDIAN CUT
PERMIT FEE FROM $50.00 to $250.00;
PROVIDING STANDARDS FOR THE CONSTRUC-
TION OF PAVEMENT RESTORATION; PRO-
VIDING A PENALTY CLAUSE FOR COMMENC-
ING WORK PRIOR TO ISSUANCE OF A
PERMIT; PROVIDING FOR EXEMPTIONS
FOR UTILITY COMPANIES; PROVIDING A
DEFINITIONAL SECTION; REPEALING
ALL ORDINANCES IN CONFLICT; PROVID-
ING A SAVINGS CLAUSE; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: Section 2 of Municipal Ordinance
No. 74--29 is hereby amended to read as follows:
"Section 2: The applicant for said permit
shall pay to the City as a permit fee a
sum in accordance with the following
schedule:
A. As to all streets, constructed and
paved, resurfaced or repaved, on or
before May 9, 1973 and where street
cuts are 4" or less in width, the
fee shall be $25.00 per driving lane.
B. As to all streets constructed and
paved, resurfaced or repaved, which
are not included under Section 2 A
above, the permit fees shall be as
follows:
(1) Street Cuts
Streets paved, resurfaced or re -
paved within one year prior to
application:
$500.00/Driving Lane
Streets paved, resurfaced or repaved
within two years prior to application
$250.00/Driving Lane
Streets paved, resurfaced or repaved
more than two years prior to applica-
tion
$ 50.00/Driving Lane
(2) Median Cuts
Per median cut with stack4ane
$250.00
Per median cut without stacking lane
and with curbing
$200.00
Per median cut without stacking
lane and without curbing
$ 50.00
(3)Sidewalks or thoroughfare not

C. Restoration shall be in accordance with
Method C attached hereto."
SECTION 2: The following additional standards
shall be established:
"Section 8: All natural foliage removed
as a result of street cuts, median cuts,
sidewalks or thoroughfare cuts, shall be
relocated at the discretion of the City
Manager. All costs of relocation shall
be borne by the applicant.
Section 9: Pavement restoration shall
consist of at least 1-inch (compacted
thickness of type S-I)Bituminous Concrete
Surface on top of a minimum of 6-inches
of high -early strength, 3,000 psi, port -
land cement concrete in which a hot -dipped
- galvanized 6-inchsq.16 gage welded wire
reinforcing mesh is installed at mid -
depth over the trench and for at least 6-
inches on either side. The concrete shall
be poured on a minimum 12-inch thickness
of pavement base course quality limerock
which has been compacted to 98% of the
maximum density obtained during a Proctor
compaction test in accordance with AASHO
Designation T-180; Method C. The remain-
ing backfill materials shall be compacted
to 95% of their maximum densities, except
that the 12-inches of materials surround-
ing the conduit need be no more than 90%
of their maximum densities as herein de-
fined.
Section 10: Laboratory and field tests
which are, in the opinion of the City
Engineer, necessary to establish compli-
ance with the compaction requirements of
Section 2, above, shall be conducted at
the applicant's expense. Tests shall be
made at such depths and locations as
selected by the City Engineer.
Section 11: Except for emergencies, the
above permit fees shall be doubled if work
commences before a permit is issued to
the applicant. If the street opening is
covered before test samples have been

taken or the City Engineer has granted
permission, he may order the backfill
and/or restoration work removed for
whatever testing and inspection he re-
quires.Permits expire (60) calendar days
following issuance; provided however one
(30) day extension may be granted for good
cause by the City Engineer.
SECTION 12. Utility companies whose franchise
agreement with the City provide for the de-
duction of permit and/or inspection fees and/or
costs from the time to time may obtain permits
without the payment of fees therefor.
SECTION 13. For the purpose of this Ordinance,
street shall mean the entire public right-of-
way, whether paved or not, and "street cut" shall
mean any excavation within, on or under the street.
SECTION 3: Should any section or provision of this
ordinance or any portion hereof or any paragraph, sentence
or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder thereof as whole or any part hereof other than
the part declared to be invalid.
SECTION 4: All Ordinances or parts of Ordinances in con-
flict herewith are hereby repealed.
SECTION 5: This Ordinance shall become effective immediately
upon its final passage.
