AN ORDINANCE REGULATING THE USE AND
OPERATION OF BOATS OR VESSELS WITH-
IN THE WATERWAYS OF THE CITY OF TAMARAC;
PROVIDING A SAVINGS CLAUSE; REPEALING ALL
LAWS IN CONFLICT HEREWITH; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 11 g. of the Charter of the City of
Tamarac grants the City the power to regulate and control the
use and occupancy of the waters, waterways, water bottoms,
in the City, and
WHEREAS, in furtherance of protecting the public's health,
safety, and welfare, the City Council of the City of Tamarac
deems it advisable to establish and provide regulations con-
cerning the use and operation of boats or vessels within the
waters and waterways of the City Tamarac.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: No boat or vessel shall be operated upon
any waterway or drainage canal in the City of Tamarac to which
is attached, bolted, appended, affixed or in any way made a
part of said boat or vessel, an internal or external combustion
engine; provided however, boats or vessels owned or operated
by the City of Tamarac shall be exempt from this Ordinance
when used solely for maintenance purposes or in the event
of an emergency.
SECTION 2: A person is guilty of careless operation of
a boat or vessel who operates any boat or vessel or through
the operation of same with disregard for the safety of persons
or property, or without due regard, caution, and circumspection,
or at a speed or in a manner as to endanger, or may endanger,
life or limb or damage the property of or injure any person.
SECTION 3: All ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.

SECTION 4: Should any section or provision of this
ordinance or any portion hereof or any paragraph, sentence
or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not effect the validity of
the remainder hereof as a whole or any part hereof other than
the part declared to be invalid.
SECTION 5: This ordinance becomes effective immediately
upon its final passage.
