CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE CREATING THE POSITION OF
TRAFFIC ACCIDENT INVESTIGATION OFFICER
IN THE DIVISION OF POLICE, DEPARTMENT
OF PUBLIC SAFETY OF THE CITY OF TAMARAC;
PROVIDING STANDARDS FOR TRAINING; PRO-
VIDING POWER; PROVIDING FOR RESTRICTION
OF ARREST POWER AND AUTHORITY TO CARRY
FIREARMS; PROVIDING A SAVINGS CLAUSE;
REPEALING ALL LAWS IN CONFLICT HERE-
WITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 316, Florida Statutes, Section
316.016(3)(b), thereof, provides the power in a chartered munici-
pality to employ a Traffic Accident Investigation Officer, and
WHEREAS, the City Council of the City of Tamarac, Florida,
upon investigation and inquiry, deems it advisable to provide -for
the employment of said Traffic Accident Investigation Officer
within the Department of Public Safety, Division of Police,
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The Department of.Public Safety, Division of
Police, shall have the power, in accordance with any and all appli-
cable Charter provisions or ordinances, to employ an individual as
a Traffic Accident Investigation Officer, pursuant to Chapter 316,
Florida Statutes, Section 316.016(3)(b), thereof.
SECTION 2: Educational Instruction: No individual shall
be employed as a Traffic Accident Investigation Officer unless such
individual shall have successfully completed at least two hundred
(200) hours of instruction in traffic accident investigation and
Court presentation through the Selective Traffic Enforcement
Program (STEP) as approved by the Police Standards Board and funded
through the National Highway Traffic Safety Administration (NHTSA)
or a similar program approved by the Police Standards Board.
SECTION 3: Power to Issue Traffic Citations: Any Traffic
Accident Investigation Officer employed by the City of Tamarac
through the Department of Public Safety, Division of Police, shall

have the power pursuant to Chapter 316, Florida Statutes, Section
316.016(3)(b), thereof, to issue traffic citations when, based on
personal investigation at the scene of a traffic accident, such
Traffic Accident Investigation Officer has reasonable and probable
grounds to believe that a person involved in said traffic accident
has committed an offense under the provisions of Chapter 316,
Florida Statutes, in connection with the traffic accident.
SECTION 4: Restriction on Power: Nothing in this
Ordinance contained, shall be construed to permit the carrying of
firearms or other weapons, nor shall such Traffic Accident
Investigation Officer have arrest authority other than for the
issuance of a traffic citation as authorized herein and by Florida
Statute, Chapter 316.
SECTION 5: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such conflict.
SECTION 6: Should any section or provision of this
Ordinance or any portion hereof or any paragraph, sentence or word
be declared by a Court of competent jurisdiction to be invalid,
such decision shall not effect the validity of the remainder hereof
as a whole or any part hereof other than the part declared to be
invalid.
RRCTTON 7: This Ordinance becomes effective immediately
upon its final passage.
