CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 1
AN ORDINANCE ESTABLISHI G A TRAFFIC
VIOLATIONS BUREAU WITHIN THE MUNICIPAL
COURT OF THE CITY OF TAMARAC; PROVID-
ING FOR THE FUNCTIONS OF SAID BUREAU;
PROVIDING A SAVINGS CLAUSE; REPEALING
ALL LAWS IN CONFLICT HEREWITH; PROVID-
ING AN EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida did
enact Florida Statute, Chapter 318, known and cited as the
"Florida Uniform Disposition of Traffic Infractions Act", and
WHEREAS, the Supreme Court of the State of Florida has
promulgated a rule applicable to Municipal Courts, which rule is
known as "Transition Rule 20", and
WHEREAS, Rule 6.100 of "Transition Rule 20" provides,
in pertinent part, that any Court handling criminal traffic
offenses or traffic infractions shall establish a Traffic Violations
Bureau by local rule, and
WHEREAS, the City Council of the City of Tamarac, Florida,
is desirous of establishing a Traffic Violations Bureau,
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: There is hereby established, within the Muni-
cipal Court system of the City of Tamarac, Florida, a bureau which
shall be known as the "Traffic Violations Bureau". Said Traffic
Violations Bureau shall operate under and pursuant to the Judicial
Administrator of the Municipal Court.
SECTION 2: Functions: The funcition of the Traffic
Violations Bureau shall be to accept appearances, waivers of non-
criminal hearings, admissions and payment of civil penalties for
traffic infractions not requiring a mandatory hearing, as said
traffic infractions are set forth in Florida Statute, Chapter 318.
The Traffic Violations Bureau may also accept appearances, waivers
of hearing, admissions and payment of civil penalties as provided
in Section 318.18 of Chapter 318, Florida Statutes, in traffic
infractions cases where the driver originally elected, but was
not required, to appear before an official prior to the date of
the hearing.
SECTION 3: Report of Cases: All cases processed in
the Traffic Violations Bureau shall be numbered, tabulated and
reported for identification and statistical purposes. Any
statistical reports required by law and the number of cases
disposed of by the Traffic Violations Bureau shall be listed
separately from those disposed of in open court.
SECTION 4: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such conflict.
SECTION 5: Should any section or provision of this
Ordinance or any portion hereof or any paragraph, sentence or word
be declared by a Court of competent jurisdiction to be invalid,
such decision shall not effect the validity of the remainder hereof
as a whole or any part hereof other than the part declared to be
invalid.
SECTION 6: This Ordinance becomes effective immediately
upon its passage.
